Source text - English There is a statutory right in English law not to be unfairly dismissed from employment, as provided by s. 94 Employment Rights Act 1996. An employee normally requires at least one year’s service with his or her employer in order to be eligible to pursue an unfair dismissal claim. This qualifying period does not apply however in discrimination cases (such as dismissals based on race, sex, disability, sexual orientation or religious/belief discrimination). There is a three-month limitation period (commencing from the date of dismissal) for issuing a claim for unfair dismissal. The venue for hearing unfair dismissal claims is known as an Employment Tribunal (ET).
Translation - Polish W prawie angielskim istnieje ustawowy przepis, chroniący przed bezzasadnym zwolnieniem z pracy, regulowany artykułem 94 Ustawy o prawach zatrudnienia z 1996 roku. Zwykle, aby uzyskać prawo do złożenia skargi z tytułu bezzasadnego zwolnienia, pracownik powinien być zatrudniony u danego pracodawcy przez co najmniej rok. Powyższy okres kwalifikacyjny nie ma jednak zastosowania w sprawach o dyskryminację (a zatem nie dotyczy zwolnień wynikających z dyskryminacji ze względu na rasę, płeć, niepełnosprawność, orientację seksualną czy wierzenia i przekonania religijne). Okres, w którym można złożyć pozew, ograniczono do trzech miesięcy (licząc od dnia zwolnienia), po czym następuje przedawnienie. Sprawy o bezzasadne zwolnienie są rozpatrywane przez Sąd Pracy.
