6)La automatización a la que se somete la producción en masa o en serie implica una ampliacón de los mercados de consumo pero también obviamente se afrontan riesgos técnicos sobre os cuales nadie en particular puede ejercer un control absoluto. El deber de responder no se agota en la razón de un daño “injustamente causado”. El riesgo creado presupone una actividad humana que incorpora al medio social una cosa peligrosa por su naturaleza o su forma de utilización.
7) Sentado eso, en cuanto al planteamiento que hace la parte actora referente al supuesto de responsabilidad que le cabría a la demandada habrá de apuntarse que encuadra en la categoría de “fabricante no vendedor”, situación en la cual no existe nexo contractual con el adquirente o consumidor, o bien el caso de que el producto haya causado un daño a un tercero no vinculado por contrato con el fabricante.

6) The automation of mass or series production thanks to technology involves an expansion of consumer markets but there are technical risks that need to be faced which fall outside the absolute control of any person. The duty to respond to those risks is not solely attributable to an “unfairly caused damage” but is also attributable to an “unfairly sustained damage”. The risk created leads to the assumption that there is a certain human activity that incorporates a risky component into the social environment owing either to the nature or utilization method thereof”
7) Having stated the above, now, with regard to the claims made by plaintiffs as to the alleged liability of defendant, it should be worth highlighting that defendant can be classified as “non- selling manufacturer”: which implies no privity of contract between the manufacturer and purchaser or consumer, or else this can be classified as a case in which the product has caused damage to a third party having no contractual relationship with the manufacturer.
