Introduction
The popular uprisings that swept through North Africa took the world by surprise. It was the self-immolation of a 26-year-old Mohamed Bouazizi that triggered the popular unrest that engulfed Tunisia and spread, at its wake, like wild-fire to the rest of North Africa and the wider Arab World. Both the scale and speed of the popular uprisings as well as their results have been startling. The uprisings proved to be events for which even the governments in those countries were ill-prepared, let alone the rest of the world. They were extraordinary events whose occurrence can hardly be anticipated. And as such, they are not like any other crisis situation which can be envisioned and for which response mechanisms of inter-governmental entities can ordinarily prepare themselves.
Extraordinary as these events are, it cannot necessarily be concluded that they are entirely beyond the purview of the normative and policy instruments of the African Peace and Security Architecture (APSA). Nevertheless, the nature of the events as well as the issues that to which they gave rise and the response of the AU raise important questions regarding the adequacy of the APSA for handling such kinds of events. This is the question that this paper seeks to investigate.
Normative and Policy Framework of the African Peace and Security Architecture
One way of interrogating the adequacy or lack thereof of the APSA vis-à-vis such popular uprisings is to look at whether the popular uprisings fit in any of the APSA instruments. This mainly entails an examination of the APSA norms and policy instruments through the prism of the popular uprisings and the underlying issues that precipitated them. More specifically, it is important to examine the threats and issues to which APSA normative and policy frameworks address themselves.
The normative and policy framework of the AU peace and security regime is founded on a number of the Organisation’s legal and policy instruments. The Constitutive Act (herein after the Act) is the foundation of these instruments. The other instruments include the AU Protocol on the Establishment of the Peace and Security Council (PSC Protocol) and the Common African Defense and Security Policy. The normative framework of the AU peace and security regime comprises the norms/values and principles enunciated in these and related instruments.
The Act enunciates under Article 4 the founding principles underlying the AU’s legal and institutional framework. Of the 18 principles listed, the ones that are of particular importance with respect to popular uprisings are respect for human rights, sanctity of human life and democratic principles, and good governance; rejection of impunity and unconstitutional changes of governments; and the right of the AU to intervene in a member state in case of grave circumstances. The two objectives of the AU relevant in this context, as set out in the Act, are to ‘promote democratic principles and institutions, popular participation and good governance’, and to ‘promote and protect human and peoples’ rights in accordance with the African Charter on Human and Peoples’ Rights and other relevant human rights instruments’.
The Protocol Relating to the Establishment of the Peace and Security Council (PSC) recognises ‘the fact that the development of strong democratic institutions and culture, observance of human rights and the rule of law, as well as the implementation of post-conflict recovery programmes and sustainable development policies, are essential for the promotion of collective security, durable peace and stability, as well as the prevention of conflicts’.
The normative basis for the AU’s peace and security regime is further elaborated in the Solemn Declaration on a Common African Defense and Security Policy (CADSP). This Declaration identifies human security as an important basis and measure of the continental collective security system. Accordingly, it draws attention to the need to focus on human rights, good governance, democracy, and equitable social and economic development. The policy also identifies as common security threats not only inter-state conflicts or tensions and external threats, but also intra-state conflicts or tensions. Given the high incidence of intra-state conflict, these pose the greatest danger to peace and security of the continent. The threats identified under this category include the following:
The existence of grave circumstances, namely war crimes, genocide and crimes against humanity.
Lack of respect for the sanctity of human life, impunity, political assassination, acts of terrorism and subversion.
Coups d’etat and unconstitutional changes of government, as well as situations that prevent and undermine the promotion of democratic institutions and structures, including the absence of the rule of law, equitable social order, population participation and electoral processes.
Improper conduct of electoral processes.
Absence of the promotion and protection of human and peoples’ rights, individual and collective freedoms, equitable opportunity for all, including women, children and ethnic minorities.
Poverty and inequitable distribution of natural resources.
Corruption.
Of the various themes covered in the APSA norms, those that are of particular importance for managing popular uprisings include the prohibition of unconstitutional changes of government, lack of functioning democracy, poverty and inequitable distribution of and access to resources and opportunities, absence of respect for and protection of human and peoples’ rights, and abesence of good-governance, including coruption. It is important to note that there are various instruments that in detail elaborate these norms and establish mechanisms for their institutionalization within the AU decision-making processes. These include the African Charter on Human and Peoples’ Rights (1981), the African Charter on Democracy, Election and Governance (2007), the Cairo Agenda for Economic Recovery and Social Development in Africa (1995), the Algiers Decision on Unconstitutional Changes of Government (1999), the Grand Bay Declaration and Plan of Action on Human Rights in Africa (1999), the Lomé Declaration on the OAU Response to Unconstitutional Changes Government (2000), the New Partnership for Africa Development of the African Union (2001), the OAU/AU Declaration on the Principles Governing Democratic Elections in Africa (2002), the Kigali Declaration on Human Rights in Africa (2003) and the AU Convention on the prevention of and fight against corruption (2003). For the AU, the major challenges have thus far been the establishment of a systematic and coherent implementation mechanism and operationalizing effective functional linkages between these commitments to democracy, human rights and governance and the APSA. The elaboration of a governance architecture that is currently under way should serve as an opportunity to overcome these challenges and systematically integrate the works of institutions such as the African Commission and Court on Human and Peoples’ Rights into the processes of the APSA such as Peace and Security Council of the AU.
Considerations for determining the legitimacy of popular uprisings
While many of the normative and policy frameworks of the APSA, as briefly explored above, are relevant, they offer no systematic and particular guidance on how to respond to popular democratic uprisings. As former South African President Thabo Mbeki recently put it, ‘The stark choice Africa faced was – should we side with the demonstrators or with the governments they demanded should resign!’ At the heart of this lies the difficulty of distinguishing between legitimate uprisings and those that may amount to situations that APSA norms and policy instruments proscribe.
Based on the purpose and object of the APSA norms and policy instruments and the experience from North Africa, it is necessary to identify the considerations for determinig the legitimacy of popular uprisings. This may help in developing guidelines for the AU to make principled response to similar events in the future. In this regard it is possible to identify six considerations which are key in responding to popular uprisings.
The first consideration relates to the existence of what the CADSP refers to as ‘situations that prevent and undermine the promotion of democratic institutions and structures, including the absence of the rule of law, equitable social order, population participation and electoral processes.’
As an examination of the uprisings in North Africa reveals, what precipitated the popular uprisings include the existence of circusmtances that undermined democratic institutions and structures. The existence of these circumstances leave citizens with no institutional mechanism of redressing their grievances and holding their leaders to account, forcing them instead to resort to protests and popular uprisings. The popular uprisings in North Africa express deep-seated anger and frustration of ordinary citizens against corrupt, tyrannical and undemocratic political orders. In responding to events of this kind, this is the first consideraiton that the AU needs to make.
The other consideraiton is the organizaiton and nature of mobilizaiton of protestors. The test here is the issue of whether the uprising involves an attmpt on the part of a particular political grouping or section of society to impose its political agenda. In terms of organization and mobilization, the popular uprisings in North Africa were not driven by and associated with prevailing political groupings and ideological divisions in these countries. As Omar Ben Yeder, wrote on Tunisia’s uprising, ‘[t]his was a spontaneous uprising by the people, not sparked by any particular political leader or movement.’ They did not thus involve partisan political agenda nor did they seek to impose a political agenda of one political grouping or section of society over others. They rather espoused popular aspirations and expectations for a reformed political and socio-economic order. They were mostly mobilized through social media with young activists serving as catalysts and organizers.
The third consideraiton is the popularity of the uprisings. Here the question is whether or not the participation in the uprisings transcend prevailing ideological, religious, ethno-cultural, and other sectoral cleavages in society. Seen from this perspective, it emerges that one of the features of the North African uprisings that gave them their democratic character was that they were popular. The involvement in the protests was not limited to a particular section of the society. While most of the people who were active in the uprisings are the youth and people from middle and lower income backgrounds, the uprisings nevertheless attracted people from almost all walks of life and age group as well as people from different religious, cultural, ideological and political affiliations. In this regard, Ben Yeder is right when he stated ‘[t]he show of solidarity throughout the country, its diaspora and across all social classes was unique, unexpected and intensely uplifting.’
The fourth consideration is the peacefulness of the uprisings. As suggested above, various instruments of APSA, particularly the African Charter on Human and Peoples’ Rights, guarantee the right of peaceful assembly. One of the most notable features of the North African uprisings, with the notable exception of case of Libya, was that they were largely peaceful, except the sporadic expressions of anger and defiance to efforts at countering the demonstrations.
The fifth consideration is the involvement of the military. Given the AU’s rules on unconstitutional changes of government, the constitutionality of the active involvement of the military in movements for toppling governments can be highly questionable. Once again, it is interesting to note that the militaries in both Tunisia and Egypt maintained their neutrality. They were involved neither in instigating nor in actively helping the removal of their presidents. Despite its standing in the history and politics of the country, even the Egyptian army maintained a ‘hands-off’ approach until Mubarak eventually bowed to the public pressure to stand down. This is another feature that sets the Libyan case apart from others, as the situation there has turned into a full blown civil war following the defection of military personnel to the rebel side and their organisation of what is now an effective army. Despite the similarity that it shares with the uprisings in Tunisia and Egypt, the case of Libya should therefore be treated differently, as a civil war. AU’s Roadmap for resolving the crisis in Libya does exactly that.
A final consideration is the involvement of external actors. Where external actors are deeply involved in instigating or actively supporting uprisings, the right of the people in that society to self-determination gets compromised with the consequence of rendering the country amenable to the manipulation of outside forces. One of the fine features of the uprisings in North Africa was that they were fully initiated and executed by ordinary men and women. There was also no external involvement or direct support for the protests. The protests were wholly motivated by the internal political and socio-economic ills that prevailed in their societies for sometime. They are people-driven efforts to determine and shape the political and economic directions of their society, an exercise of self-determination par excellence. Again, the Libyan experience deviates from this characteristic, in view of NATO’s military intervention on the side of the protesters-cum-rebels.
Role of the AU
Broadly speaking, the role of the AU with respect to popular uprisings can be divided into two. First, the AU has a preventive role. This requires the development and implementation of initiatives and strategies for the progressive realization and implementation of the norms and principles that constitute the shared values of AU member states. The other role of the AU is to respond to the uprisings and the crises relating thereto.
Preventive role of the AU
Increased access to information and technology by a rising number of people in Africa will continue to deepen the political activism of citizens in many parts of the continent. Under such circumstances, citizens in many African countries will tend to be less willing to tolerate autocracy, corruption, lack of socio-economic opportunities, and heightened poverty. There is thus deepening expectation that governments show and register tangible progress in building and entrenching democracy and good governance as well as respect for human rights and in pursuing economic policies that enhance economic growth and progressively reduce poverty.
The legitimacy of African governments depends on the degree to which they meet these expectations. In the years to come, whether or not governments will face popular opposition and experience popular rebellion will depend on the success that they register in these critical areas. There is only one choice for AU member states, to deliver on the socio-economic and political needs and expectations of their people or face the wrath of increasingly enlightened and active youthful public. It would not at all be enough that a government delivers and focuses exclusively on economic growth only. Delivery based legitimacy is not enough. African governments need to put as much investment on achieving functioning democracies and institutionalizing and deepening good governance.
As we have seen above, the AU has developed several norms and institutions on democracy, governance, peace and security. The implementation of the commitments to democracy, good governance and human rights as well as equitable socio-economic development has now become imperative. This is the most sustainable guarantee for peace and security and for preventing popular upheavals.
In a statement that he made during the 275th meeting of the AU PSC Ministers dedicated to a debate on the state of peace and security in Africa, AU Commissioner for Peace and Security, Ambassador Lamamra raised two points of particular importance.
• Regarding democratization and the building of good governance, we need to spare no efforts at all, as failure to uphold democracy and good governance brings big dangers to our continent. The Continent is witnessing an increase in election‐related and governance‐linked crises. This trend must be arrested before it reaches unmanageable proportions. The deepening of democracy and improving political and economic governance could significantly contribute to our efforts to prevent conflicts on the Continent.
• Last, but not least, it is urgent that we invest in employment‐generating economic policies that would provide jobs and better incomes for the population, especially the youth, and contribute to elevating standards of living across the Continent. Indeed, this is one way of preventing future uprisings, like those we are witnessing in North Africa.
The uprisings in North Africa show that the role that the AU plays in facilitating and ensuring the implementation of these norms in member states is critical if such uprisings and other crisis situations are to be prevented. This will also be the litmus test for the continuing relevance of the AU in the lives of ordinary people in Africa. For this AU needs to enhance the effectiveness of some of its normative and institutional frameworks and their implementation. Most notably, there is a need to mainstream the works of the African Commission and Court on Human and Peoples’ Rights and Political Affairs Department of the AU into the APSA processes and institutions.
Response
In terms of response, the APSA normative and policy frameworks have not equipped the AU with effective response and enforcement mechanism for all situations identified as constituting threats to peace and security. This is best illustrated by the fact that the prohibition on unconstitutional changes of government is the only principle of the APSA for whose breach a sanction is specifically prescribed. Thus, Article 30 of the Constitutive Act provides ‘Governments which shall come to power through unconstitutional means shall not be allowed to participate in the activities of the Union.’
No similar response mechanism is developed for breach of other equally important norms of APSA, such as those situations that pricipitated the popular uprisings in Tunisia, Libya and Egypt. The AU has not as yet developed effective means for discouraging systematic violations of human rights of citizens, unconstitutional use of government power and generally bad governance. The failure of the AU instruments as far as responding to deficiencies relating to democracy and constitutional rule is thus that they provide very little about how the AU needs to respond to issues of unconstitutional exercise of power, that is governments that exercise power in a way that undermines constitutional rule – such as by enacting laws that repress freedom of the press, freedom of expression and association, extra-judicial arrest or detention, torture, extra-judicial killings, appointments or dismissals without due process of the law, etc.
Nature of AU response
In examining the response of the AU, there are certain consideraitons to which one should have regard. The first of this is the principle of the APSA stipulated under Article 2 (1) of the PSC Protocol for the timely and efficient response. This commits the AU for speedy and clear response. Such response menas establishing a leadership role for engagement in emergeing situations. Such a response puts the AU in a position to shape the course of internaitonal engagement and the outcome of such engagement. The lack of such response creates the pretext for others global actors to take formulate and implement reponses that do not necessarily cohere with the response that the AU may wish to adopt.
Opinion makers in various parts of the continent expressed the view that the AU has been slow in its response to the uprisings in North Africa. One of the manifestations of AU’s rather slow and hesitant response is the fact that external actors seized the opportunity to project their own response and take lead in engaging in North Africa with the consequence of the marginalizaiton of AU’s voices.
The AU’s response has been not only slow but also weak. During the ministerial meeting of the 275 session of the PSC, Rwanda’s Minister of Foreign Affairs had the following to say on this
We are all in agreement that Africa should not condone a Head of State who holds his own people in contempt. And that we shall never tolerate a Head of State that intentionally takes lives of its own people. Despite all this, why has the African Union not responded timely and take a leadership role to put in place practical steps to stop this? …
[W]hy has the African Union, in such grave situations prevailing and potential outbreak of violence in member States, not called for an extraordinary urgent conference of Heads of State and Governments for prompt deliberations and actions?
Coming as it did even from a member country of the AU, which is also part of the PSC, this view echoes some level of inadequacy or perception of such inadequacy in AU’s reponse.
When considered in the light of the nature of the events in North Africa, the response of the AU, with the exception of its road map and High Level ad hoc Committee on Libya, is regarded to have been weak. For example, when it was first seized of the situation in Libya some weeks after the beginning of the uprising, the AU opted for sending an investigation team, instead of acting immediately. Even after the PSC adopted a communique condemining the killing of civilians and excessive use of forces, the AU has not gone further to take stronger measures against the Libyan government for its violent response against peaceful demonstrators. Apart from condemnation of violence, other measures that may be considered may range from suspension of the country from participation in activities of the Organization, to imposing diplomatic sanctions including severance of diplomatic relations and even withdrawal of recognition and should circumstances warrant ultimately intervention as per Article 4 (h) of the Constitutive Act of the AU.
Apart from timeliness and robustness of response, other important considerations include clarity and coherence of response. When the AU Peace and Security Council met on 10 March 2010, it expressed its “rejection of any foreign military intervention, whatever its form.” But a week later when the UN Security Council adopted its Resolution 1973, the three non-permanent African members of the UNSC voted in favour of a resolution, which prescribed exactly the “foreign military intervention” that Africa had rejected. This revealed a lack of coordination and coherence between Addis Ababa and the African members of UNSC in New York. It also reflected inconsistency in Africa’s response to the crisis.
Effective communication of AU policy response to such events and robust media campaign is another consideration. Apart from timing, part of the reason why the AU voice did not gain the attention of mainstream world media and therefor failed to have an impact, as Thabo Mbeki noted, both ‘on Africa and world opinion’ was that the AU has not effectively communicated its policy response to the events in North Africa, including Libya and it did not deploy robust media campaign. As the comment by the Rwandan Foreign Minister suggests, at some level the AU was also either slow or ineffective in communicating with and mobilizing the totality of AU member states on the subject.
Conclusion and policy recommendaitons
The popular uprisings in North Africa have shown the role and limits of the normative and policy framework of the APSA. Three areas of limitation that require particular attention for policy action have in particular been observed. The first of this is the lack of any guideline on how the AU may determine the legitimacy of popular uprisings for helping it adopt clear and effective responses. The second lacuan in the APSA normative and policy frameworks is that they do not lay down the actions or measures that the AU needs to take in relation to serious deficiencies in member states compliance with AU norms on democracy, constitutionalism, rule of law and respect for and protection of human rights.
There is a need for enhanced focus on dealing with structural deficiencies relating to constitutionalism, human rights and democracy. Institutionally there is thus a need to achieve integration and enhanced coordination among various AU bodies and most importantly to mainstream and institutionalise fully and systematically the works of the African Commission and the African Court on Human and Peoples’ Rights and that of the Political Affairs Department of the AU into the processes of the PSC.
Finally, certain shortcomings have been identified with respect to the nature of the AU response to the uprisings. These shortcomings have cast doubt on the effectiveness and credibility of the AU. It is imperative that steps are taken to rectify these shortcomings. Institutionally, this may require a mechanism for stronger coordination and cohesion not only between Addis Ababa and African representatives in New York but also within Africa between the AU and its member states.

مقدمة
إن الثورات التي اجتاحت شمال أفريقيا قد فاجئت العالم بأسره والتي أشعل شرارتها الأولى محمد البوعزيزي، 26 عاماً، ومن ثم امتدت إلى دول شمال أفريقيا كالنار في الهشيم ثم إلى سائر الوطن العربي. وقد كان مستوى وسرعة هذه الثورات ونتائجها مذهلاً حتى بدت الحكومات التي اشتعلت فيها هذه الثورات غير مستعدة لها بالشكل المطلوب ناهيك عن العالم بأسره. إنها أحداث استثنائية يصعب التنبؤ بها، ولهذا تختلف عن الأزمات الأخرى التي يمكن التحرز منها أو يمكن لمؤسسات الدولة الإعداد لها مسبقاً.
وبما أنها أحداث استثنائية فإنه لا يمكن بالضرورة القول إنها خارج نطاق الأدوات المعيارية وسياسة جهاز "هندسة الأمن والسلم الأفريقية". وعلى أي حال فإن طبيعة هذه الأحداث والقضايا التي أثارتها وردُ الاتحاد الأفريقي يثير أسئلة مهمة تخص كفاءة جهاز "هندسة الأمن والسلم الأفريقية" في التعامل مع هذا النوع من الأحداث . هذا هو السؤال الذي تحاول هذه الورقة تقصيه .

البروتوكول الخاص بإنشاء مجلس الأمن والسلم يعترف بأن تطوير المؤسسات والثقافة الديمقراطية، ورعاية حقوق الإنسان وحكم القانون بالإضافة إلى تنفيذ برامج ما بعد النـزاعات وسياسة التنمية المستديمة كلها مهمة وضرورية لنشر الأمن الشامل والاستقرار ومنع الاقتتال .
الأساس المعياري لجهاز الاتحاد الأفريقي للأمن والسلم مفصل في الإعلان الرسمي لسياسة الأمن والدفاع العام الأفريقي . ويَعتبِر هذا الإعلان أمنَ البشر أساساً مهماً ومقياساً لجهاز الأمن في القارة بصورة عامة. ووفقاً لذلك يلفت هذا الإعلان الأنظار إلى الحاجة إلى التركيز على حقوق الإنسان، الحكومة الرشيدة، والديمقراطية، والتنمية الاجتماعية الاقتصادية العادلة. وتُبَين هذه السياسة أيضاً أن التهديدات الشائعة ليست فقط النـزاعات والاضطرابات بين الدول والتهديدات الخارجية فحسب ولكنها أيضاً النـزاعات والاضطرابات داخل الدولة. وباعتبار إمكانية وقوع نـزاعات داخل الدولة، فإن هذا النوع يعتبر من أسوء المخاطر على الأمن والسلم في القارة . وتشتمل التهديدات المحددة في هذه الفئة على :
• توافر ظروف مأساوية وبالتحديد جرائم حرب، وإبادة جماعية وجرائم ضد البشرية.
• عدم احترام حرمة الحياة والحصانة البشرية، والاغتيالات السياسية، وأفعال الإرهاب والتخريب.
• الانقلابات العسكرية والتغييرات غير الدستورية في الحكومة، بالإضافة إلى الحالات التي تمثل عائقاً في طريق نشر المؤسسات الديمقراطية، وغياب حكم القانون، ونظام اجتماعي عادل، والمشاركة الشعبية في العمليات الانتخابية.
• ممارسات غير لائقة في العمليات الانتخابية.
• غياب نشر ورعاية حقوق الإنسان والحرية الفردية والجماعية، وغيار الفرص المتعادلة للجميع بمن فيهم النساء، والأطفال والأقليات العرقية.
• الفقر والتوزيع الجائر للموار الطبيعية.
• الفساد.
من المواضيع المختلفة التي يغطيها جهاز "هندسة الأمن والسلم الأفريقية" والتي تتمتع بأهمية بالغة في إدارة الثورات الشعبية هو منع التغييرات غير الشرعية في الحكومة، وعدم تفعيل الديمقراطية، والفقر والإجحاف في توزيع الموارد والفرص، وعدم احترام أو العناية بحقوق الإنسان، وغياب الحكومة النموذجية، والفساد. وتجدر الإشارة إلى أنه هناك العديد من الأداوت التي تشرح بالتفصيل هذه القواعد وتأسس لها آليات تجعل منها قواعد مقبولة في عمليات صنع القرار في الاتحاد الإفريقي. ومن تلك الأدوات الميثاق الأفريقي لحقوق الإنسان ( 1981م )، الميثاق الأفريقي للديمقراطية، الانتخابات والحكومة (2007م)، خطة القاهرة للانتعاش الاقتصادي والتنمية الاجتماعية في أفريقيا، قرار عاصمة الجزائر حول التغييرات غير الدستورية في الحكومة في العام 1999م، إقرار وخطة غراند باي لشؤون حقوق الإنسان في أفريقيا، إعلان لومي في رد منظمة الوحدة الإفريقية حيال التغييرات غير الدستورية في الحكومة 2000م، الشراكة الجديدة لتطوير أفريقيا التابعة للاتحاد الأفريقي 2001م إعلان منظمة الوحدة الأفريقية أو الاتحاد الأفريقي للمبادئ التي تنظم الانتخابات الديمقراطية في أفريقيا عام 2002م ، إعلان كيغالي لحقوق الإنسان في أفريقيا للعام 2003م ، اتفاقية الاتحاد الأفريقي لمحاربة الفساد 2003م . بالنسبة للاتحاد الأفريقي، فإن المعضلات الرئيسية تتمثل في تأسيس آلية تنفيذ منظمة ومتماسكة، وتفعيل روابط وظيفية فعالة بين هذه الالتزامات، وحقوق الإنسان، والحكومة، وجهاز "هندسة الأمن والسلم الأفريقية". تعتبر تفاصيل بنية الحكومة التي يتم إعدادها حالياً بمثابة فرصة للتغلب على هذه التحديات والعمل بشكل منظم لضم أعمال مؤسسات مثل اللجنة والمحكمة الأفريقية لحقوق الإنسان في عمليات جهاز "هندسة الأمن والسلم الأفريقية" مثل مجلس السلم والأمن في الاتحاد الأفريقي .
اعتبارات تحديد شرعية الثورات الشعبية
على الرغم من أن الأطر المعيارية وسياسة جهاز "هندسة الأمن والسلم الأفريقية"، كما هو موضح أعلاه بشكل مختصر، مجدية إلى حد ما، إلا أنها لا تقدم توجيهاً منهجياً دقيقاً للتصدي للثورات الديمقراطية الشعبية. وكما يصف رئيس دولة جنوب أفريقيا السابق ثابو مبيكي الخيار الذي واجهته أفريقيا "هل نقف مع الشعوب المتظاهرة أم مع الحكومات التي يطالبون بإقالتها!" . وفي صلب هذا الخيار تكمن الصعوبة في التمييز بين الثورات الشعبية الشرعية وتلك التي تشبه الحالات الممنوعة لدى قواعد وسياسة جهاز "هندسة الأمن والسلم الأفريقية".
وبناء على هدف قواعد وأدوات السياسة وخبرة شمال إفريقيا، من المهم تحديد الاعتبارات التي من خلالها يتم تحديد شرعية هذه الثورات الشعبية. وقد يساعد ذلك في تطوير مبادئ الاتحاد الأفريقي للتعامل مع أحداث مماثلة مستقبلاً. وعلى ذلك، يمكن تحديد ستة اعتبارات مهمة للتعامل مع الثورات الشعبية:
الاعتبار الأول ينظر إلى مدى توافر ما يسميه الـ سي أي دي أس بي بـ " الحالات التي تمنع وتقوض المؤسسات والصروح الديمقراطية، مثل غياب حكم القانون، وغياب نظام الاجتماعي الوافي، وعدم مشاركة الشعب في العمليات الانتخابية ".
وكما يشير اختبار أجري بخصوص الثورات الشعبية في شمال أفريقيا، فإن مما عجل الثورات الشعبية توافر ظروف تقوض المؤسسات والصروح الديمقراطية. وتوافر هذه الظروف يترك المواطنين من غير حلول عملية لمعاناتهم ويضع القيادة تحت المسائلة مما يدفع المواطنين إلى التظاهر في ثورات شعبية. والثورات الشعبية في شمال أفريقيا إنما هي تنفيس للغضب والإحباط الذي أصاب المواطنين ضد الفساد، والاستبداد، والأنظمة غير الديمقراطية. وفي محاولة للتعامل مع تلك الأحداث، ينبغي أن يهتم الاتحاد الإفريقي بهذا الاعتبار الأول لأهميته.
والاعتبار الآخر هو تنظيم وطبيعة حركة المتظاهرين. ويشتمل الاختبار هنا على قضية ما إذاكانت هذه الثورات فيها محاولة فرض حركة سياسية معينة أو شريحة من المجتمع برنامجها السياسي. من ناحية التنظيم والحركة، فإن الثورات الشعبية في شمال أفريقيا لم تنشأ ولا تربطها أي علاقة بأية مجموعات سياسية أو عقائدية في هذه الدول. وكما كتب الأستاذ عمر بن يدر في الثورة التونسية: " لقد كانت ثورة عفوية قام بها الشعب، ولم تحركها أي قيادة أو حركة سياسية" وعليه، لم يقحموا أية برامج سياسية ولم يسعو لفرض أي برنامج سياسي خاص بأي مجموعة سياسية أو شريحة من المجتمع على الآخرين. بل تمسكوا بآمال وتطلعات في إصلاحات تدخل على النظام السياسي، والاجتماعي والاقتصادي. وقد تم تحريكهم عن طريق الصحافة الاجتماعية بنشطاء في مقتبل العمر قاموا بدور المحفز والمنظم .
الاعتبار الثالث هو مدى شيوع الثورة، وهنا يكمن السؤال هل المشاركة في الثورة تخطَّت الفروق العقائدية، والثقافية، والفروق الأخرى في المجتمع . وبالنظر من هذا المنظور، يظهر أن أحد ملامح الثورة في شمال أفريقيا التي كستها صبغة ديمقراطية هي أنها شائعة. المشاركة في المظاهرات لم تقتصر على جزء من المجتمع. وعلى الرغم من أن المشاركين النشطين في المظاهرات من الشباب وذوي الدخل المتوسط، إلا أنه تم جذب أفراد من المجموعات المجتمعية والعمرية الأخرى بالإضافة إلى أناس من ديانات، وثقافات، وعقائد، وانتماءات سياسية مختلفة. وفي هذا الصدد، كان ابن يدر محقاً عندما قال :" كان التماسك في جميع أنحاء البلاد، وفي الشتات عبر جميع الطبقات المجتمعية مميزاً وجلياً وغير متوقعاً".
أما الاعتبار الرابع فهو سلمية الثورة. كما هو مقترح أعلاه، العديد من أدوات جهاز "هندسة الأمن والسلم الأفريقية" وخاصة الميثاق الأفريقي لحقوق الإنسان، تضمن حق التجمعات السلمية. أحد أبرز ملامح الثورة في شمال أفريقيا باستث ناء الحال في ليبيا كانت سلمية في نطاق واسع ما عدا تعابير الغضب المتقطعة في مواجهة الجهود المبذولة لإخماد هذه المظاهرات.
أما الاعتبار الخامس فهو مشاركة الجيش. وبالأخذ بعين الاعتبار قوانين الاتحاد الأفريقي بخصوص التغييرات غير الدستورية في الحكومة، فشرعية إشراك الجيش في الحركات التي تسعى لإسقاط الحكومات يثير العديد من التساؤلات حول أغراضه. ومرة أخرى، من المدهش ملاحظة أن الجيش في كل من تونس ومصر حافظ على الحياد. ولم يشارك في أي تحريض أو أي مساعدة نشطة في اقتلاع الرؤساء. وبالرغم من موقفه في التاريخ وسياسة الدولة، فإن الجيش المصري حافظ على أسلوب عدم التدخل إلى اللحظة التي رضخ فيها مبارك لضغوط الجماهير. وهذا من الملامح التي ميزت الثورة الليبية عن غيرها من الثورات نظراً لأن الوضع قد تحول تماماً إلى حرب أهلية بانحياز أفراد من الجيش إلى المعارضة وتنظيمهم جيشاً معتبراً. ورغم التشابه بينها وبين نظيرتها في كل من تونس ومصر، فإن الحال في ليبيا ينبغي التعامل معه بصورة مختلفة، كحرب أهلية. خطة الاتحاد الأفريقي لحل الأزمة في ليبيا قامت من هذا المنطلق بالضبط.
أما الاعتبار الأخير فهو مشاركة طرف خارجي حيث يشارك بفعالية في التحريض ودعم الثورة، ويتم التلاعب في حق الشعب في تقرير المصير في ذلك المجتمع مما يجعله عرضة لاستغلال قوى خارجية. ومن مميزات الثورات الشعبية في شمال أفريقيا أن بدايتها كانت على أيدي أناس عاديين. ولم يكن هناك أي تدخل خارجي أو أي دعم مباشر للمتظاهرين. وخرج المتظاهرون بسبب المشاكل السياسية الداخلية والاجتماعية والاقتصادية التي ظهرت في مجتمعاتهم لبعض الوقت. وكانت جهود شعب لإقامة الوضع السياسي والاقتصادي في مجتمعهم، وممارسة حق تقرير المصير. ومرة أخرى فإن الخبرة الليبية انحرفت عن هذه القاعدة بتدخل حلف الناتو ودعمهم للمتظاهرين المتمردين.
دور الاتحاد الأفريقي
بصورة عامة يمكن تقسيم دور الاتحاد الإفريقي فيما يخص الثورات الشعبية إلى قسمين. أولاً، الدور الوقائي للاتحاد. ويتطلب تطوير وتنفيذ مبادرات واستراتيجيات لتحقيق وتنفيذ ممارسات ومبادئ تدخل في تكوين القيم المشتركة في الدول الأعضاء في الاتحاد الأفريقي. أما الدور الثاني الذي يلعبه الاتحاد الأفريقي فهو التعامل مع الثورات والأزمات التي لها علاقة بهذه الثورات.
الدور الوقائي للاتحاد الأفريقي
توفر المزيد من المعلومات والتكنولوجيا لعدد متزايد من الناس في أفريقيا سيزيد نشاطهم السياسي في كثير من الأجزاء في القارة. وفي ظروف مثل هذه، فإن الناس في دول أفريقية كثيرة سيكونون أقل تحملاً للأتوقراطية، والفساد، وانعدام الفرص الاجتماعية والاقتصادية، ومستويات الفقر المتصاعدة. فهناك آمال لا مناص عنها بأن تقوم الحكومات بإظهار وتسجيل تطوراً في تحسين الديمقراطية والحكم الجيد بالإضافة إلى احترام حقوق الإنسان وتبني سياسات اقتصادية بمقدورها تنمية الاقتصاد وتقضي على الفقر بصورة نهائية.
وتعتمد شرعية الحكومات الأفريقية على درجة الوفاء بهذه التوقعات. وفي السنوات المقبلة، بغض النظر عما إذا كانت الحكومات ستواجه ثورات شعبية أم لا فإن شرعية الحكومات سيعتمد على نجاح تسجيلها في هذه النقاط الحساسة. وهناك خيار وحيد لدى الدول الأعضاء في الاتحاد الأفريقي، وهو الوفاء بالحاجات الاقتصادية والاجتماعية لشعوبهم وإلا فمواجهة الغضب الشعبي الهائج سوف لن يكون كافياً أن يكون تركيز الحكومة على النمو الاقتصادي . تحتاج الحكومات الأفريقية إلى أن تضع الاستثمارات لتفعيل الديمقراطية وترسيخ الحكوم الرشيد.
كما تم عرضه أعلاه، فإن الاتحاد الأفريقي قد طور عدة قواعد ومؤسسات حول الديمقراطية، والحكومة، والأمن والسلم. وقد أصبح تنفيذ إلتزامات الديمقراطية، و الحكوم الرشيد، وحقوق الإنسان بالإضافة إلى النمو الاجتماعي والاقتصادي ضرورة ملحة لأنه الضمان المستمر للأمن والسلم ومنع الاضطرابات الشعبية .
وفي كلمة ألقاها مفوض الاتحاد الأفريقي في اللقاء الـ 275 لوزراء مجلس الأمن والسلم المخصص لمناقشة وضع الأمن والسلم في أفريقيا، تطرق سعادته إلى نقطتين في غاية الأهمية:
• يجب ألا نوفر أي جهد في إرساء الديمقراطية والحكم الرشيد، لأن الإخفاق في ذلك يجلب مخاطر عظيمة إلى قارتنا. وتشهد القارة أزمات متزايدة في الانتخابات وتأسيس الحكم الرشيد. ويجب أن يتوقف هذا قبل أن يتأزم الوضع. إن ترسيخ الديمقراطية وتطوير الحكومة السياسية والاقتصادية يدعم جهودنا لإيقاف الصدامات الدامية في قارتنا.
• وأخيراً، من المهم أن نستثمر في السياسات التي تخلق مزيداً من الوظائف وترفع من دخل الأفراد وخصوصاً فئة الشباب وتسهم أيضاً في مستوى المعيشة عبر القارة. حقيقةً، إنها طريقة لمنع ثورات مستقبلية كتلك التي رأينا في شمال أفريقيا .
ثورات شمال أفريقيا تظهر أن الدور الذي يلعبه الاتحاد الأفريقي في تسهيل تنفيذ القواعد في الدول الأعضاء مهم في منع الثورات أو أية أزمات. سيكون هذا هو الاختبار الحقيقي لاستمرار أهمية الاتحاد الأفريقي في حياة الأناس العاديين في أفريقيا. ولهذا السبب يحتاج الاتحاد الأفريقي لتطوير فاعلية بعض الأطر المعيارية والدستورية وتنفيذها. وعلى درجة من الأهمية، هناك الحاجة إلى رفع سقف مهام اللجنة الأفريقية ومحكمة حقوق الإنسان وقسم الشؤون السياسية في الاتحاد الأفريقي في عمليات جهاز "هندسة الأمن والسلم الأفريقية" ومؤسساته.
رد الاتحاد الأفريقي
بالنسبة لرد الاتحاد الأفريقي فإن الأطر المعيارية وسياسة جهاز "هندسة الأمن والسلم الأفريقية" لم تزود الاتحاد الأفريقي برد فعال وآلية تنفيذ للمؤسسات التي تم اعتبارها مصدراً لتهديد الأمن والسلم. ويتضح هذا أكثر باعتبار أن منع التغييرات غير الدستورية على الحكومة هو المبدء الوحيد لدى جهاز "هندسة الأمن والسلم الأفريقية" الذي يعاقب مخالفه. ولذلك، فإن المادة 30 من القانون التأسيس تنص على أن الحكومات التي تصل إلى سدة الحكم عبر تغييرات غير دستورية لن يكون بإمكانها الاشتراك في نشاطات الاتحاد.
لم يتم تطوير أي آلية مشابهة لمخالفة قواعد أخرى مماثلة لتلك المذكورة في جهاز "هندسة الأمن والسلم الأفريقية" مثل الحالات التي حرضت على الثورة الشعبية في تونس، وليبيا ومصر. لم يطور الاتحاد الأفريقي بعد طرق فعالة للتقليل من الانتهاكات المنظمة لحقوق المواطنين، والاستخدام غير الشرعي للسلطة والحكومة. وفشل أدوات الاتحاد الأفريقي من ناحية الاستجابة لأوجه القصور المتعلقة بالديمقراطية والقانون الشرعي هو أنها تذكر القليل، القليل فيما يخص طريقة التعامل مع شؤون الممارسة غير الشرعية للسلطة، بمعنى أن الحكومات التي تمارس السلطة بطريقة تقوض القانون الدستوري مثل سن القوانين التي تقيد حرية الصحافة والتعبير، والاعتقال والتوقيف بعيداً عن القضاء، والتعذيب، والقتل خارج القضاء، والتعيينات والإقالات دون الرجوع إلى القانون .... إلخ.
طبيعة رد الاتحاد الأفريقي
عند تمعن رد الاتحاد الأفريقي، هناك اعتبارات معينة ينبغي أخذها بعين الاعتبار، أولها مبدء جهاز "هندسة الأمن والسلم الأفريقية" المنصوص عليه في المادة 2 (1) من بروتوكول مجلس الأمن والسلم للرد الوافي في الوقت الملائم. وهذا يلزم الاتحاد الأفريقي برد سريع وواضح. ويعنى بهذا النوع من الردود إنشاء دور قيادي لإدارة الحالات التي تظهر. وهذا النوع من الردود يضع على عاتق الاتحاد الأفريقي مهمة تحديد المشاركة الدولية ونتائجها. وغياب هذا النوع من الردود يوجد ذريعة لتدخل أجنبي في محاولة لإيجاد رد قد لا يتماشى مع الردود التي يراها الاتحاد الأفريقي.
أصحاب الآراء في أجزاء عديدة من القارة يرون أن رد الاتحاد الأفريقي للثورات الشعبية أتى متأخراً. أحد القرائن على أن رد الاتحاد الأفريقي كان بطيئاً ومتردداً هو أن التدخل الأجنبي أفلح في استغلال الفرصة لعرض استجابته وأخذ زمام القيادة في الاشتراك في شمال أفريقيا مع ما ينطوي ذلك على تهميش لصوت الاتحاد الأفريقي.
ولم تكن استجابة الاتحاد الأفريقي بطيئة فحسب بل وضعيفة أيضاً. فقد قال وزير خارجية رواندا في الاجتماع الوزاري الـ 275 في جلسة مجلس الأمن والسلم: "كلنا متفقون ألا تتغاضى أفريقيا عن قيادة دولة تحتقر شعبها وألا تتحمل أية دولة تبيد شعبها. ورغم كل هذا، لما لم يقم الاتحاد الأفريقي برد في الوقت الملائم ويأخذ دوراً قيادياً في وضع خطوات عملية حياله؟... لما لم ينادي الاتحاد الأفريقي في هذه الحالة المأساوية من العنف إلى مؤتمر استثنائي عاجل لرؤساء الدول لاتخاذ إجراءات فورية" . وبما أنها جاءت من دولة عضو في الاتحاد الأفريقي وهي جزء من مجلس الأمن والسلم ، فإن هذه النظرة تعكس مستوى ضعف أو تصور عن ضعف استجابة الاتحاد الأفريقي.
عند اعتبار الاستجابة في ضوء طبيعة الأحداث في شمال أفريقيا، فإن استجابة الاتحاد الأفريقي باستثناء خطتها واللجنة الرفيعة المستوى لليبيا تعتبر ضعيفة. على سبيل المثال، في الأسابيع القليلة الأولى لاندلاع الثورة الشعبية في ليبيا كان الوضع مازال محدوداً، قام الاتحاد الأفريقي بإرسال فريق لتفحص الوضع بدلاً من اتخاذ إجراءات مباشرة . وحتى بعد أن تبنى مجلس الأمن والسلم البيان الذي شجب فيه قتل المواطنين والاستخدام المفرط للقوة ، لم يقم الاتحاد الأفريقي بمزيد من الإجراءات الأكثر حزماً ضد الحكومة الليبية في ردها على المظاهرات السلمية. وبعيداً عن شجب العنف، هناك بعض الإجراءات التي يمكن اتخاذها بدءاً من تعليق مشاركة الدولة في نشاطات المنظمة إلى فرض قيود دبلوماسية مثل قطع العلاقات الدبلوماسية وحتى سحب الاعتراف وإن لزم الأمر التدخل كما هو منصوص في المادة 4 (هـ ) من القانون التأسيسي للاتحاد الأفريقي.
وبعيداً عن اعتبارات التوقيت وقوة الاستجابة، هناك اعتبارات أخرى مثل وضوح ومدى تماسك الاستجابة. لما عقد اجتماع مجلس الأمن والسلم بالاتحاد الأفريقي بتاريخ 10 مارس من العام 2010م عبَّرَ الاجتماع عن رفضه لأي تدخل عسكري أجنبي أياً كان شكله " ولكن بعد شهر عندما تبنى مجلس الأمن القرار رقم 1973 ، صوتت ثلاث دول غير دائمة العضوية في مجلس الأمن بالأمم المتحدة لصالح القرار والذي يسمح بتدخل عسكري أجنبي رفضته أفريقيا. وقد عكس هذا بشكل جلي غياب التنسيق والتماسك بين أديس أبابا والدول الأفريقية الأعضاء في مجلس الأمن بالأمم المتحدة في نيو يورك. كما أنه عكس التناقض في رد الاتحاد الأفريقي حيال الأزمة.
التواصل الفعال لسياسة الاتحاد الأفريقي في الرد على تلك الأحداث وحملة إعلامية قوية تمثل جانباً آخر. بعيداً عن التوقيت، بحسب السيد ثابو مبيكي فإن جزءاً من الأسباب التي أدت إلى إخفاق الاتحاد الأفريقي في جذب الانتباه العالمي والذي بدوره أدى إلى فشله، هو عدم توصيل رده حيال الأحداث في شمال أفريقيا بشكل فعال ولم يعمد إلى حملة إعلامية جارفة. وكما يقترح وزير الخارجية الرواندي في تعليقه فإن الاتحاد الأفريقي كان إمّا بطيئاً أو غير فعّال في إيصال وتحريك الدول الأعضاء في الاتحاد الأفريقي بخصوص الموضوع.
الخاتمة وتوصيات السياسة
لقد أظهرت الثورات الشعبية في شمال أفريقيا دور وحدود الأطر المعيارية وسياسة مجلس الأمن والسلم. فهناك ثلاثة جوانب ضعف تتطلب اهتماماً دقيقاً تم تحديدها. كان أولها غياب التوجيهات في تحديد الاتحاد الأفريقي لشرعية الثورات الشعبية لمساعدتها في تبني ردود واضحة وفعالة. وكانت الثغرة الثانية في الأطر المعيارية وسياسة مجلس الأمن والسلم أنها لم تحدد الإجراءات اللازم اتخاذها حيال القصور في امتثال الدول الأعضاء للقواعد الديمقراطية، والدستور، وحكم القانون، واحترام وحماية حقوق الإنسان .
هناك حاجة إلى التركيز في التعامل مع القصور في التمسك بالمبادئ، حقوق الإنسان والديمقراطية. في السياق التنظيمي، هناك الحاجة إلى تنسيق مطور ومتكامل بين مؤسسات الاتحاد الأفريقي المختلفة وأهم من ذلك توسيع نطاق مهام اللجنة الأفريقية والمحكمة الأفريقية لحقوق الإنسان بالإضافة إلى قسم الشؤون السياسية في الاتحاد الأفريقي في عمليات مجلس الأمن والسلم .
وأخيراً، تم تحديد بعض أوجه القصور من ناحية طبيعة رد الاتحاد الأفريقي حيال الثورات الشعبية. وقد أظهرت هذه الإخفاقات شكوكاً حول فاعلية واعتمادية الاتحاد الأفريقي. اتخاذ خطوات عملية لتصحيح هذه الإخفاقات بات ضرورة ملحة. ويتطلب هذا إلى آلية واضحة لتنسيق أكثر صلابة وتماسكاً ليس بين أديس أبابا والممثلين الأفارقة في نيو يورك فحسب بل بين أفريقيا والاتحاد الأفريقي والدول الأعضاء.
