Interdisciplinarity in ethics and the ethics of interdisciplinarity
ANNE BALSAMO AND CARL MITCHAM
This chapter explores interdisciplinarity dynamics in the context of ethics. It starts by observing the origins of ethics in the predisciplinary plentitude of philosophy followed by a historical overview of ethics in terms of significant interdisciplinary formations broadly construed. Next is an extended discussion of interdisciplinarity in contemporary fields of applied ethics. A third section reverses the approach, to consider the possibility of ethical guidelines for the practice of interdisciplinarity, through reflection on the character of knowledge production in the digital age.
Ethics itself is constituted by systematic, critical reflection on human action with the aim of both increasing knowledge about and improving culturally or personally acceptable behavior. In that ethics involves critical reflection, it is distinct from moral¬ity which exists largely independent of conscious thought. Because ethics bridges knowing and doing, it constitutes a site for multiple inter- and transdisciplinary engagements. Most commonly, however, it is identified as a major branch of the disci¬pline of philosophy—alongside logic, epistemology, and metaphysics. Yet upon closer examination, ethics can be seen as drawing on a number of disciplines that may also be described as having emerged from it; disciplines such as psychology and anthro¬pology, as well as politics and economics, significantly influence the domain of eth¬ics. Especially in what are called its applied or practical versions, ethics takes form as hybridizations of disciplines and specialized concerns in the cases of biomedical ethics, environmental ethics, or computer ethics—each of which depends on multi-disciplinary interactions with other domains. Finally, ethics manifests strong trans-disciplinary elements, insofar as it is heavily dependent on life experience. Informed by the development of multiple disciplines, implicated in the creation of new hybrid research fields, and constituted by transdisciplinary questions, ethics is an inherently interdisciplinary endeavor.

18.1 Historical overview
In its classical form philosophy was a term that referenced all learning and was thus deeply interdisciplinary. Indeed, it may be more accurate to describe philosophy as originally pralisciplinary, since it preceded the demarcation of disciplines. The history of the pursuit of knowledge in the European tradition unfolds as a progressive spinning off of mul¬tiple specialized forms of learning from within a nondisciplinary matrix known as phi¬losophy. Physics, astronomy, natural history or biology, psychology—including what are now termed the human sciences and the humanities—were all once part of philosophy as exhibited in the works of Plato, Aristotle, and their followers.
The emergence of moral theory or ethics as an explicit dimension of learning exem¬plifies what social scientists have termed the process of structural differentiation. Over the course of human history, there has been a tendency to disaggregate many aspects of human culture that once formed a more synthetic unity. For instance, one distinc¬tive feature of the period between 500 BCE and 500 CE, especially among those peoples inhabiting the northeastern shores of the Mediterranean Sea, was a gradual movement to distinguish among the elements of law (in Greek, nomos), moral custom {ethos), narrative story {mythos), rational thinking {logos), and nature {phusis).
Since the 1500s in Europe and then the Americas, this process continued, such that a plethora of structural differentiations emerged in science (where physics, chemistry, geol¬ogy, biology, and more were separated out as specialized forms of knowledge), in industry (through the division of labor), in government (separation of powers), and in religion (multiple church denominations). This systole of differentiation has in turn repeatedly given rise to the diastole of counter efforts promoting relationships or interactions among the associated socio-cultural structures, thus constituting in broad if non-standard terms multiple manifestations of interdisciplinarity: interdisciplinary research in science, team management in industry, constitutional formation and civil religion in the state, ecu¬menism in religion, and universal human rights in culture. One basic description of phi¬losophy today could reasonably characterize it as the most general effort to reflect on and understand these differentiations and their countermovements. This is especially the case with that structural differentiation in philosophy known as ethics.
In a broad-brush historical overview, the development of ethics took shape in five over¬lapping interdisciplinary interactions or formative efforts to bridge other structural differ¬entiations in culture. The first formation took shape in Greece in the centuries preceding the common era as an orientation toward understanding certain social norms as perfect¬ing human nature by integrating humans into natural or cosmic orders. The macrocosm of cosmic reality was thought to be mirrored in the human microcosm, as summarized in the phrase 'as above, so below'. From this perspective, study of the natural world was itself of ethical significance. Morality served to mediate not just among human beings but also between social and natural orders. This view of the relation between human behavior and non-human orders of reality that can be found articulated in related ways in classical Hinduism and Daoism.
Insofar as the social order is itself viewed as the instantiation of a cosmic order, morality could also be understood, in a second interdisciplinary formation, as mediating between

individuals and the social order. The ethics of Confucianism illustrates such an approach. Confucian ritual aims to unify not only heaven and earth but also individual persons with the present and past social fabric, and might thus be described as a practice of intergenera-tionality. Greek philosophy, Hinduism, Daoism, and Confucianism all emerged in what Karl Jaspers (1949) identified as the Axial Age of human history—the period between 800 and 200 BCE—which gave rise to a set of basic ethical understandings of morality as distinct from but mediating cultural formations.
A third basic formation of ethics emerged in conjunction with Judeo-Christian-Islamic notions of divine revelation, especially as articulated in Christian theology. In revealed the¬ology, divine or supernatural infusions of knowledge from above can be variously under¬stood as enclosing nature or opposing it. In the view of Thomas Aquinas, for instance, the natural law ethics of reason was simply confirmed by and raised to a higher level by the ethics of revelation; the natural virtues of courage, moderation, practice-wisdom, and justice were understood as complemented by the supernatural virtues of faith, hope, and love. By contrast, for Augustine, revelation functioned to relativise the importance of nature; the virtues of the ancients were no more than 'shining vices'. In both cases, however, ethics functioned as a handmaid to theology by mediating between revealed and natural knowledge. These two conceptions of ethics also manifested in the ethical theories of Judaism and Islam.
A fourth formation of ethics as interdisciplinarity has emerged opposed to the idea of ethics as handmaid of revelation. In this case, ethics functions instead as the handmaid of a new kind of science: modern natural science. During the Enlightenment, ethics became an interdisciplinary mediation not so much between nature and society as between the socio-political order and the pursuit of science in its distinctly modern form, which conceives non-human realities as devoid of moral significance except insofar as value is attributed to them by humans. In one version, ethics is cast as the protector of science. This notion of ethics argues for the autonomy of science and its support by the state because of its benefit to society. In another version, that of ethics as Romantic critique, it argues for delimitations on science in order to protect humans from dominance by science.
Finally, in a fifth formation, morality can be conceived as a practice leading to some kind of enlightenment or revelation from below. This view of morality may be inter¬preted as having roots in the Axial Age, through the example of Buddhism, but is also illustrated in the belief that adherence to the scientific method leads to the production of true knowledge. Additionally, modern psychology has proposed various methods, from psychoanalysis to educational techniques, as productive of knowledge. Although the enlightenments of Buddhist meditation and scientific methods are quite different, according to this formation of ethics both may be described as emerging in a natural manner from the disciplining of experience. The meaning of 'discipline' in this instance exhibits different but related meanings to those customarily associated with discussions of interdisciplinarity.
This brief historical overview of five formations of ethics as interdisciplinarity may be summarized as follows. In generalized terms, ethics as interdisciplinarity has functioned as mediation and synthesis of: (1) human and cosmic reality, (2) individual and social

orders, (3) reason and revelation, (4) science and human affairs, and (5) as a pathway to insight. Only in the first half of the twentieth century were efforts made to construct an ethics purified of all forms of interdisciplinarity in what has come to be known as 'meta-ethics'. In the face of manifest needs for ethical guidance with regard to new forms of science and technology, however, the meta-ethics project gave way in the second half of the 20th century to what has come to be called applied ethics.
18.2 Interdisciplinarity in applied ethics: bioethics and nuclear ethics
The meta-ethics project aimed to set aside substantive debates about good and bad, right and wrong, and to focus instead on analyzing the meaning of moral terms and the struc¬ture of ethical discourse or argumentation, as in a seminal text titled The language of morals (Hare 1952). According to American philosopher Stephen Toulmin (1982), the practical problems created by scientific and technological advances in medicine 'saved the life of ethics' in a more traditional or normative sense. He might have extended his insight to note that salvation also involved resuscitation by interdisciplinarity. For Toulmin, when ethical reasoning became engaged in clinical work and considered the actual practices of physicians, hospital ethics committees' and/or institutional or governmental bodies' linguistic analyse of theoretical conflicts tended to be superceded by practical reasoning. Conflicts between deontology, utilitarianism, and virtue ethics are sidestepped in favor of ad hoc constructions to deal with particular problems.
Such social consensus in the area of medicine on the basis of multidisciplinary ethical practice was initially adumbrated in the post-World War II creation of the Nuremberg Code for research on human subjects. While in earlier periods medical scientists had at times exhibited a certain weakness in exercising their responsibilities for the protection of human subjects, Nazi concentration camp experiments dramatized the need to develop universally agreed-upon guidelines for the conduct of medical research. Judges from sev¬eral nations collaborated with medical experts to create protocols establishing applied ethical principles for technoscientific medicine. This transdisciplinary cooperation among legal experts and medical practitioners resulted in foundational statements about the basic rights of all medical research participants to free and informed consent. Subsequent debates about human stem cell research, cloning, and the patenting of genomic sequences have continued to depend on broad cross-disciplinary dialogues regarding what factors and kinds of knowledge are relevant to policy making.
Insofar as medicine engages with and is transformed by developments in biology and the life sciences, it becomes empirically interdisciplinary. This trajectory has turned medical ethics into the interdisciplinary fields of bioethics and biomedical ethics. In a well-cited article on the constitution of the field of bioethics' Maurice de Wachter (1982) has argued that even when its interdisciplinary character is assumed, the implications require careful attention. In particular, de Wachter argues that flour¬ishing of interdisciplinarity calls for the suspension of all disciplinary approaches, even when formulating research questions.

In light of the points made by Toulmin and de Wachter, it is important to acknowledge that the very term 'applied ethics' has been contested. Yet regardless of the different terms used to describe this domain—such as 'practical ethics' or 'professional ethics'—all assert a notion of engagement between and among multiple disciplines as the proper course for determining moral action. Consider, for instance, the case of nuclear ethics and policy, which refers to the ethics of nuclear weapons development and deployment as well as the ethics of nuclear power generation and production. Here the engagement spans the tech¬nological disciplines of nuclear science and engineering, as well as the social sciences of economics and environmental policy, along with the health sciences and medicine. If such interdisciplinary engagements are to be fruitful, the particular issues posed for ethical anal¬ysis will need to be formulated from the beginning through dialogue among the disciplines, so that the results of analyses are not predetermined by any set of disciplinary concerns.
18.3 Interdisciplinarity in applied ethics: environmental and computer ethics
Similar observations apply to the fields of environmental and computer ethics. Indeed, the development of environmental ethics was originally informed by naturalist writers (such as Henry David Thoreau and John Muir) as well as by conservation biologists (such as Aldo Leopold and Rachel Carson), all of whom undertook to advance critical ethical reflection on human—nature interactions from different disciplinary contexts. In previous formula¬tions, ethics had been concerned primarily with the relationship of human-to-human or human-to-divine. Wildlife biologist Leopold was the first to make an explicit case for an environmental extension of ethics to include what he called a 'land ethic'. In his words:
All ethics so far evolved rest upon a single premise: that the individual is a member of a community of interdependent parts. His instincts prompt him to compete for his place in that community, but his ethics prompt him also to co-operate (perhaps in order that there may be a place to compete for)....The land ethic simply enlarges the boundaries of the community to include soils, waters, plants, and animals, or collectively: the land. (Leopold 1949, p. 204)
Extending both the foundation of an ethical relationship to encompass both humans and the land required interdisciplinary collaboration to unpack the logic of this interac¬tion. Carson's work (1962) in particular was instrumental in establishing a context for the creation of statutory laws and governmental agencies for protection of the natural environment. In turn, environmental protection has become a global discussion that now routinely engages politicians and economists on issues of sustainable development. In the early twenty-first century, environmental ethics developed into a broad interdisciplinary field that includes thinkers in the domains of literature, science, law, economics, public policy, education, and philosophy.
The formation of computer ethics unfolded in similar ways. In the early stages of the devel-opment of computer technologies, it was scientists and engineers such as Norbert Wiener who argued for the need to direct ethical attention to the implication of the use of the new machines of data manipulation and communication. Wiener, the founding figure of cybernetics, titled

his second book The human use of human beings: cybernetics and society (Wiener 1950). His work was from the beginning an interdisciplinary endeavor situated in the interstices between mathematics, physics, and biology (Balsamo 1996). Through the interpretation of Terrell Ward Bynum (2008), Wiener also laid the foundation for computer or information ethics.
Following this early work, discussions in the Association for Computing Machinery (ACM), the largest non-governmental organization of computer professionals, led in 1973 to the adoption of a code of ethics (Anderson 1994). Other computer professional societies formulated similar or related codes in the following decade, e.g. the British Computer Society in 1983 and the Australian Computer Society in 1987. In 1978, interdisciplinary engagement between computer professionals and philosophers led to coining the term 'computer ethics' and in 1985 to the publication of a textbook of the same name (Johnson 1985). There followed an explosion of interdisciplinary interest and collaboration among computer professionals, philosophers, social scientists, and others who shared a general recognition that the field of computer ethics could not be pursued without extensive interdisciplinary collaboration.
As illustration of the implications of interdisciplinary ethics, consider the ACM code revision of 1992. The first code emphasized professional self-promotion and discipline (for example, being competent, acting within the limits of competence, and not misrepresent¬ing one's abilities). Only in the last of five canons did the code specify that ACM mem¬bers should be concerned to use their 'special knowledge and skills for the advancement of human welfare'. By contrast, the 1992 revision elevated the principle of contributing to 'society and human well-being' to the first commitment, while professional discipline was subordinated to education and raising consciousness. In a commentary on the revised code published in the Communications of the ACM in 1993, the interdisciplinary team of Ron¬ald E. Anderson (social scientist), Deborah G. Johnson (philosopher), Donald Gotterbarn (computer scientist), and Judith Perrolle (social scientist)—a subset of the code drafting committee—noted that 'a major benefit of an educationally oriented code is its contribu¬tion to the group by clarifying the professionals' responsibility to society' (p. 98).
One substantive moral commitment that stands out as a distinctive result of the inter¬disciplinary nature of the ACM code is an expressed respect for individual privacy. In the 1973 version of the code, this idea took the form of obligations to minimize personal data collection, to secure such data collections, and to arrange for the disposal of data when their function had been served. In the 1992 revised code, a similar respect for individual privacy is expressed in the following terms:
Computing and communication technology enables the collection and exchange of personal infor¬mation on a scale unprecedented in the history of civilization....It is the responsibility of pro-fessionals to maintain the privacy and integrity of data describing individuals....This imperative implies that only the necessary amount of personal information be collected in a system, that reten¬tion and disposal periods for that information be clearly defined and enforced, and that personal information gathered for a specific purpose not be used for other purposes without consent of the individual(s). (ACM code, 1.7)
According to Bynum, however, computer and information ethics, especially as grounded in the foundational reflections of Wiener, raise issues that are more transdisciplinary than interdisciplinary. As Bynum describes it:

[Wiener's] way of doing information ethics does not require the expertise of a trained philoso¬pher.... Any adult who functions successfully in a reasonably just society is likely to be [able to contribute]. As a result, those who must cope with the introduction of new information technology -whether they are public policy makers, computer professionals, business people, workers, teach¬ers, parents, or others - can and should engage in information ethics by helping to integrate new information technology into society in an ethically acceptable way. Information ethics, understood in this broad sense, is too important to be left only to philosophers or to information professionals. (Bynum 2008, p. 30)
In effect, Bynam suggests the possibility of an interdisciplinary ethics not simply of knowl-edge and technological production, but also of knowledge and technological utilization. The users of technologies should be able to draw on their own broad non-disciplinary knowledge to assess them, a view that has also been termed end-user conviviality (Mit-cham 2009).
Indeed, most discussions about the ethics of information focus on the production side (of information goods or solutions to problems) rather than on the use side, where con¬sumers and citizens take up and utilize information. Information production is admittedly difficult to thematize, analyze, and practice interdisciplinarily. But interdisciplinary use of information is a quite common phenomenon, well and easily practiced if seldom theo¬rized. Most 'disciplinary' producers engage frequently in 'interdisciplinary' consumption. When information producers leave the design shop or academic classroom they become citizens, members of families, churches, and users of all sorts of information goods and services—most of which they engage not as disciplinary experts or specialists but simply on the basis of common experience. In short, the disciplinary historian becomes an inter-and transdisciplinary human being when going to a health care provider. A physician's diagnosis and treatment recommendation is only incidentally filtered through the histo¬rian's perspective, insofar as questions might be asked about the historical development and origin of a diagnosis or therapy. The historian qua patient and consumer of medical services has an ability and indeed a motivation to draw from any number of disciplines in the process of making sense of a diagnosis or prescribed therapy: an old general chemistry course from high school, a required science course in college, a novel about medical care, newspapers reports and TV programs. Interdisciplinary consumption and use is a largely undertheorized aspect of interdisciplinarity that in fact functions in almost all areas of applied ethics.
18.4 Interdisciplinarity in applied ethics: professional ethics of engineering and science
The 'disciplinarity' that characterized the mode of knowledge production of the last half of the twentieth century, into which 'interdisciplinarity' is an intervention, exhibits a his¬torically specific character. In earlier periods, producers such as farmers, tailors, and even soldiers were both producers and consumers of their own goods: farmers ate their own food; tailors wore their own clothes; vernacular architects lived in the houses they built; soldiers fought with the weapons they designed, manufactured, and maintained. The

hyperstructural differentiation that resulted in the proliferation of disciplines with rigid boundaries did not arise until the modern period.
In the domain of professional ethics the typically modern separation of production and use is less pronounced than in other applied ethics fields. Consider, for example, the devel¬opment of engineering ethics and the ethics of scientific research. In both cases, interdis¬ciplinary work has become the norm. Engineering is a discipline that has evolved into several specialized subfields, from civil and mechanical to chemical, electrical, electronic, industrial, nuclear, computer, and more. Especially since the 1990s, the paramount com¬mitment, across all fields of engineering, has been articulated as the protection of public safety, health, and welfare—a commitment that has become known as the paramountcy clause. In the 1970s, the US National Endowment for the Humanities (NEH) and the National Science Foundation (NSF), stimulated in part by widespread public concern about a series of engineering-related failures (most prominently involving automobiles and airplanes) and in an effort to deepen understanding and practice of the paramountcy clause, jointly awarded a number of grants to research teams that included both philoso¬phers and engineers to study the ethics of engineering research and practice. The NSF even established a special Ethics and Values in Science and Technology (EVIST) grants program. This resulted in the creation of a number of interdisciplinary team-taught engi¬neering ethics courses and the publication of engineering ethics textbooks (e.g. Unger 1982; Martin and Schinzinger 1983; Harris etal. 1995).
A similar interdisciplinary dynamic transformed critical reflection and practice with regard to the ethics of scientific research. Stimulated again in part by public concern about fraud and misconduct in science, including the misuse of public funds as revealed in US Congressional hearings in the 1980s, the NSF and the US National Institutes of Health (NIH) funded interdisciplinary research and course development on the responsible conduct of research. This trajectory of scholarship was also promoted by interdisciplin¬ary professional scientific organizations such as the US National Academies of Science (NAS) and the American Association for the Advancement of Science (AAAS). A 1989 pamphlet, On being a scientist—produced by an interdisciplinary team of representa¬tives from the physical sciences, life sciences, engineering, social sciences, and humanities under general direction of the Committee on Science, Engineering, and Public Policy of the NAS, National Academy of Engineering, and Institute of Medicine and published by the National Academies Press—became a standard teaching resource at both the graduate and undergraduate levels in universities. This and related texts review basic research pro¬tocols regarding notions of integrity and honesty in the reporting of research results, the avoidance of conflicts of interest, the fair treatment of subordinates and colleagues, and respect for animal welfare for the purposes of raising awareness and fostering ethically responsible scientific practice.
18.5 Applied ethics generalized
The permutations of 'applied ethics' discussed here display at least four common fea¬tures. First, the distinctions between multi-, cross-, trans-, and interdisciplinarity are of

marginal concern to those who practice interdisciplinary ethics. Interdisciplinary teams engage in their work and negotiate the parameters of their interactions on the fly without feeling much need to analyze the particulars. Second, the practice of interdisciplinarity is often considered a transgression of proper disciplinary order. In the discipline of philoso¬phy, for instance, those who become involved in interdisciplinary work are often profes¬sionally marginalized. Philosophers who specialize in applied ethics are seldom accepted as equal members of their departments. Sometimes they are nudged out of the discipline and into interdisciplinary units such as programs and departments of science, technology, and society (STS) studies. Julie Thompson Klein (1990,2001) has in this regard described the character of interdisciplinarity' that emerges in different institutional contexts as a consequence of the movement 'out of the disciplines' by interdisciplinary researchers.
Third, the notion of interdisciplinarity often expands beyond an initial grouping com-prising engineers and scientists to eventually include social scientists and humanists (Frodeman et al. 2001). This results, fourth, in the formation of new questions about the professional and cultural boundaries of applied ethics work. Engaging in applied ethics in the context of contemporary globalization leads researchers to ask questions about the legitimacy of, for example, standards for the responsible conduct of research developed in Europe and the United States as distinct from China, India, or South Africa (European Commission 2009).
Along with a number of different, substantive ethical ideals such as free and informed consent in bioethics, sustainability in environmental ethics, and privacy protection in computer ethics, two other commitments are often incorporated into applied ethics fields. One is that technical experts have the obligation to promote public education regarding the most relevant aspects of their work. Another is that, when appropriate, these tech¬nical experts have obligations to involve the public in decision making about technical matters. Summarizing these two ideal commitments, it has been argued that the ethical determination of boundary conditions on research and knowledge production requires co-responsible or interdisciplinary collaboration between the scientific community and the public (Mitcham 2003). This, in turn, requires ethics (in its broadest formation) to reflect upon its own unavoidable disciplinary blind spots, to shift from one frame of refer¬ence to another, in order to appreciate the specific character of different forms of knowl¬edge, different methods of knowledge production, and different purposes of knowledge creation. Clarifying the ethical responsibility of technical experts to engage members of the public in technical decision making enacts the political adage of'no taxation without representation'. We live in a world where scientific research and technological invention have a more significant impact on citizens than do government tax policies. This partici¬patory principle also moves applied ethics from the realm of personal behavior into that of politics and policy (Winner 1980; Goldman 1992).
18.6 The ethics of interdisciplinarity as an ethics of shift work
The foregoing review of applied ethics indicates that it would be difficult to do such work without interdisciplinary engagements. This persistent fact in turn suggests a value: doing

interdisciplinarity in the most ethical way imaginable. Although value may not be deriv¬able from fact, facts can stimulate reflection on relevant values. To think about the right and wrong ways of doing interdisciplinarity is to anticipate an ethics of interdisciplinarity, and in such an anticipation it would be useful to begin with a general characterization of interdisciplinarity itself. Although interdisciplinary collaboration comes in many forms— multi-, cross-, inter-, and transdisciplinarity, to name only the four most common types— uniting all forms of interdisciplinary is what may be described as the phenomenon of 'shift work', literal and metaphorical. Taking this as the starting point, a manifesto on the ethics of interdisciplinarity will itself involve a shift in rhetoric and tone. This is but one more manifestation of the dynamic movement characteristic of interdisciplinary work.
Unlike shifts that start and end with the punch clock, interdisciplinary shifts from one framework to another require the on-going crossing of boundaries. Many studies treat boundary crossing as the exception rather than the rule: 'At this historical point, how¬ever, the interactions and reorganizations that boundary crossing creates are as central to the production and organization of knowledge as boundary formation and maintenance' (Klein 1996, p. 2). Yet it can be difficult to grasp the specific dynamics of this shift work across boundaries, let alone figure out how to exercise positive influence over it. In this case, ought need not imply can, but does imply try.
Although interdisciplinary shift work is enabled by new technologies, it is not techno¬logically determined. Enabled and stimulated by advancing technologies of transportation, communication, and information storage and retrieval, shift work takes form in classrooms and galleries, in virtual online worlds, in networked social spaces, and through mobile access points. The traditional spaces of cultural production and reproduction—research labs, art studios, universities, museums, libraries, galleries, theaters, and community centers—are themselves being transformed by those who inhabit them as they adopt new practices of communication, community formation, knowledge production, and technology use.
Given its dependence on, without being determined by, technological change, the shift work ethos invites cultivation of what may be called the technological imagination, a qual¬ity of mind that enables people to think with and through technology (Balsamo, forth¬coming). This is equivalent to what Albert Borgmann calls 'real ethics': an ethics that steps beyond ideas and theories and is more expansive than that focused on personal interac¬tions. 'Real means tangible; real ethics is taking responsibility for the tangible setting of life' (Borgmann 2006, p. 11). Real ethics rests on the recognition that even as we design the world of artifacts within which we live, those artifacts design us. Additionally, the technological imagination entails performativity and improvization, the cultivation of which rests on appreciation or understanding of: (1) the hidden character of knowledge in a digital age, (2) the multifaceted consequences of technological innovation, and (3) the development of new protocols for enacting interdisciplinary activity. The richer the technological imagination, the better the questions it will bring to these three aspects of the practice of interdisciplinarity.
(1) With regard to the hidden character of knowledge: for those now considered mem¬bers of a generation 'born digital' (who came to consciousness after the emergence of the internet in the 1990s), it is obvious that data ? information # knowledge, and that daily life is a scene of constant shifts between different networked contexts. Consequently,

they often display a transgressiveness that emerges from repeated experiences of traveling across linked information flows. Their successful navigation of media flows, distributed learning, and social environments requires the fluid mutation of interests, identities, and affiliations. Mutability becomes one of their strongest attributes. It is exactly this sensibil¬ity and fluid mutability that can serve as the foundation for a lifetime of learning.
But mutability is not easily accommodated within established institutions that govern and sanction knowledge production and which depend on specific structures, conven¬tions, and often highly traditional rituals of production. In order to successfully navigate contemporary digital network worlds, participants must learn not only how to transform data into information, but then be able to integrate information that comes from different sources for purposes of creating knowledge. In short, they must learn how to synthesize material harvested from diverse information flows. To affect this, digital shift workers learn to produce knowledge through dialogues among disciplines, social negotiation, and collaboration with peers, experts, and multiple others. Knowledge-producing activities will thus depend on understanding how disciplinarity functions as the institutionalized practice of knowledge verification. Shift workers learn how to engage in conversations with those who hold diverse cultural values or intellectual commitments. The everyday experience of the digital generation already incorporates creative synthesis practices such as data mining, remixing, and modding. But to create knowledge, interdisciplinarians must also learn how to critique the information flows they remix. In this sense, 'critical reading' is not an outmoded text-based literacy.
(2) The multifaceted consequences of innovation can be summed up in the formula: technological innovation = social transformation. Research that produces technological innovation is socially and culturally transformative insofar as all technologies shift social and cultural arrangements. Transformation takes shape through the formation of new publics, policies, social protocols, services, cultural narratives, as well as new technologi¬cal applications and devices. Innovation thus calls for multidisciplinary collaboration not just in pursuit of the creation of new technological products, but also in the formation of political alignments for interdisciplinary collaborations. In the past, such collabora¬tions have been unnecessarily limited. As the technohumanists Cathy Davidson and David Goldberg (2004) point out in their 'Manifesto for the humanities in a technological age', those who call for interdisciplinary collaboration that focuses on applied social problems frequently disregard the participation of humanists. As an example they cite Jeffrey Sachs, as Director of the Earth Institute at Columbia University and Special Adviser to the United Nations Secretary-General on Millennium Development Goals. Although insisting 'that interdisciplinarity was the only way to solve world problems', proposed bringing together only the earth sciences, ecological sciences, engineering, public health, and the social sci¬ences with a heavy dose of economics—leaving out the arts, culture, and philosophy. Yet complex social problems call for hybrid solutions that benefit from the incorporation of intellectually nuanced cultural analyses. The cultural aspects of technology design, use, deployment, implementation, maintenance, and disposal are fundamental to the process of forming adequate responses to variegated social problems.
(3) Having called for including a broader range of disciplinary participants, it is important to note that those who collaborate as members of interdisciplinary

shift teams must resist any facile division of labor that relegates scientists to studying conditions, engineers to designing artifacts, and social scientists and humanists left to practicing critique. While different roles are to be played by different types of participants, all must be willing—indeed, eager—to learn new skills, analytical frameworks, methods, and practices. This is the starting point for a practical ethics of interdisciplinarity. When people with different disciplinary or even interdisciplinary backgrounds come together, it is important to acknowledge that everyone has something to contribute and to learn.
The following virtues may thus be as indicative of the ethical habits appropriate to shift work interdisciplinarity:
Intellectual generosity. A genuine acknowledgment of others' work. This should be explic¬itly expressed to collaborators as well as mentioned via citation practices. Showing appreciation for other ideas in face-to-face dialogue and throughout a collaborative process stimulates intellectual risk-taking and creativity.
Intellectual confidence. A belief that one has something important to contribute. Confi¬dence avoids boastfulness and includes a commitment to accountability for the qual¬ity of a collaboration. Everyone's contribution to a collaboration needs to be reliable, rejecting short cuts and guarding against intellectual laziness.
Intellectual humility. A recognition that one's knowledge is partial, incomplete, and can always be extended and revised. This is a quality that allows people to admit they do not know something without suffering loss of confidence or self-esteem.
Intellectual flexibility. The ability to change one's perspective, especially based on new insights from others. This can include a capacity for play, for suspending judgment and imagining other ways of being in the world and other worlds to be within.
Intellectual integrity. The exercise of responsible participation. Such a habit serves as a basis for the development of trust, and is a quality that compels colleagues to bring their best work and thinking to collaborative efforts.
Beyond such particular virtues, however, the practical ethics of interdisciplinarity assumes that more effective interdisciplinary production and use is a natural good, ft is pragmatic in orientation, seeking only to improve interdisciplinary output—making interdisciplinarity work well rather than questioning whether interdisciplinarity should work.
At the same time, is there no need for a questioning of greater and greater productiv¬ity? Questioning is generally seen as legitimate with regard to material productivity. Why not also with interdisciplinary productivity, whether practiced in the realm of tangible or cognitive goods? Is it not possible to be overwhelmed by knowledge and innovation? Are these not the ultimate issues for any ethics of interdisciplinarity?
18.7 Conclusion
Ethics as a form of interdisciplinarity has been described in a broad-brush historical survey from the Axial Age to the twenty-first century. This survey identified five basic frameworks in which ethics has mediated interactions between human beings and other aspects of reality. This constitutes an admittedly metaphorical extension of the notion

of interdisciplinarity, but one that suggests possibilities deeper than those customarily imagined—and going beyond the commonplace of interdisciplinarity as useful for prob¬lem solving.
Beginning in the second half of the twentieth century it is also possible to identify a form of ethics—applied ethics—in which interdisciplinarity in a less metaphorical sense plays an increasingly constitutive role. A selective review of work in various applied ethics fields, from bioethics to engineering, reveals how integral interdisciplinarity is to almost any critical reflection on life in a technoscientific world.
The prominence of interdisciplinarity in ethics in turn suggests the need for an ethics of interdisciplinarity, that is, for reflections on what ethos could best guide interdisciplin¬ary practitioners in their shift work. In a sense, of course, the whole handbook of which this chapter is a part has the same aim. But as its own special contribution to such a gen¬eral goal, the ethics chapter concluded by identifying shift work as a key characteristic of all interdisciplinary activity and then ventured to explore differences between right and wrong ways to enact its ever recurring shifts in perspective and method. The result was to describe five virtues for interdisciplinary practice. One way of testing the adequacy of these virtues would be to consider their relevance to the many other analyses of interdis¬ciplinarity that inform the present handbook.

يبحث هذا الفصل في ديناميكيات تداخل التخصصات في سياق الأخلاقيات ويبدأ بفحص أصول الأخلاقيات في العلوم الفلسفية الوفيرة قبل ظهور التخصصات ويتبعها نظرة عامة تاريخية حول علم الأخلاق من حيث التكوينات الهامة لتداخل التخصصات والتي تم تفسيرها على نطاق واسع، و ندخل بعد ذلك في مناقشة مطولة حول تداخل التخصصات في المجالات المعاصرة للأخلاقيات ، أما في القسم الثالث من الفصل فينعكس هذا المنهج لدراسة إمكانية وجود إرشادات أخلاقية لممارسة تداخل التخصصات من خلال تأمل سمات إنتاج المعرفة في العصر الرقمي.
تتكون الأخلاق في ذاتها من خلال التفكير النقدي المنظم في أفعال الإنسان من أجل هدفين هما: زيادة المعرفة بالسلوك المقبول من الناحية الثقافية أو الشخصية، وبهذا يتضمن علم الأخلاق التفكير النقدي ويتميز عن الفضائل في أن الأخيرة مستقلة بشكل كبير عن التفكير الواعي؛ وحيث أن الأخلاقيات تربط ما بين المعرفة والتطبيق فهي تعتبر موقعا تلتقي فيه التخصصات المتعددة والمتداخلة وما وراء التخصصات، ومع هذا فمن الشائع تعريفها على أنها الفرع لأكبر في علم الفلسفة – جنبًا إلى جنب مع المنطق ونظرية المعرفة والميتافيزيقا، كما نجد أن علم الأخلاق، من خلال فحصه عن كثب، يقوم على عدد من العلوم يمكن وصفها على أنها نابعة منه، حيث أن بعض العلوم مثل علم النفس وعلم الإنسان وكذلك السياسة والاقتصاد لها تأثير كبير على علم الأخلاق، خاصة ما يطلق عليه الصيغ التطبيقية أو العملية حيث يٌهجن علم الأخلاق بالمجالات العلمية والاهتمامات المتخصصة في حالات أخلاقيات الطب الحيوي أو أخلاقيات البيئة أو أخلاقيات الحاسوب، ويعتمد كل منها على تفاعلات تعددية التخصصات مع المجالات الأخرى، وأخيرًا يظهر في علم الأخلاق بوضوح عناصر ما وراء التخصصات بقدر ما تعتمد بشكل كبير على الخبرة الحياتية، وبما يكتسبه علم الأخلاق من معارف تكونت من تطور عدد من التخصصات وتكونت من مسائل ما وراء التخصصات يكون علم الأخلاق بطبيعته محاولة متداخلة التخصصات.
18.1 نظرة تاريخية عامة
كانت الفلسفة في شكلها الكلاسيكي مصطلح حدد معايير كافة أشكال التعلم ولذلك كانت متداخلة التخصصات بشكل كبير وحقيقة قد نكون أكثر دقة حين نصف الفلسفة بأنها في الأصل سابقة لجميع التخصصات حيث سبقت وضع حدود التخصصات العلمية، كما يكشف تاريخ تتبع المعرفة في التقاليد الأوروبية تشكل العديد من أشكال التعلم المتخصص من مصفوفة غير تخصصية تعرف بالفلسفة، وكانت جميع العلوم مثل الفيزياء والفلك والتاريخ الطبيعي أو علم الأحياء وعلم النفس – وكذلك ما يطلق عليه الآن علم الإنسان و الدراسات الإنسانية – جزءا من الفلسفة كما يتضح من أعمال أفلاطون وأرسطو وتابعيهم.
يعتبر ظهور النظرية الأخلاقية أو علم الأخلاق كبعد واضح للتعلم تجسيدًا لما أطلق عليه علماء الاجتماع عملية التمايز البنيوي، وكان هناك اتجاه على مدى التاريخ البشري لتصنيف العديد من جوانب الثقافة الإنسانية التي شكلت في يوم من الأيام وحدة اصطناعية، على سبيل المثال: إحدى السمات المميزة للفترة ما بين 500 ق.م و500 ميلادية وخاصة بين الشعوب التي عاشت على السواحل الشمالية الشرقية للبحر المتوسط هي الاتجاه التدريجي نحو التمييز بين عناصر القانون (في الإغريقية nomos) والأعراف الخلقية (ethos) والأساطير (mythos) والتفكير العقلاني (logos) والطبيعة (phusis).
واستمرت هذه العملية منذ عام 1500م في أوروبا ثم بعد ذلك في الأمريكيتين بحيث ظهر تزايد في التمايز البنيوي في العلوم (حيث تم فصل علوم الفيزياء والكيمياء والجيولوجيا والأحياء والكثير من العلوم الأخرى كمعرفة متخصصة) وفي الصناعة (عبر تقسيم العمل) وفي الحكومة (فصل السلطات) وفي الدين (تعدد الطوائف الكنسية)، وبصورة متكررة أدى هذا الانقباض في التمايز بدوره إلى انبساط الجهود المقابلة التي تشجع وجود علاقات أو تفاعلات بين البنى الاجتماعية الثقافية ذات الصلة ومن ثم يشكل الظواهر المتعددة لتداخل التخصصات مثل أبحاث تداخل التخصصات في العلوم وإدارة فرق العمل في الصناعة ووضع الدستور والدين المدني للدولة والحركة المسكونية في الدين والحقوق العالمية للإنسان في الثقافة، كما أن إحدى أهم السمات الأساسية التي يمكن أن نصف بها الفلسفة حاليًا والتي تصفها بشكل معقول هي أنها الجهد العام لتدبر هذه الاختلافات وفهمها وكذلك الحركات المقابلة لها، وهذه هي الحالة الخاصة التمايز البنيوي في الفلسفة وتعرف بعلم الأخلاق.
ومن خلال نظرة تاريخية عامة نجد أن علم الأخلاق تشكل من خلال خمسة تفاعلات أو جهود تشكيل متراكبة لتداخل التخصصات لربط التمايز البنيوي في الثقافة، ظهر التشكل الأول في اليونان في القرون التي سبقت ميلاد المسيح في صورة توجه نحو فهم معايير اجتماعية محددة تسعى إلى كمال الطبيعة البشرية وذلك عن طريق دمج البشر في النظم الطبيعية والكونية، وكان يُعتقد أن التعقيد الكوني للحقيقة الكونية تنعكس على العالم المصغر للإنسان كما تلخصها جملة "كما يكون في الأعلى يكون بالأسفل" ومن هذا المنظور كانت دراسة العالم الطبيعي ذاتها لها مغزى أخلاقي، كما تعمل الفضائل الأخلاقية كوسيط ليس بين البشر فقط بل بين النظم الطبيعية والاجتماعية كذلك، وهناك بعض النصوص الواردة في الهندوسية والطاوية حول هذه الرؤية للعلاقة بين السلوك البشري والأنظمة غير البشرية.
وبقدر ما يمكن رؤية النظام الاجتماعي على أنه تجسيد للنظام الكوني؛ يمكن أيضا فهم الأخلاقية – عند التشكل الثاني المتداخل التخصصات – على أنها وسيط ما بين الأفراد والنظام الاجتماعي، كما يتضح من الأخلاقيات الكونفوشيوسية، والتي لا تهدف طقوسها إلى توحيد الأرض والسماء فقط بل إلى توحيد الأفراد بالنسيج الاجتماعي الحاضر والماضي ويمكن أن نطلق على هذا تداخل الأجيال أو التفاعل بين الأجيال المختلفة. وكل من الفلسفة الإغريقية والهندوسية والطاوية والكونفوشيوسية تطورت مما أطلق عليه كارل جاسبرز (1949) Karl Jaspers العصر المحوري للتاريخ الإنساني (الفترة من عام 800 إلى 200 ق.م تقريبًا)– والتي أعلت من قيمة مجموعة من المفاهيم الأخلاقية الأساسية للفضيلة التي تختلف عن التكوينات الثقافية ولكنها تتوسط بينها.
التشكل الأساسي الثالث لعلم الأخلاق جاء مرتبطا بأسس الديانات السماوية اليهودية والمسيحية والإسلامية عن الوحي الإلهي وخاصة كما ورد في اللاهوت المسيحي، حيث يمكن فهم المعارف المتلقاه عن الوحي الإلهي على أنها تتضمن الطبيعة بداخلها أو تعارضها. ومن وجهة نظر توماس أكويناس Thomas Aquinas على سبيل المثال أن أخلاقيات القانون الطبيعي للعقل أكدتها ببساطة وأعلت من شأنها أخلاقيات الوحي، فالفضائل مثل الشجاعة والاعتدال والحكمة والعدل يمكن فهمها جميعًا على أنها يكملها للإيمان والأمل والحب، بينما نجد أوجاستين Augustine على العكس من ذلك يرى أن وظيفة الوحي هي تحقيق نسبية أهمية الطبيعة وأن فضائل القدماء لم تكن سوى "الرذائل البينة"، ومع هذا نجد في كلتا الحالتين أن علم الأخلاق يكمل الأديان السماوية عن طريق التوسط بين الوحي والمعرفة الطبيعية ويتضح هذان المفهومان من النظريات الأخلاقية في اليهودية والإسلام.
أما التشكل الرابع لعلم الأخلاق كمجموعة من التخصصات المتداخلة فقد ظهر ليناقض فكرة أن علم الأخلاق خادم للوحي وفي هذه الحالة تعمل الأخلاق على أنها خادم لنوع جديد من العلم ألا وهو العلوم الطبيعية الحديثة، وأصبح علم الأخلاق أثناء عصر التنوير وسيط متداخل التخصصات ليس بين الطبيعة والمجتمع بقدر ما هو بين النظام الاجتماعي السياسي واللحاق بركب العلم في شكله الحديث المميز الذي يرى الحقائق غير الإنسانية خالية من المغزى الأخلاقي فيما عدا القيمة التي يضفيها عليها البشر، ويعتبر علم الأخلاق من ناحية حامي العلم ويدفع هذا المفهوم الأخلاقي باستقلالية العلم ودعم الدولة له بسبب نفعه للمجتمع، ومن ناحية أخرى يعتبر علم الأخلاق نقدا رومانسي يقول بتقييد حدود للعلم من أجل حماية البشر من سيطرة العلم عليهم.
وأخيرا التشكل الخامس والنهائي للأخلاق كممارسة تؤدي إلى نوع من التنوير أو الوحي من العالم السفلي ويمكن تفسير هذه الرؤية على أن لها جذور متأصلة في العصر المحوري (الفترة من عام 800 إلى 200 ق.م تقريبًا) من خلال البوذية كمثال، كما تتضح أيضًا في الإيمان بأن الالتزام بالمنهج العلمي يؤدي إلى إنتاج معرفة حقيقية بالإضافة إلى تقديم علم النفس الحديث وسائل متعددة، بدءا من التحليل النفسي وحتى التقنيات التعليمية، كمنتج للمعرفة وعلى الرغم من اختلاف التنوير الذي أحدثه توسط البوذية عن الوسائل العلمية فإنه وفقا للمعلومات المتعلقة بعلم الأخلاق فيمكن وصف كلاهما على أنه ينشأ بطريقة طبيعية عن تخصص الخبرة و لكلمة "التخصص " هنا معانٍ مختلفة إلا أنها ترتبط بما يتعلق بمناقشات تداخل التخصصات.
يمكن أن نلخص هذه اللمحة التاريخية الموجزة حول التشكيلات الخمسة لعلم الأخلاق كعلم متداخل التخصصات كما يلي: يلعب علم الأخلاق كتداخل للتخصصات دور الوسيط والمزيج من: (1) الإنسان والحقيقة الكونية، (2) النظم الفردية والاجتماعية، (3) العقل والوحي، (4) العلم وشئون الإنسان، و (5) طريق نحو الاستبصار. وخلال النصف الأول من القرن العشرين فقط، ظهرت جهود لبناء علم الأخلاق خالٍ من أي شكل من أشكال تداخل التخصصات عُرف بأنه "فلسفة ما وراء الأخلاق"، وعلى الرغم من هذا فإنه في ظل الاحتياج الواضح للتوجيه الأخلاقي فيما يخص الأشكال الجديدة للعلم والتقنية فإن مشروع "ما وراء الأخلاق" أفسح الطريق في النصف الثاني من القرن العشرين لما أصبح اسمه بعد ذلك "علم الأخلاق التطبيقي".
18.2 تداخل التخصصات في علم الأخلاق التطبيقي: أخلاقيات علم الأحياء والأخلاق النووية
يهدف مشروع فلسفة ما وراء الأخلاق إلى أن ينحي جانبًا النقاشات الموضوعية حول الخير والشر والصواب والخطأ والتركيز على معاني المصطلحات الأخلاقية وبناء الخطاب الأخلاقي والمناقشات بدلا من ذلك كما يرد في نص " لغة الأخلاق" (هير Hare 1952). وفقا للفيلسوف الأمريكي ستيفين تولمين Stephen Toulmin (1982) المشكلات التطبيقية التي يخلقها التقدم العلمي والتكنولوجي في مجال الطب أنقذت حياة علم الأخلاق بالمعنى التقليدي أو المعياري، وقد امتد استبصاره ليذكر أن هذه الإنقاذ تتضمن أيضًا إعادة هذا العلم للحياة من خلال تداخل التخصصات، يرى تولمين أنه عندما دخل التفكير الأخلاقي إلى العمل الإكلينيكي وسلط الضوء على الممارسات الفعلية للأطباء فإن التحليل اللغوي للجان الأخلاقيات بالمستشفيات والهيئات المؤسسية أو الحكومية للصراعات النظرية غلب عليها التفكير العملي، كما أن الصراعات الناشئة بين آداب الطب والنفعية والفضائل قد تراجعت لصالح ما تم تخصيصه لتناول مشكلات معينة.
ومثل هذا التوافق الاجتماعي في مجال الطب القائم على الممارسة الأخلاقية المتعددة التخصصات ظهرت بوادره أثناء وضع قانون نورمبرج بعد الحرب العالمية الثانية لأخلاقيات إجراء الأبحاث على الإنسان، فبينما في السابق أبدى علماء الطب بعض الضعف في ممارسة مسؤولياتهم في حماية الأشخاص، فإن تجارب المعسكر النازي أظهرت بشدة الحاجة إلى وضع خطوط إرشادية متفق عليها عالميا فيما يخص إجراء الأبحاث الطبية، وتعاون القضاة من مختلف الدول مع خبراء الطب من أجل وضع المبادئ الأخلاقية المطبقة في الطب التقني-العلمي، ونتج عن هذا التعاون العابر للتخصصات بين الخبراء القانونيين والأطباء بيانات تأسيسية تتعلق بالحق الأساسي لجميع المشاركين بالبحث العلمي في الموافقة الحرة المستنيرة، وتلت ذلك نقاشات لاحقة حول أبحاث الخلايا الجذعية للإنسان والاستنساخ والحصول على براءات الاختراع المتعلقة بالسلاسل الجينية واعتمدت في حواراتها على الحوارات العابرة للتخصصات حول ماهية عناصر المعرفة وأنواعها ذات الصلة بصناعة القرار.
وبالقدر الذي يشترك فيه الطب في التقدم الحيوي وعلوم الحياة وهي التي ساهمت في تغييره يتحول إلى مجال لتداخل التخصصات من الناحية التجريبية، وحوّل هذا المسار أخلاقيات مهنة الطب إلى مجالات متداخلة التخصصات عرفت بالأخلاقيات البيولوجية وأخلاقيات الطب الحيوي. وفي مقالة يكثر اقتباسها حول إنشاء مجال الأخلاقيات البيولوجية تحدث موريس دي واشتر Maurice de Wachter (1982) أنه عند افتراض وجود سمة تداخل التخصصات فإن تبعات ذلك تتطلب انتباها فائقا ودفع دي واتشر بشكل خاص بأن انتعاش تداخل التخصصات يستدعي تعليق جميع مناهج التخصصات العلمية حتى عند تشكيل أسئلة البحث.
في ضوء هذه النقاط التي وضعها تولمين ودي واتشر يجب أن نعترف بأن مصطلح "علم الأخلاق التطبيقي" يدور حوله الكثير من الجدل وبغض النظر عن المصطلحات المختلفة التي استخدمت لوصف هذا المجال – مثل "الأخلاق العملية" أو "الأخلاق المهنية" – فجميعها تؤكد فكرة المشاركة بين التخصصات المتعددة بوصفها المدخل الصحيح لتحديد العمل الأخلاقي. إذا أخذنا كمثال حالة الأخلاقيات النووية والسياسية والتي تشير إلى أخلاقيات تطوير الأسلحة النووية واستخدامها فضلا عن أخلاقيات توليد الطاقة النووية وإنتاجها، يمتد الارتباط هنا ليشمل التخصصات التقنية للعلوم النووية والهندسة وكذلك العلوم الاجتماعية للاقتصاد والسياسة البيئية إضافة إلى العلوم الصحية والطب، فإذا أردنا لهذا الترابط لتداخل التخصصات أن يكون مثمرا فإن القضايا المحددة المطروحة للتحليل الأخلاقي سوف تحتاج لإعادة صياغة من البداية عبر الحوار ما بين التخصصات؛ حتى لا تنفرد إحدى التخصصات بتحديد مسبق لنتائج هذه التحليلات.
18.3 تداخل التخصصات في علم الأخلاق التطبيقي: الأخلاقيات البيئية وأخلاقيات الحاسوب
هناك بعض الملاحظات المماثلة التي تسري على مجالي البيئة والحاسوب، وفي الحقيقة كان الفضل في تطوير الأخلاقيات البيئية يرجع في الأساس إلى كُتاب المذهب الطبعاني (مثل هنري ديفيد ثورو Henry David Thoreau وجون موير John Muir) ومعهم علماء أحياء الانحفاظ (مثل ألدو ليوبولد Aldo Leopold وراشيل كارسون Rachel Carson) وتعهدوا جميعًا بتطوير التفكير الأخلاقي النقدي على التفاعلات بين الإنسان والطبيعة من السياقات المختلفة للتخصصات، في التشكيلات السابقة كان علم الأخلاق يهتم بصفة أساسية بالعلاقة بين الإنسان والإنسان أو بين الإنسان والإله، وكان ليوبود عالم أحياء الحياة البرية أول من وضع حالة واضحة للامتداد البيئي لعلم الأخلاق ليشمل ما يسمى "أخلاق الأرض" ومنها قوله:
"تقوم جميع الأخلاقيات التي تم تطويرها حتى الآن على افتراض واحد وهو أن الفرد عضو في مجتمع يتكون من أجزاء تعتمد على بعضها البعض وتدفعه غرائزه للتنافس على المكان الذي يشغله داخل هذا المجتمع؛ إلا أن أخلاقه تدفعه أيضًا إلى التعاون (ربما لأنه قد يكون هناك مكان ليتنافس عليه) ... وببساطة فإن أخلاق الأرض تمد من الحدود المجتمعية لتشمل التربة والماء والنباتات والحيوانات أو الأرض بأكملها." (ليوبولد 1949، صفحة 204).
ويتطلب امتداد وضع العلاقة الأخلاقية لتشمل البشر والأرض تعاون التخصصات المتداخلة لكشف النقاب عن منطق هذا التفاعل، وكان عمل كارسون (1962) على وجه الخصوص له دور فعال في بناء سياق لخلق القوانين التشريعية والهيئات الحكومية لحماية البيئة الطبيعية، وبالتالي أصبحت حماية البيئة موضوعا للنقاش على مستوى العالم حيث تشغل قضايا التنمية المستدامة بصورة روتينية رجال السياسة والاقتصاد، وفي بداية القرن الحادي والعشرين تطورت الأخلاقيات البيئية لتصبح مجال واسع لتداخل التخصصات يضم المفكرين في مجالات الأدب والعلوم والقانون والاقتصاد والسياسة العامة والتعليم والفلسفة.
كما تكشّفت أيضا أخلاقيات الحاسوب بصورة مشابهة؛ حيث أنه في المراحل الأولى لتطوير تقنيات الحاسوب تحدث علماء مثل نوربيرت وينير Norbert Wiener عن الحاجة لتوجيه الاهتمام الأخلاقي نحو الآثار المترتبة على استخدام الآلات الحديثة لمعالجة البيانات والاتصالات، كما كان عنوان الكتاب الثاني لوينير – مؤسس علم السبرانية - استخدام الإنسان للإنسان: السبرانية والمجتمع (وينير 1950). وكان عمله من البداية عمل متداخل تخصصات يشغل حيز بين علوم الرياضيات والفيزياء والأحياء (بالسامو Balsamo 1996)، ومن خلال تفسير تيريل ورد باينيوم (2008) وضع وينير أيضا الأساس لأخلاقيات الحاسوب أو المعلومات
وبعد هذا العمل المبكر أدت النقاشات التي خاضتها جمعية آلات الحوسبة ACM في عام 1973، وهي أكبر منظمة غير حكومية لمحترفي الحاسوب إلى تبني قواعد للسلوك (أندرسون 1994) كما صاغت بعض جمعيات الحاسوب المحترفة الأخرى قواعد مشابهة أو ذات صلة بها خلال العقد التالي مثل الجمعية البريطانية للحاسوب British Computer Society في 1983 والجمعية الاسترالية للحاسوب Australian Computer Society، وفي عام 1978أدى التعاون بين كل من محترفي مجال الحاسوب والفلاسفة إلى وضع مصطلح جديد وهو "أخلاقيات الحاسوب" ثم نُشر كتاب يحمل نفس العنوان في عام 1985 (جونسون 1985)، وتبع هذا ازدهار كبير لتداخل التخصصات والتعاون بين المهنيين في مجال الحاسوب والفلاسفة وعلماء الاجتماع وأقروا جميعًا بأنه لا يمكن مواصلة العمل في مجال أخلاقيات الحاسوب دون التعاون المكثف بين التخصصات.
وكمثال على الآثار المترتبة على وضع أخلاقيات متداخلة التخصصات نأخذ نموذج مراجعة قوانين جمعية آلات الحوسبة ACM الذي تم عام 1992، أكدت النسخة الأولى من القانون على الارتقاء الذاتي المهني والانضباط (على سبيل المثال: الكفاءة والعمل في إطار حدود الاختصاص وعدم تشويه القدرات الشخصية) واقتصر القانون في بنوده الخمسة الأخيرة على أنه يجب على أعضاء الجمعية أن يهتموا بالاستفادة من معرفتهم ومهاراتهم من أجل النهوض برفاهية البشر"، وفي المقابل جاءت المراجعة عام 1992 لتعلي من مبدأ المساهمة في "المجتمع ورفاهية الإنسان" بصفته البند الأول بينما جاء الالتزام المهني تابع للتعليم ورفع درجة الوعي. وفي إطار التعليق على القانون المعدل جاء في مجلة "اتصالات جمعية آلات الحوسبة" عام 1993 لاحظ فريق تداخل التخصصات المكون من رونالد إي. أندرسون Ron¬ald E. Anderson (عالم اجتماع) وديبورا جي جونسون Deborah G. Johnson (فيلسوف) ودونالد جوتربارن Donald Gotterbarn (عالم حاسوب) و جوديث بارول Judith Perrolle (عالم اجتماع) – وجميعهم شكلوا مجموعة فرعية للجنة صياغة القانون – أن "الفائدة الكبرى للقوانين ذات الأصول التعليمية هي مساهمتها في المجموعة عن طريق توضيح مسئوليات المهنيين تجاه المجتمع" (صفحة98).
إن أحد أهم الالتزامات الأخلاقية التي توصف بأنها ظهرت نتيجة لطبيعة قوانين جمعية آلات الحوسبة ACM المتداخلة التخصصات تمثلت فيما بدا من احترام الخصوصية الفردية، وفي المراجعة لبنود القانون التي تمت عام 1973 أخذت هذه الفكرة شكل الإلزام لتقييد جمع البيانات الشخصية وحماية هذه البيانات وتنظيم التخلص السليم من البيانات بعد أن تؤدي وظيفتها كما أولت المراجعة المماثلة التي تمت عام 1992 نفس الاهتمام للخصوصية الفردية وجاء كما يلي:
تُمكن الحاسوبية وتقنية الاتصالات الأشخاص من جمع وتبادل المعلومات الشخصية على نطاق لم يسبق له مثيل في تاريخ الحضارة ... وإنه يقع على عاتق المهنيين مسئولية الحفاظ على خصوصية وسلامة البيانات التي تصف الأشخاص...ويتضمن هذا الواجب ضرورة أن يقتصر جمع البيانات الشخصية داخل النظام على البيانات المهمة وأن يتم تحديد فترات الاحتفاظ بهذه المعلومات والتخلص منها ويُفرض الالتزام بها وأن يتم جمع هذه المعلومات الشخصية لأغراض محددة وألا تستخدم لأغراض أخرى دون موافقة صاحبها. (قانون جمعية آلات الحوسبة – 1.7)
و على الرغم من ذلك يرى بينوم أن أخلاقيات الحواسب والمعلومات، خاصة ما جاء في كتابات لوينر، تثير قضايا تميل في طبيعتها لما وراء التخصصات أكثر منها إلى تداخل التخصصات، ويصفها بينوم على أنها:
لا تتطلب طريقة [وينر] في معالجة أخلاقيات المعلومات لخبرة الفيلسوف المتمرس ... فأي شخص بالغ ناجح في عمله يعيش داخل مجتمع به قدر معقول من العدل يستطيع المساهمة فيها، نتيجة لذلك يستطيع كل من يحتاج إلى التعامل بنجاح مع بداية تكنولوجيا المعلومات الجديدة – سواء كانوا من واضعي السياسات العامة أو محترفي الحاسوب أو رجال أعمال أو عمال أو مدرسين أو آباء أو غيرهم – الاشتراك في أخلاقيات المعلومات بل ويجب عليهم ذلك عن طريق المساعدة في دمج تكنولوجيا المعلومات الجديدة في المجتمع بطريقة مقبولة أخلاقيًا، وتعد أخلاقيات المعلومات بهذا المعنى الواسع شديدة الأهمية ولا تُترك للفلاسفة وحدهم أو للعاملين في مجال المعلومات. (بينام 2008، صفحة 30).
يشير بينام في الواقع إلى احتمال ألا تكون أخلاقيات تداخل التخصصات نتاج المعرفة والتقنية بهذه البساطة؛ ولكنها نتاج المعرفة واستخدام التقنيات ويجب على مستخدمي التقنية أن تكون لديهم القدرة على الاستفادة من معرفتهم غير العلمية الواسعة من أجل تقييم التقنية وأُطلق على هذا الرأي اجتماعية المستخدم النهائي (ميتشام 2009).
وفي الواقع تركز غالبية النقاشات حول أخلاقيات المعلومات على جانب الإنتاج (السلع المعلوماتية وحلول المشكلات) أكثر من جانب الاستخدام حيث يتناول المستهلكون والمواطنون المعلومات ويستخدمونها، ونعترف أنه من الصعب على إنتاج المعلومات تحديد موضوع لتداخل التخصصات أو تحليلها أو ممارستها، لكن استخدام تداخل التخصصات للمعلومات ظاهرة شائعة بشكل كبير حيث تتم ممارستها بصورة جيدة وبسهولة إذا ندرت بها النظريات، ويشترك غالبية منتجي "التخصصات العلمية" بصورة متكررة في استخدام "تداخل التخصصات"، وعندما يغادر منتجي المعلومات مكان التصميم أو الفصل الأكاديمي يصبحون مواطنين وأفراد في أسرهم ويذهبون إلى الكنائس ويستخدمون جميع أنواع السلع المعلوماتية والخدمات – ولا يكون اشتراكهم بصفتهم خبراء بالتخصص العلمي أو متخصصين لكن على أساس الخبرة العادية. باختصار، يصبح مؤرخ التخصص إنسانا يحمل تداخل التخصصات وما وراء التخصصات عندما ذهب إلى مقدم الرعاية الصحية، ولا تخضع آراء الطبيب وتوصياته للفحص والمراجعة من المنظور التاريخي إلا في حالة وجود أسئلة حول التطور التاريخي لوسيلة تشخيصية أو علاج وأصولهما. إن المؤرخ إذا كان مريضا ومستهلكا للخدمات الطبية لديه القدرة بل الدافع للاستفادة من أية عدد من التخصصات في عملية فهم التشخيص أو العلاج الموصوف وقد يشمل ذلك ما درسه من الكيمياء في المدرسة الثانوية أو أحد الدورات التدريبية في العلوم أثناء الجامعة أو رواية حول العناية الطبية أو تقارير الجرائد وبرامج التلفاز. في الحقيقة إن جانب استهلاك تداخل التخصصات واستخدامها مهمل من الناحية النظرية في تداخل التخصصات التي تدخل في جميع مجالات الأخلاقيات التطبيقية تقريبًا.
18.4 تداخل التخصصات في الأخلاقيات التطبيقية: الأخلاقيات المهنية للهندسة والعلوم
أظهرت "التخصصية" التي ميزت نمط إنتاج المعرفة في النصف الأخير من القرن العشرين، ويدخل بها "تداخل التخصصات"، شخصية تاريخية محددة؛ في الفترات السابقة كان المنتجون مثل الفلاحين والخياطين وحتى الجنود منتجين ومستهلكين لبضائعهم فالفلاحون يأكلون مما يزرعون والخياطون يلبسون ما يصنعون ويسكن عامة المهندسين المعماريين المساكن التي يبنونها ويحارب الجنود بالأسلحة التي يصممونها ويصنعونها ويقومون بصيانتها، ولم يظهر التباين البنيوي أو الانفصال سوى في العصر الحديث وهو ما أدى إلى ازدهار التخصصات ذات الحدود الصارمة.
في مجال الأخلاقيات المهنية يكون الفصل النمطي بصورته الحديثة بين الإنتاج والاستخدام أقل ظهورا مما هو عليه في مجالات الأخلاقيات التطبيقية، على سبيل المثال نأخذ تطور أخلاقيات مهنة الهندسة وأخلاقيات البحث العلمي ففي الحالتين أصبح تداخل التخصصات هو القاعدة السائدة حيث أن الهندسة تخصص تفرع منه العديد من المجالات المتخصصة بداية من الهندسة المدنية والميكانيكية إلى الكيميائية والكهربائية والإلكترونية والصناعية والنووية والحاسوبية وغير ذلك الكثير، وكان هناك التزام صارم وواضح خاصة منذ تسعينيات القرن العشرين في جميع مجالات الهندسة بالحماية والأمن العام والصحة والرفاهية – وعُرف هذا الالتزام بشرط غلبة المصلحة العامة paramountcy clause، وفي سبعينيات القرن العشرين حفز الاهتمام العام بسلسلة من الإخفاقات المتعلقة بالهندسة (تشمل في أغلبها السيارات والطائرات) كل من المؤسسة الوطنية الأمريكية للعلوم الإنسانية (NEH) ومؤسسة العلوم الوطنية (NSF) لبذل الجهد من أجل تعميق فهم وممارسة الشرط سالف الذكر واشتركتا في تقديم عدد من المنح لفرق البحث التي تضم كل من الفلاسفة والمهندسين لدراسة أخلاقيات ممارسة مهنة الهندسة وأبحاثها، حتى أن مؤسسة العلوم الوطنية (NSF) أنشأت برنامج منح خاص من أجل أخلاقيات وقيم العلم والتكنولوجيا (EVIST) مما نتج عنه عدد من الدورات في أخلاقيات مهنة الهندسة تقدمه فرق مشتركة ونشر كتب تضم أخلاقيات مهنة الهندسة (على سبيل المثال: أونجر Unger 1982 ومارتين Martin وشينزينجر Schinzinger 1983 وهاريس Harris وآخرون 1995).
كما غيرت الديناميكية المشابهة متداخلة التخصصات الانعكاس النقدي والممارسة فيما يختص بأخلاقيات البحث العلمي، ثم جاءت أحداث اختلاس وتصرفات لا أخلاقية العلوم كسوء استغلال المال العام كما تبين في جلسات الكونجرس الأمريكي في ثمانينيات القرن العشرين لتشجع مؤسسة العلوم الوطنية (NSF) والمعاهد الوطنية الأمريكية للصحة AAAS)) على تمويل أبحاث وتطوير حول مسئولية سير الأبحاث. وقد شجع هذا المسار الدراسي مؤسسات مهنية متداخلة التخصصات مثل المؤسسة الأمريكية للأكاديميات الوطنية للعلوم (NAS) والجمعية الأمريكية لتقدم العلوم (AAAS) وأصبح الكتاب الذي صدر في عام 1989 عنوانه حول العلماء "On being a scientist" – وأنتجه فريق تداخل التخصصات المشكل من ممثلين عن علوم الفيزياء والحياة والهندسة والعلوم الاجتماعية وعلوم الإنسان تحت الإدارة العامة للجنة العلوم والهندسة والسياسة العامة للمؤسسة الأمريكية للأكاديميات الوطنية للعلوم والأكاديمية الوطنية الأمريكية للهندسة National Academy of Engineering ومعهد الطب Institute of Medicine ونشرته مطبعة الأكاديميات الوطنية – مصدر معياري للتعليم على مستوى طلبة الدراسات العليا وطلبة الجامعة، ويعرض هذا الكتاب وما يشبهه من كتابات برتوكولات البحث الأساسية فيما يتعلق بأفكار النزاهة والأمانة في تقرير نتائج الأبحاث وتجنب تعارض المصالح، والمعاملة العادلة للمرءوسين والزملاء واحترام حقوق الحيوان لأغراض زيادة الوعي وتعزيز الممارسة العلمية المسئولة أخلاقيًا
18.5 تعميم الأخلاقيات المطبقة
تعرض التباديل التي ناقشناها هنا "للأخلاقيات التطبيقية" أربع سمات مشتركة على الأقل الأولى: الفروق بين تعددية التخصصات وعبر التخصصات وما وراء التخصصات وتداخل التخصصات هامشية بالنسبة لمن يمارسون أخلاقيات تداخل التخصصات، حيث تنخرط فرق تداخل التخصصات في عملها وتتفاوض حول مقاييس تفاعلاتها إجمالا دون أن تكون هناك حاجة ملحة لتحليل الجزئيات، ثانيا: غالبًا ما تعتبر ممارسة تداخل التخصصات اعتداء على الترتيب الصحيح للتخصصات، في تخصص الفلسفة على سبيل المثال غالبًا ما يكون المشتركين في عمل لتداخل التخصصات مهمشين مهنيًا ونادرًا ما يتم قبول الفلاسفة المتخصصين في الأخلاقيات التطبيقية كأعضاء مساوين لمن في قسمهم وأحيانًا ما يُدفعون خارج التخصص للعمل في وحدات تداخل التخصصات مثل برامج وأقسام العلوم والتكنولوجيا ودراسات علم الاجتماع، وفي هذا السياق وصفت جولي تومبسون كلاين (1990 – 2001) طبيعة تداخل التخصصات والتي تظهر في سياقات مؤسسية مختلفة بأنها نتيجة لخروج باحثي تداخل التخصصات "خارج التخصصات".
ثالثا: غالبًا ما تمتد فكرة تداخل التخصصات لما وراء الجمع المبدئي الذي يتكون من المهندسين والعلماء لتضم في النهاية علماء الاجتماع وعلوم الإنسان (فروديمان Frodeman وآخرون 2001) ونتج عنها السمة الرابعة: وهي بروز أسئلة جديدة حول الحدود المهنية والثقافية لعمل الأخلاقيات التطبيقية، وقاد الانشغال بالأخلاقيات التطبيقية في سياق العولمة المعاصرة الباحثين إلى طرح أسئلة حول شرعية معايير سلوكيات الأبحاث المسئولة والتي تم تطويرها في أوروبا والولايات المتحدة الأمريكية مع اختلافها عن الصين والهند وجنوب أفريقيا (اللجنة الأوروبية 2009).
وإلى جانب عدد من المثل العليا الأخلاقية الموضوعية المختلفة مثل الموافقة الحرة المستنيرة في أخلاقيات علم الأحياء واستدامة الأخلاقيات البيئية وحماية الخصوصية في أخلاقيات الحاسوب هناك أيضا التزامين آخرين في مجالات الأخلاقيات التطبيقية، الأول هو أن الخبراء الفنيين ملزمين بتعزيز الثقافة العامة فيما يختص بالجوانب الأوثق صلة بعملهم، والآخر هو أنه، عند ملائمة الحال، يكون هؤلاء الخبراء ملزمون بإشراك العامة في صنع القرار المتعلق بالأمور الفنية. ويمكن اختصار هذان الالتزامان المثاليان بالقول أن التقرير الأخلاقي للشروط المحددة للأبحاث وإنتاج المعرفة يتطلب مسئولية مشتركة أو تعاون لتداخل التخصصات ما بين المجتمع العلمي وعامة الشعب (ميتشام 2003)، وهذا يتطلب في المقابل من علم الأخلاق (في التشكيل الشامل له) التفكير مليًا في النقاط غير المفهومة التي لا يمكن تجنبها حتى يتم التحول من إطار مرجعي لآخر وحتى يتم تقدير السمة المميزة للأشكال المختلفة للمعرفة والأساليب المتباينة لإنتاج المعرفة والأغراض المختلفة لخلق المعرفة. إن توضيح المسئولية الأخلاقية للخبراء الفنيين لإشراك عامة المواطنين في صناعة القرارات الفنية يفعل المقولة السياسية "لا ضرائب دون تمثيل" حيث أننا نعيش في عالم تكون فيه للأبحاث العلمية والمخترعات التقنية تأثير هام على المواطنين أكبر من تأثير سياسات الضرائب الحكومية، وينقل هذا المبدأ الأخلاقيات التطبيقية من محيط السلوك الشخصي إلى محيط السياسة والسياسات (وينر 1980 وجولدمان 1992).
18.6 أخلاقيات تداخل التخصصات باعتبارها أخلاقيات العمل المتناوب
يشير الاستعراض السابق للأخلاقيات التطبيقية إلى أنه من الصعب القيام بتلك المهام دون اشتراك تداخل التخصصات وهذه الحقيقة الثابتة تشير إلى قيمة ألا وهي القيام بأعمال تداخل التخصصات وفقا لأعلى مستوى أخلاقي ممكن؛ وعلى الرغم من أن القيمة قد لا تؤخذ من الحقيقة إلا أن الحقائق يمكن أن تحفز تدبر القيم ذات الصلة، ويعتبر التفكير في الطرق الصحيحة والخاطئة في عمل تداخل التخصصات هو توقع لأخلاقيات تداخل التخصصات، وفي مثل هذا التوقع يكون من المفيد أن نبدأ بتوصيف عام لتداخل التخصصات في ذاته، وعلى الرغم من أن تعاون تداخل التخصصات يتخذ أشكالا عديدة منها – تعددية التخصصات وعبر التخصصات وتداخل التخصصات وما وراء التخصصات وهي الأشكال الأربعة أنواع المشهورة على سبيل المثال – إلا أن توحيد جميع أشكال تداخل التخصصات هو ما يمكن أن نصفه بظاهرة "العمل المتناوب" بالمعنى الحرفي والمجازي للتعبير، وانطلاقًا من هذه النقطة فسوف يتضمن بيان أخلاقيات تداخل التخصصات تحول في لغة الخطاب وفي النبرة, وليس هذا إلا بيان آخر للحركة الديناميكية التي تميز عمل تداخل التخصصات.
وعلى عكس النوبات التي تبدأ وتنتهي مع دقات الساعة فإن تحول تداخل التخصصات من إطار إلى آخر يتطلب تخطي الحدود الدائم بينها، وعالجت الكثير من الدراسات تخطِ هذه الحدود على أنه استثناء وليس قاعدة: "ومع هذا فإنه عند هذه النقطة التاريخية فإن التفاعل وإعادة التنظيم الذي يحدثه تخطِ الحدود وإعادة التنظيم يكون أساسيا بالنسبة لإنتاج وتنظيم المعرفة تماما كتكوين الحدود والحفاظ عليها" (كلاين 1996 صفحة 2) ولكنه قد يكون من الصعب وضع اليد على الديناميكيات المحددة لهذا العمل المتناوب عبر الحدود، ناهيك عن معرفة كيفية بذل تأثير إيجابي عليها وفي هذه الحالة فإن كلمة "يجب" لا يفترض أن تعني "يستطيع" ولكنها تفترض "المحاولة".
وعلى الرغم من أن العمل المتناوب داخل التخصصات تيسره التقنيات الحديثة إلا أنها لا تحدده؛ وحيث أن العمل المتناوب يمكنه ويحفزه التقدم التقني في مجال الانتقالات والاتصالات وتخزين المعلومات واستعادتها فإن العمل المتناوب يظهر في الفصول التعليمية وصالات العرض والعوالم الافتراضية على الإنترنت وعلى الشبكات الاجتماعية ومن خلال نقاط الوصول المحمولة، كما أن المواقع التقليدية لإنتاج المعرفة – مثل معامل البحث والاستوديوهات الفنية والجامعات والمتاحف والمكتبات والمعارض والمسارح والمراكز الاجتماعية – جميعها تخضع للتغيير من قبل قاطنيها لأنهم تبنوا ممارسات جديدة في الاتصالات والتشكيل المجتمعي وإنتاج المعرفة واستخدام التقنيات.
نظرًا لاعتماد فلسفة العمل المتناوب على التغير التكنولوجي دون أن تكون متوقفة عليه، فإن هذا يستدعي استثمار ما يمكن أن نطلق عليه الخيال التكنولوجي وهي صفة عقلية تُمكن البشر من التفكير بالتكنولوجيا ومن خلالها (بالسامو Balsamo تحت الإصدار) ويكافئ هذا ما يسميه ألبرت بورجمان Albert Borgmann "الأخلاقيات الحقيقية" وهي الأخلاقيات التي تتعدى لما وراء الأفكار والنظريات وتتوسع لما يزيد عن التركيز على التفاعلات الشخصية، "الحقيقية تعني الملموسة والأخلاقيات الحقيقية تتحمل مسئولية إقامة الواقع الملموس في الحياة" (بورجمان 2006، صفحة 11)، وتقوم الأخلاق الحقيقية على الاعتراف بأنه حتى عندما نصمم العالم المليء بالمصطنعات الذي نعيش فيه فإن هذه المصطنعات تشارك في تصميمنا، بالإضافة إلى أن الخيال التكنولوجي ينطوي على الأدائية والارتجال والاستثمار فيهما يقوم على تقدير أو فهم كل من: (1) الطبيعة الخفية للمعرفة في هذا العصر الرقمي، (2) الأوجه المتعددة لعواقب الابتكارات التكنولوجية، (3) تطوير بروتوكولات جديدة من أجل تشريع نشاط تداخل التخصصات وكلما كان الخيال التكنولوجي خصب، كانت الأسئلة المطروحة حول هذه العوامل الثلاث لممارسة تداخل التخصصات أفضل.
(1) فيما يتعلق بالطبيعة الخفية للمعرفة لمن يمكن اعتبارهم الآن من مواليد الجيل "الرقمي" (الذي كوّن وعيه بعد ظهور الإنترنت في تسعينيات القرن العشرين) حيث يتضح أن البيانات لا تساوي المعلومات والمعلومات لا تساوي المعرفة وأن الحياة اليومية ما هي إلا مشهد للتحولات المستمرة بين السياقات المختلفة والمتشابكة؛ وبالتالي تظهر درجة من التجاوز في كثير من الأحيان نابعة من الخبرات المتكررة للانتقال عبر تدفقات المعلومات المترابطة، كما أن نجاح هؤلاء في الإبحار في وسائل الإعلام المتدفقة والتعليم المستقى من جوانب متعددة وبيئاتهم الاجتماعية هي أمور تتطلب تغيرا سلسا في المصالح والهويات والانتماءات، ويصبح هذا التغير إحدى سماتها القوية، وليس سوى هذه الحساسية والتغير السلس إلا ما يعتبر أساسا للتعلم مدى الحياة.
لكن هذه التغير لم يتم استيعابه بسهولة داخل المؤسسات الراسخة التي تحكم إنتاج المعرفة وتمررها والتي تعتمد على هياكل معينة وتقاليد وطقوس على درجة عالية من التقليدية للإنتاج في كثير من الأحيان، وحتى يتم تصفح عوالم الشبكة الرقمية المعاصرة بنجاح فإنه يجب على المشاركين تعلم طريقة تحويل البيانات إلى معلومات كما يجب عليهم أيضا أن تكون لديهم القدرة على دمج المعلومات الواردة من المصادر المختلفة لخلق المعرفة. وباختصار يجب عليهم أن يتعلموا كيفية جمع المواد المأخوذة عن تدفقات المعلومات المختلفة، وحتى يتحقق ذلك يتعلم المشتغلون بالعمل المتناوب ذو الطبيعة الرقمية إنتاج المعرفة من خلال إجراء حوارات بين التخصصات والتفاوض الاجتماعي والتعاون مع الأقران والخبراء والكثيرين غيرهم، وبهذا سوف تعتمد أنشطة إنتاج المعرفة على فهم كيفية عمل التخصصات كممارسة مؤسسية للتحقق من المعرفة، ويتعلم من يعملون في العمل المتناوب كيفية الدخول في محادثات مع من يحملون قيما ثقافية متنوعة أو التزامات فكرية، وتتضمن الخبرة اليومية بالفعل مع الجيل الرقمي ممارسات توليفية مبتكرة مثل استخراج البيانات وإعادة الجمع والتعديل؛ ولكن حتى يكون هناك خلق للمعرفة يجب أن يتعلم علماء تداخل التخصصات كيف ينقدون فيض المعلومات التي يعيدون جمعها وبهذا المعنى لا تكون "القراءة الناقدة" مجرد قراءة بلا معنى.
(2) ويمكن تلخيص الآثار متعددة الجوانب للابتكار في هذه المعادلة: الابتكار التكنولوجي = التحول الاجتماعي، فالأبحاث التي ينتج عنها ابتكار تكنولوجي تتسم بأنها قادرة على التغيير من الناحية الاجتماعية والثقافية بقدر ما تستطيع الابتكارات التكنولوجية بجميع أنواعها أن تحدث تحولا في النسُق الاجتماعية والثقافية، ويتخذ هذا التحول شكل تكوين الرأي العام الجديد والسياسات والبروتوكولات الاجتماعية والخدمات والروايات الثقافية والتطبيقات التكنولوجية الجديدة والأجهزة؛ وبهذا فإن هذه الابتكارات تستدعي تعاون تعددية التخصصات ولا تقتصر فقط على السعي وراء خلق منتجات تكنولوجية جديدة، ولكنها تسعى كذلك لتشكيل خطوط سياسية متوازية في تعاون تداخل التخصصات، في الماضي كان مثل هذا التعاون محدودا بلا داعٍ، كما أشار كل من كاثي ديفيدسون Cathy Davidson وديفيد جولدبيرج David Goldberg (2004) في كتابهما (بيان عن العلوم الإنسانية في عصر المعلومات" إلى أن من ينادون بتعاون متداخل التخصصات يركز على المشكلات الاجتماعية المنتشرة غالبا ما يتجاهلون مساهمات علماء العلوم الإنسانية، وعلى سبيل المثال فقد استشهدوا بكل من جيفري ساتشس Jeffrey Sachs بصفته مدير معهد الأرض بجامعة كولومبيا والمستشار الأمين العام للأمم المتحدة للأهداف الإنمائية للألفية الجديدة، وعلى الرغم من إصراره على أن "تداخل التخصصات هو السبيل الوحيد لحل مشكلات العالم" فقد اقترح الجمع بين علوم الأرض والبيئة والهندسة والصحة العامة والعلوم الاجتماعية فقط مع جرعة كبيرة من علم الاقتصاد – وترك الفنون والثقافة والفلسفة، إلا أن المشكلات الاجتماعية المعقدة تتطلب إيجاد حلول مهجنة تستفيد من دمج التحليلات الفكرية الثقافية الدقيقة، كما تعتبر الجوانب الثقافية للتصميم التقني والاستخدامات التقنية والتوزيع والتطبيق والصيانة وكذلك التخلص منها عمليات جوهرية لتشكيل حلول مناسبة للمشكلات الاجتماعية المتنوعة.
(3) وبعد المطالبة بضم مجموعة أوسع من التخصصات المشاركة يجب ملاحظة أن من يتعاونون كأعضاء في فرق تناوب تداخل التخصصات يجب أن يقاوموا أي تقسيم سطحي للعمل والذي قد يحصر العلماء في دراسة الظروف والمهندسين في تصميمات المصطنعات ويُترك علماء الاجتماع والعلوم الإنسانية لممارسة النقد، فبينما يجب أن يقوم المشاركين على اختلافهم بأدوار مختلفة فيجب أن يكون الجميع على استعداد – بل في الواقع متحمسين – لتعلم مهارات وأطر تحليلية ووسائل وممارسات جديدة وهذه هي نقطة البداية للأخلاقيات العملية لتداخل التخصصات، فحينما يجتمع الأفراد من مختلف التخصصات أو حتى من مجالات متداخلة التخصصات فمن المهم أن نقر بأن كل منهم لديه ما يشاركه مع الآخرين وما يتعلمه منهم؛ لذا يمكن أن تعد الفضائل التالية دليلا على العادات الخلقية المناسبة في مجال تداخل التخصصات في العمل المتناوب:
السخاء الفكري: وهو التقدير الأصيل لأعمال الآخرين ويجب أن يتم التعبير عنه للآخرين بوضوح إضافة إلى التعاون معهم واقتباس أعمالهم وإظهار التقدير لأفكارهم ضمن المحادثة المباشرة معهم أو من خلال التعاون الذي يحفز المُخاطرة الفكرية والإبداع.
الثقة الفكرية: هو الإيمان بأن الفرد لديه شيء هام ليساهم به والثقة تجعل الشخص يتجنب المفاخرة وتتضمن الالتزام نحو المساءلة عن جودة التعاون فكل ما يسهم به كل شخص مشارك يجب أن يكون موضع ثقة ورافض للطرق المختصرة وحذر من الكسل الفكري.
التواضع الفكري: وهو الاعتراف بأن معرفة الفرد جزئية وغير مكتملة وقابلة للتوسعة والتنقيح على الدوام وهذه هي المزية التي تسمح للناس بالاعتراف بأنهم لا يتعلمون شيئًا دون المعاناة من فقدان الثقة أو تقدير الذات.
المرونة الفكرية: هي قدرة الفرد على تغيير وجهة نظره خاصة استنادًا إلى الرؤى الجديدة للآخرين ويمكن أن يتضمن هذا القدرة على التعامل وتعليق الحكم وتخيل طرق أخرى لوجوده في هذا العالم وعوالم أخرى يمكن أن يوجد بها.
النزاهة الفكرية: هي ممارسة المشاركة المسئولة، وهذه عادة هي أساس تنمية الثقة وهي مزية تجبر الزملاء على تقديم أفضل أعمالهم والتفكير في بذل جهود تعاونية.
ومع هذا وبعيدًا عن هذه الفضائل بالذات، تفترض الأخلاقيات العملية لتداخل التخصصات أن الإنتاج والاستخدام متداخل التخصصات الذي يتميز بفاعلية أكبر هو أمر طبيعي، فهو توجه واقعي ولا يسعى سوى لتحسين مخرجات تداخل التخصصات – مما يحسن من عمل تداخل التخصصات دون أن يطرح تساؤل حول جدوى تطبيق تداخل التخصصات.
وفي نفس الوقت ألا توجد حاجة إلى المطالبة بالمزيد والمزيد من الإنتاجية، فمثل هذه المطالبة تعتبر أمرا شرعيا فيما يتعلق بالإنتاج المادي، فلماذا لا نطبقها أيضا في إنتاجية تداخل التخصصات سواء طُبقت في مجال السلع المادية أو المعرفية؟ أليس من الممكن أن تغمرنا المعرفة والابتكار؟ أوليست هذه هي المسائل النهائية لأية أخلاقيات لتداخل التخصصات؟
18.7 الخاتمة
خضع علم الأخلاق - كشكل من أشكال تداخل التخصصات – إلى الوصف المستفيض من الناحية التاريخية امتد من العصر المحوري (من حوالي 800 إلى 200 ق.م) وحتى القرن الحادي والعشرين، وحدد هذا الاستقصاء خمسة أُطر رئيسية توسط فيها علم الأخلاق في التفاعلات بين الإنسان والجوانب الأخرى للواقع؛ مما يشكل امتدادا مجازيا لفكرة تداخل التخصصات ولكنها تقترح احتمالات أعمق من تلك التي عادة ما نتخيلها – وتذهب لما وراء ما هو مألوف في تداخل التخصصات كحل المشكلات.

MEDIA SERVICES TERMS AND CONDITIONS
Please read these terms carefully before submitting a signed Order Form for a Service. Client will be legally bound by these terms when Reuters sends Client a countersigned Order Form. Client is advised to print off and keep a paper copy of these terms.
Any terms not defined below shall have the meaning ascribed to them in the applicable Order Form.
Agreement - these terms and conditions, any applicable Order Form and any other schedules, declarations or addenda referred to in them.
As Is – the incorporation into the Client Service, of items of Reuters Content including (but not limited to) stories, pictures, graphics and videos, in their entirety, without making substantial alterations to the original item.
For the avoidance of doubt, As Is shall encompass insubstantial alterations performed by Client for reasons of style, size or localization (meaning the adapting of terms/phrases for Client’s local audience) which do not distort the meaning of the Reuters Content and editing for length to produce a news brief.
As Source – the selective incorporation into original Content created by the Client Newsroom for the Client Service of facts, figures, statements, quotes, background material, still or moving images or portions of text from the Reuters Content and combining this with information from other sources to prepare original news stories (being stories that are not recognizable as being sourced from Reuters whether by means of expression or as sole factual content). For the avoidance of doubt paraphrasing or summarizing a complete story, editing a story for length only, or making only minor alterations to a story is not use of Reuters Content As Source.
Automated Publication – the automated publication of Reuters Content As Is in the Client Service without human editorial intervention.
Charges - the fees for the Services and any related charges set out on any Order Form or schedule or otherwise specified under this Agreement. Charges may, for the avoidance of doubt, include but not be limited to the following (where applicable): installation, displacement, removal fees; support fees; any third parties’ equipment and/or other services fees and any taxes due in relation to the Services provided under this Agreement.
Client Newsroom - the Client’s editorial operations, staffed in whole or in part by professional journalists, performing the newsgathering, editing and programming functions required to produce the Client Service.
Client Service – the Client’s publication(s), program(s), service(s), internet site(s) application(s) and/or mobile property(ies) specified in any applicable Order Form for which Client is granted certain rights under this Agreement to use Reuters Content.
Confidential Information - information in any form (including, but not limited to, models, software and computer outputs) which is not excluded under clause 11.2, whether written or oral, of a business, financial or technical nature which is marked or otherwise indicated as being or is, or ought reasonably to be, known to be confidential and which is disclosed by either party or any member of its Group (the Disclosing Party) to the other party or any member of its Group (the Receiving Party) through its dealings with each other.
Content - content in whatever form including text, data, graphics, moving and still images, sound recordings and underlying works.
Third Party Provider - a third party (other than members of the Reuters Group) whose Content is contained in the Services.
Contributed Content - audio-visual Content supplied by Client for use in services supplied by the Reuters Group as specified in the Order Form.
Control - the power to direct or cause the direction of the management of policies of another entity, whether through the ownership of voting securities, by contract, or otherwise.
Digital Media – together, Online Media, Mobile Devices any digital physical storage medium and any other electronic media capable of receiving Content, excluding standard television and radio.
Digital Publication Limit – the number of items of Reuters Content which may be published via Digital Media in the Client Service per day, as set out in the relevant Order Form.
Digital Rights – the right to reproduce and distribute Reuters Content in the Client Service via Online Media and Mobile Devices.
Edit – the editing, adapting, sub-editing, dubbing and/or interpolation of any Content and translation of any textual or audio part of any Content by human intervention.
Equipment - hardware and/or software and related documentation supplied by a member of the Reuters Group and listed on the applicable Order Form.
Extract - any extract of Reuters Content including, but not limited to, any discrete report, story or textual item, audio or visual clip or still image (including, but not limited to, a photograph or graphic).
Financial Information Service - any Service comprised of access to data or other financial information via a Reuters terminal product and specified in an Order Form as a Financial Information Service.
Force Majeure – an event beyond either party’s reasonable control, including, without limitation, labour dispute, act of God, war, riot, civil commotion, malicious damage, act of terrorism, compliance with law or governmental order, failure of telecommunications, fire, flood or storm.
Group - with respect to Reuters, the Reuters Group and, with respect to Client, Client’s holding companies and Subsidiaries and Subsidiaries of such holding companies.
Host - a third party used to host or maintain the Client Service or to distribute Reuters Content.
Installation Address - any location of Client’s (or Client’s Host) to which the Services are supplied directly by Reuters, to which the Services are downloaded or from where Services are accessed, each as specified in any Order Form.
Manual Publication – means any publication of the Reuters Content in the Client Service, As Is or As Source, with human intervention performed by the Client Newsroom.
Media - any media via which the Client Service may be provided as specified in any applicable Order Form.
Initial Term - the initial term period specified in the relevant Order Form for any particular Service.
Mobile Devices - any portable device using wireless technology including, but not limited to, cellular phones, personal digital assistants and pagers, used by an individual to receive Content from via an application, a dedicated mobile platform or from the internet.
Online Media - any internet site or online service.
Order Form – any Reuters standard order form listing the Services ordered by Client and which Reuters accepts.
Pictures Service(s) - the Service(s) comprised of photographic and graphic Content specified in an Order Form as (or which Reuters notifies Client is) a Pictures Service.
Ready to Publish Service(s) - the Reuters online report(s) and any other Service specified in an Order Form as (or which Reuters notifies Client is) a Ready to Publish Service.
Reuters Content - the Content contained in the Services (or any part), including Reuters headlines and any third party content, individually and collectively.
Reuters Group - collectively any business entity that, from time to time, directly or indirectly Controls, is Controlled by, or is under common Control with Reuters, or that is a successor (including, without limitation, by change of name, dissolution, merger, consolidation, reorganization, sale or other disposition) to any such business entity or its business and assets.
Reuters Video Library – Reuters video archive, the contact details of which will be provided to the Client by the Reuters account manager.
RIC(s) - the set of codes also known as Reuters Instrument Codes.
Service(s) - the service(s) supplied by Reuters under the Agreement, which include(s) the provision of Content and Support.
Software - software or any part of it and related documentation, whether and ancillary part of a Service or otherwise, including any upgrades and enhancements, as listed on the applicable Order Form.
Subsidiary - a company in which another company owns directly or indirectly more than 50% of the issued share capital or equivalent rights and over which it exercises effective control.
Support - the use of reasonable efforts to maintain the Equipment, Software and/or Services in good operating condition, provision of modifications to enhance Services and, where applicable, installation, removal or relocation of the Equipment.
Term - the Initial Term plus any renewal period(s) during which Client is subscribing to relevant Service(s) under this Agreement.
Territory - the geographic locations (if any) specified in the applicable Order Form in which the Client Service is disseminated.
Text Service(s) - the Service(s) comprised of textual Content specified in Reuters Media Services Order Form – Text, Pictures and Ready to Publish Services and any other Service which Reuters notifies Client from time to time is a Text Service.
Video Service(s) - the World News Service (or any successor service) comprised of video Content (together with the accompanying textual scripting information), the DeskTop Library Service and any other Service specified on an Order Form (or which Reuters notifies Client is) a Video Service.
Web Widget – a shareable web application or component which can be embedded on a computer desktop or in a web page to display dynamically updated content, for example, news headlines.
1. SCOPE, COMMENCEMENT AND DURATION
1.1 For regulatory or other reasons, some Services are provided by another member of the Reuters Group. Client’s rights and obligations in respect of these Service are therefore against/towards the member of the Reuters Group specified on the applicable Order Form as providing such Service. The meaning of “Reuters” is construed accordingly.
1.2 This Agreement shall remain in full force and effect as long as any Order Form is in effect. Unless otherwise stated in the Order Form, at the expiration of its Initial Term or any renewal term, each Order Form shall automatically renew for a period of twelve (12) months, unless either party provides notice of termination ninety (90) days prior to the end of the then current term.
2. REUTERS SERVICES
2.1 Reuters will supply the Services to Client or make the Services accessible to Client at the Installation Address. Client will pay the Charges and use the Services solely in accordance with the terms of the Agreement.
2.2 Client agrees that it (a) will not use the Services in contravention of any laws or regulations; (b) is responsible for obtaining and maintaining all required licences and consents to receive and use the Services and making any filings necessary to provide the Client Service such as consents of broadcasting, telecommunications or other government or regulatory authorities; (c) shall ensure that any passwords used to access the Services are not shared and are kept confidential, and shall notify Reuters promptly if it becomes aware of any password being used by a person not authorised to access the relevant Service; (d) shall have its personnel complete any forms and/or consents Reuters reasonably requires in order for Reuters to comply with any statutory obligations relating to the usage, storage and transfer of such personnel’s personal data by Reuters as required in the course of Reuters Group operations, and (e) shall inform end-users of Client Service(s) that Reuters Content is to be used only for their own personal non-commercial use.
3. USE OF REUTERS CONTENT
3.1 GENERAL CONDITIONS APPLICABLE TO ALL SERVICES
3.1.1 Reuters grants to Client during the Term the non-exclusive, non-transferable, non-sublicensable right, subject to the terms of the Agreement, to use Reuters Content As Is and As Source, solely by incorporating it in the Client Service for dissemination via the Media in the Territory, and to make such internal copies as are necessary to enable such use.
3.1.2 Client must comply with any editorial or mandatory delay codes contained in Reuters Content and any other reasonable limitations or restrictions placed by Reuters, Third Party Providers and/or any court or competent authority on the use, display or distribution of the Reuters Content including, but not limited to, limitations specified in scripts to Video Services or the requirement of a separate licence by the Third Party Providers. Reuters will inform Client of the meaning of any such codes.
3.1.3 Reuters has complete editorial freedom in the form and content of the Reuters Content and may alter the same from time to time. Such alterations may include, but are not limited to, withdrawing items and publishing corrections. Client agrees to take prompt action in response to corrections and withdrawals issued through the Service(s) and to use all reasonable efforts to incorporate the latest corrected version in the Client Service or, in the case of withdrawals, to immediately remove, insofar as is possible, any withdrawn item from the Client Service, including where applicable, archived versions of the Client Service.
3.1.4 Except where Client is using Reuters Content for the purposes of reporting current news, Client is fully responsible for obtaining at its own cost any necessary rights clearances from third parties relating to any part/aspect of the Content which may be protected by proprietary rights, copyright, neighboring rights (including, without limitation, moral rights and performers’ rights) or privacy rights prior to the use of such Content by Client, including, but not limited to, (a) clearances from people whose name, portrait, image or performance appear in the Content and/or (b) clearances in respect of musical works, sound recordings, buildings, works of art, designs, public monuments and/or other inanimate objects contained in the Content.
3.1.5 Automated Publication of Reuters Content in the Client Service is prohibited except as set out in Clause 3.5.2.
3.1.6 Client may include Extracts from Text, Video, Picture and/or Ready to Publish Services in the Client Service and in textual research materials (including scripts) prepared by Client and intended solely for the purpose of producing the Client Service.
3.1.7 Save as set out in Clause 3.4.1, Client may Edit any Extract for the purpose of incorporating such Extract in the Client Service provided that Client does not distort the meaning of such Extract or subject any Extract or any part of it to derogatory or defamatory treatment. Without limiting any other rights of Reuters, if Client breaches this clause, it will publish or broadcast (as applicable) in the applicable Client Service a retraction in a form and manner reasonably requested by Reuters and in line with local practice.
3.1.8 Where Client translates a substantial part (with respect to quality or quantity) of any Extract from the original language, Client will identify itself as having translated such Extract.
3.1.9 Client may permit and facilitate its users to e-mail, print or share Reuters Content on an ad hoc non-commercial basis for individual use only and branded in accordance with clause 8 (e.g. “e-mail this story to a friend”, “print this story” or “share this” buttons.)
3.1.10 Where access to the Reuters Content on the Client Service is pass-word protected, Client will provide Reuters with reasonable access to it free of charge to enable Reuters to verify Client’s compliance with the Agreement.
3.1.11 Client must not display the name, logo, or trademark or other identifier of any third party in such manner as to give the viewer the impression that such third party is a publisher or subscriber of the Reuters Content on any pages containing any Reuters Content. This does not prohibit conventional advertising or sponsorships that do not create such impression.
3.1.12 Client will not include any advertising or sponsorship in connection with Reuters Content that (a) breaches any law or regulation where the Client Service may be viewed or (b) falsely implies that the advertiser or sponsor is associated with Reuters or with the Reuters Content.
3.1.13 Client shall, at Reuters request, provide any relevant circulation or audience figures with respect to its dissemination of the Reuters Content; such information will be kept confidential by Reuters.
3,1,14 Reuters grants Client a non-exclusive, non-transferable license to use RICs for the term of the Agreement solely for the purposes of accessing and identifying Content from the Reuters Services, provided that the RIC may only be distributed with the underlying Content (i.e., Client may display a RIC as one of the identifiers of such Content).
3.1.15 Client will ensure that any Host complies with this Agreement and Client agrees that any breach by such Host will be treated as a breach by Client.
3.2 ADDITIONAL CONDITIONS APPLICABLE TO VIDEO SERVICES
3.2.1 Client may not strip out (in whole or in part) any Extract from a Video Service incorporated in the Client Service in order to re-supply or allow the re-use of such Extract by any person in any manner not authorized by Reuters. Where Client adds any voiceover to the Reuters Content, Client will identify itself as the source of such voiceover.
3.2.2 Where Client agrees to supply Reuters with Contributed Content during the Term, Client grants Reuters a non-exclusive, non-transferable, non-sublicensable, perpetual and royalty free right to include and distribute such Contributed Content in any service supplied by a member of the Reuters Group to its clients, provided that (i) Reuters will clearly and prominently identify Client as the supplier of the Contributed Content; (ii) Reuters will bear any costs associated with the delivery of the Contributed Content to Reuters; (iii) Client will not supply and Reuters will not use any Contributed Content in breach of any applicable laws and regulations; and (iv) Reuters will observe any reasonable conditions notified to it by Client regarding the use of the Contributed Content including any obligations imposed by any court or competent authority.
3.2.3 Client must keep an accurate and up-to-date record of tapes, or other media as appropriate, in which Reuters Content is stored specifying the date, story, title and source of each tape (or other media) as specified in the related scripting information. At Reuters request, Client will provide Reuters with a copy of such record.
3.3 ADDITIONAL CONDITIONS APPLICABLE TO FINANCIAL
INFORMATION SERVICES
3.3.1 Client will use Content from any Financial Information Service for its internal information purposes only. Client will not distribute or redistribute such Content to any person (a) except for personnel specifically authorized to access or retrieve such Content from devices or accesses declared in the relevant Order Form or any addenda, and (b) except that Client may redistribute limited Extracts in a non-systematic manner only as part of original content created by Client for the Client Service.
3.3.2 Client agrees to comply with any restrictions or conditions imposed on the use, access, storage, and permitted distribution and/or redistribution of Content from any Financial Information Service by the relevant Third Party Provider and to provide Reuters with copies of all required authorizations upon Reuters reasonable request. Reuters or the Third Party Provider will notify Client of these. Client also agrees to enter into a separate agreement with Reuters or any such Third Party Provider if required.
3.4 ADDITIONAL CONDITIONS APPLICABLE TO READY TO PUBLISH
SERVICES
3.4.1 Client may not Edit Video Content in Ready To Publish Services except to Edit for length only.
3.5 ADDITIONAL CONDITIONS APPLICABLE WHERE REUTERS
CONTENT IS DISTRIBUTED VIA DIGITAL MEDIA
3.5.1 Client may distribute Reuters Content via Digital Media when one or more Digital Media rights are granted on the relevant Order Form, subject to the following: (a) Client confirms and represents that the primary and intended market for the Digital Media version of the Client Service is the Territory; (b) Client will not include in the Digital Media version of the Client Service any Content which Reuters identifies as being subject to any restrictions which such use/redistribution would contravene, including, but not limited to, any embargoes regarding mobile use or any geographical restrictions; (c) any photograph included in the Digital Media version of the Client Service shall be displayed in a format no higher than 800x800 pixels resolution and (d) Client will not display photographs in the Digital Media version of the Client Service in a way that simulates video.
3.5.2 Using Automated Publication, Client may distribute via the relevant Digital Media (a) Ready to Publish Services without quantitative restrictions on the number of items distributed (provided that Client shall comply with the restrictions in any video) and/or (b) Reuters Content from Text Services and Pictures Services subject to the Digital Publication Limit specified on the relevant Order Form.3.5.3 Using Manual Publication, Client may distribute via the relevant Digital Media Reuters Content from Text Services, Pictures Services, Video Services and Ready to Publish Services, subject in the case of Pictures Services to any Digital Publication Limit specified on the relevant Order Form.
3.5.4 With regard to any Service, Client must not permit, solicit or encourage (to the extent within its control) other internet sites or online services to frame, or present in any other way, Reuters Content on the Client Service. To the extent technologically feasible and commercially reasonable, Client will not permit any third party to frame the Client Service such that the Reuters Content appears on the same screen as that third party’s service. If this occurs, Client agrees to cooperate with Reuters in causing such third party to cease and desist from such framing.
3.5.5 With regard to any Service or Client Service comprised exclusively of Reuters Content, Client must not syndicate to third parties RSS feeds or Web Widgets linking back to the Reuters Content in the Client Service, except that Client may distribute headlines, short textual abstracts, or thumbnails of Reuters Content items (Teasers) present in the Client Service in email newsletters, RSS feeds and Web Widgets that it makes available to individual users of the Client Service provided that Client informs such end-users that Reuters Content is to be used only for their own personal non-commercial use, and such Teasers link back to the corresponding Reuters Content items in the Client Service.
3.5.7 If pursuant to the foregoing or any other terms of this Agreement, Reuters Content is reproduced or posted on any social media or other third party website, and such third party website seeks to exploit purported rights to the Reuters Content contrary to the terms of this Agreement, then Client shall remove the affected content from such third party website.
3.5.6 Any item of Reuters Content incorporated As Is or As Source in the Client Service and distributed via Digital Media may be displayed within the Client Service for the duration of this Agreement.
4. STORAGE OF CONTENT
4.1 Unless longer storage is required by applicable law or is set out in the relevant Order Form, Client may store the Reuters Content as follows: a) Reuters Content in Text Services, Pictures Services and Ready to Publish Services may be stored and used for 12 months only; and b) Reuters Content in Video Services may be stored until cancellation or termination by either parties of such Video Service, provided that such Reuters Content can only be used in the Client Service for a period of 30 days after its receipt from Reuters. Should Client wish to use any item of Reuters Content in Video Services 30 days after such item is received, Client must provide notice to the Reuters Video Library and pay the standard library charges which will be advised to Client on request.
4.2 Client agrees to delete stored, unused Content at the end of the applicable storage period set out in Clause 4.1 above. For clarity, except as set forth in 3.5.6, the foregoing shall not prejudice Client’s right to store the Reuters Content as previously incorporated in the Client Service.
4.3 Clauses 4.1 and 4.2 will not apply to Client’s use of DeskTop Library Service. Instead, Client may use the Content from this Service in the Client Service throughout the Term. Client may not store any Content from this Service other than on the media on which the Service is provided, and will return such Content to Reuters upon cancellation or termination of the DeskTop Library Service or the Agreement.
5. SOFTWARE (if applicable - see Order Form)
5.1 In order for Client to use certain Software owned or licensed by a third party, Client may be required to enter into an additional third party software agreement.
5.2 Reuters grants to Client during the Term a non-exclusive, non-transferable right to use the Software at the Installation Address solely for purposes of accessing the Reuters Content. Client may not sub-license, assign, copy (except for back-up purposes), distribute, modify, merge, transfer, decompile or reverse engineer the Software except to the extent permitted by Reuters in writing or to the extent this restriction is not permitted by applicable law.
6. EQUIPMENT (if applicable – see Order Form)
6.1 Reuters or its nominees will supply and/or install the Equipment as indicated on the Order Form at the Installation Address so that Client may access the Reuters Content. Reuters may, at any time and upon 30 days’ written notice (or upon less or no notice if reasonably necessary), replace the Equipment with other equipment (which will then be deemed to form part of the Equipment) or replace the means of transmission of the Services with another means of transmission.
6.2 Client will at its own cost and expense, obtain any and all consents for the installation and use of the Equipment. Client will not move the Equipment from its location as installed without the prior consent and supervision of Reuters, nor will Client allow the Equipment to become subject to any claims, liens or encumbrances. Client will not allow any person other than Reuters or its nominees to maintain and/or repair the Equipment. Client will provide, at its own cost and expense, all connections from its own computer systems to the Equipment in accordance with industry standards, and will be solely responsible for all transmission and communication of the Reuters Content from the Equipment to Client’s computer system.
6.3 Client will be responsible for any loss or damage caused to or by the Equipment from any cause whatsoever unless such loss or damage is attributable to any act or omission of Reuters.
6.4 Client agrees that, from time to time, it may be necessary for it, at its own cost and expense, to upgrade its equipment in order to maintain compatibility with modifications to any part of the Service and the means of accessing the same.
7. SUPPORT
7.1 Reuters or its nominee will provide Support. Reuters shall have no obligation to provide Support that is required because of: (a) accident, negligence or misuse not attributable to Reuters; (b) failure of an operating environment or causes other than ordinary use; (c) attempts made to repair, modify, relocate or service the Software or Equipment by persons other than the personnel of Reuters or its nominees; (d) use of non-current versions of the Software and/or Equipment where current versions have been made available to Client; or (e) use of hardware or software not supplied by Reuters. If Reuters provides support for any of the foregoing reasons, Client will pay for Reuters time and materials at Reuters then-current rates. Client will allow Reuters or its nominees access to the Installation Address, and any other reasonable location, at all reasonable times, with reasonable prior notice, in order to install, inspect, maintain, repair, replace or remove all or part of the Software and/or Equipment.
8. NOTICE, CREDIT AND BRANDING
8.1 Client agrees to comply with Reuters requirements for displaying copyright notices, disclaimers and branding as set out on the Reuters Media Branding site: http://about.reuters.com/media/brandguide from time to time. This may include branding required by Third Party Providers.
8.2 Except as specifically authorized in this clause 8, Client will not use the Reuters name or any Reuters trademarks without Reuters prior written consent. Client will not make any statement (whether oral or in writing) in any external advertising, marketing or promotion materials regarding Reuters or the Services without Reuters prior written consent. However, materials that are substantially identical to those previously approved need not be submitted for re-approval.
9. INTELLECTUAL PROPERTY
9.1 All rights with respect to the Services and Reuters name and trademarks, whether now existing or which may subsequently come into existence, which are not expressly granted to Client in this Agreement are reserved to Reuters Group. Any goodwill generated through Client’s use of the Reuters name and trademarks will inure solely to the Reuters Group.
9.2 Client will use commercially reasonable means to protect the security of the Reuters Content within the Client Service from unauthorised access, modification or distribution. Upon becoming aware of any breach in security, Client will take prompt action to remedy such breach to protect Reuters Content.
9.3 Client will promptly notify Reuters of any infringement or threatened infringement of any intellectual property rights of which Client becomes aware and will provide reasonable assistance to Reuters, at Reuters expense, in connection with such infringement.
10. CHARGES
10.1 Unless specified otherwise on the Order Form, all Charges (a) are payable from the first day of the calendar month following the month during which the Service is first made available to Client; (b) will be invoiced quarterly in advance; and (c) will be paid within 30 days of receipt of the invoice. In all cases, the amounts due under this Agreement will be paid by Client to Reuters in full without any withholding or right of set-off or deduction. A service charge of 1.5% per month or the highest lawful interest rate, whichever is lower, may be applied to all amounts not paid when due.
10.2 Notwithstanding the cancellation of any Service under this Agreement, Client agrees that all Charges for such Service will continue to be payable for the remainder of the calendar month in which cancellation takes effect.
10.3 In addition to the Charges, Client will pay to Reuters, or the relevant taxing authority as appropriate, all applicable taxes and duties (including, but not limited to, withholding tax) payable in respect of the Services, so that after payment of such taxes and duties the amount Reuters receives is not less than the Charges.
10.4 Reuters may once a year adjust or change the basis for calculating the Charges for each Service on not less than 3 months’ prior notice. Client may cancel any Service if we increase its Charges by more than 5%. If Client exercises this right to cancel, Client must notify Reuters within 30 days of the date of Reuters notice. The relevant Service will be cancelled from the date on which the Charges would have increased.
11. CONFIDENTIALITY
11.1 Each party, on its own behalf and as agent for its respective Groups (which, for the purposes of this clause 11, includes its respective advisers, agents and representatives), agrees: (a) to hold the Confidential Information in confidence and, not without the Disclosing Party’s prior written consent, to disclose any part of it, to any person other than those directly concerned with the parties’ dealings with each other and whose knowledge of such Confidential Information is essential for such dealings. The Receiving Party will ensure that those persons comply with the obligations imposed on the receiving party under this clause. The Receiving Party is liable for such person’s default; (b) not, without the disclosing party’s prior written consent, to use the Confidential Information for any purpose other than for its dealings with the other party (c) to delete for any device containing any Confidential Information and/or return to the disclosing party upon demand and termination of the Agreement, the Confidential Information except for one copy of such Confidential Information as is required to be retained by law, regulation, professional standards or reasonable business practice by a member of the Receiving Party’s Group; and (d) to use reasonable endeavours to provide the Disclosing Party with prompt notice if any member of the Receiving Party’s Group becomes legally compelled to disclose any of the Confidential Information, so that the Disclosing Party may seek a protective order or other appropriate remedy. If such order or remedy is not available in time, the obligation of confidentiality will be waived to the extent necessary to comply with the law.
11.2 The obligation of confidentiality does not apply to information which: (a) is, at the time of the disclosure, or subsequently through no act or omission of the Receiving Party’s Group, becomes generally available to the public; (b) becomes rightfully known to the Receiving Party’s Group through a third party with no obligation of confidentiality; (c) the Receiving Party is able to prove was lawfully in the possession of the Receiving Party’s Group prior to such disclosure; or (d) is independently developed by the Receiving Party’s Group.
11.3 This undertaking is binding for as long as such Confidential Information retains commercial value.
12. WARRANTY
12.1 Reuters warrants that it will provide the Services with reasonable care and skill.
13. LIABILITY
13.1 To the extent permitted by law, and except as expressly stated in the Agreement, all terms, conditions, warranties, representations, or undertakings expressed or implied by law or otherwise in relation to the Services, Content and/or Equipment are excluded.
13.2 Reuters aggregate liability to Client, and Client’s aggregate liability to Reuters, for loss, damage or costs under or in relation to the Agreement (whether in negligence, breach of contract, misrepresentation or for any other reason) in any calendar year shall not exceed the total Charges payable in respect of that calendar year. This limit on liability does not apply to:
a) either party’s liability to the other for negligence causing death or personal injury;
b) Reuters liability under clause 14.1;
c) Client’s liability under clauses 3, 8 and 14.2 of this Agreement; and
d) liability of either party for fraud, fraudulent misrepresentation or deceit
for which liability shall be unlimited.
13.3 Neither Reuters, nor any member of the Reuters Group shall be liable for any loss or damage suffered or incurred by Client or any third person arising (whether in negligence, breach of contract, misrepresentation or for any other reason) out of any faults, interruptions or delays in the Services and any inaccuracies, errors or omissions in Reuters Content.
13.4 UNDER NO CIRCUMSTANCES WILL EITHER PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES WITH RESPECT TO THE SUBJECT MATTER OF THE AGREEMENT, LOSS OF DATA OR LOST PROFITS, REGARDLESS OF WHETHER OR NOT SUCH DAMAGES COULD HAVE BEEN FORESEEN OR PREVENTED. .
13.5 Neither party shall be liable for any loss or failure to perform its obligations under this Agreement (except payment obligation of Client where Client is still receiving Reuters Services) due to circumstances of Force Majeure. If such circumstances continue for more than 3 months, either party may cancel any affected Service immediately on notice.
13.6 Nothing in this Agreement affects your rights which cannot validly be excluded or modified by any applicable law.
14. INDEMNITIES
14.1 Reuters agrees (subject to clauses 13.4, 14.2, and 14.3) to indemnify Client against any direct loss or cost (including, but not limited to, reasonable legal fees and costs of investigation) it incurs arising out of any claims by a third party that the Reuters Content infringes any third party’s intellectual property rights, provided that:
a) the relevant claim does not arise from any modification to the Reuters Content made by Client or any person receiving the Reuters Content through Client;
b) the relevant claim does not concern Reuters Content that Reuters notified Client should not be used;
c) if the relevant claim is based upon Content obtained by Reuters from a Third Party Provider, this indemnity may be limited by the amount Reuters recovers from such third party in proportion to other claims (actual or potential) arising out of the alleged infringement); and
d) the relevant claim does not arise as a result of a breach by Client of clause 3.
14.2 Client will indemnify Reuters (subject to clauses 13.4 and 14.3) against any direct loss or cost (including, but not limited to, reasonable legal fees and costs of investigation) it incurs arising out of any claim by a third party relating to or arising out of the Client Service or any other activities of Client directly or indirectly related to use of Reuters Content (including, but not limited to, infringement of any third person’s intellectual property rights), unless and to the extent such claim arose out of Client’s use of any Reuters Content as provided to Client and in accordance with the terms of the Agreement.
14.3 Any obligation under the Agreement to indemnify arises only if: (a) the indemnifying party is given immediate and complete control of the indemnified claim and (b) the indemnified party co-operates at the expense of the indemnifying party and does not materially prejudice the conduct of such claim.
15. TERMINATION
15.1 Reuters or Client may terminate this Agreement as set out in clause 1.2.
15.2 On the effective date of cancellation or termination for any reason under this Agreement, (a) Client’s access to and rights to use the Service(s) will cease; (b) subject to clause 4, Client must erase or destroy any Reuters Content and Software; and (c) pay all Charges which are due up to then.
15.3 Reuters may terminate this Agreement in whole or as it relates to one or more Services immediately if: (a) Client materially breaches any of its obligations under it and, if the breach is capable of remedy, fails to remedy such breach within: (i) 5 days for any breach of clauses 3 or 8; or (ii) 30 days of written request in all other cases ; (b) the relevant Service becomes the subject of a claim of infringement of the rights of any third party; (c) the relevant Service becomes illegal or contrary to any applicable rule, regulation, guideline or request of any regulatory authority; (d) an agreement between a Reuters Group member and a third party that is necessary to provide the Service is modified or terminated for any reason or breached by the third party; or (e) Reuters discontinues the Service (or any part) as a product offering in any category of media in which case Reuters will give Client not less than 90 days advance notice.
15.4 If Client materially breaches this Agreement, Reuters may, upon giving Client notice, immediately suspend the Services and Client’s rights granted in relation to them in whole or in part without penalty until the breach is remedied.
15.5 Reuters or Client may terminate the Agreement immediately and without notice if: (a) the other enters into a composition with its creditors; (b) an order is made for the winding up of the other; (c) an effective resolution is passed for the winding up of the other (other than for the purposes of amalgamation or reconstruction) or (d) the other has a receiver, manager, administrative receiver or administrator appointed in respect of it.
15.6 If, due to any reason within Reuters control, there is an interruption in the Services which continues for 5 days following written notice to Reuters of such interruption, Client may terminate this Agreement immediately, in which case Reuters only obligation to Client will be to refund, pro rata, any unused Charges paid in advance.
15.7 If Client cancels all or any part of a Service other than when permitted by the Agreement and/or Reuters terminates this Agreement due to any breach by Client, Reuters will be entitled to recover from Client, as liquidated damages, 75% of the Charges that would have been payable until the date the relevant Service could have been cancelled in accordance with this Agreement. The parties agree that this is a reasonable pre-estimate of Reuters loss.
15.8 Termination will not affect either party’s respective accrued rights or obligations.
16. GENERAL
16.1 All notices under the Agreement must be in writing and sent by registered mail, courier, fax or email or delivered in person to the following addresses for notices:
To Reuters: See Contact Person on the Order Form
To Client: See Contact Person on Order Form
However, each party will only send notices relating to breach or termination of the Agreement by registered mail, courier, fax or delivered in person. Notices will be deemed to be received 3 business days after being sent or on proof of delivery, if earlier.
16.2 Neither party may transfer any right or obligation of this Agreement without the prior written consent of the other. This consent may not be unreasonably withheld or delayed. However, either party may, on notice, transfer any of its respective rights or obligations to a member of its respective Group as long as such entity has sufficient assets to meet its obligations under the Agreement and, in Client’s case, does not require Reuters to provide the Services other than to the Installation Address.
16.3 This Agreement shall be governed by and construed in accordance with the law set out in the Order Form. Both parties submit to the nonexclusive jurisdiction of the courts specified in the Order Form.
16.4 If any part of this Agreement that is not fundamental is found to be illegal or unenforceable, this will not affect the validity and enforceability of the remainder of the Agreement.
16.5 If either party delays or fails to exercise any right or remedy under the Agreement, that party will not have waived that right or remedy or any other right or remedy on any other occasion.
16.6 This Agreement contains Reuters and Client’s entire understanding regarding its subject matter and supersedes all proposals and other representations, statements, negotiations and undertakings in each case, verbal or written, relating to the same.
16.7 In entering into this Agreement, Client has not relied on, and has no remedy in respect of, any statement, warranty or representation (except in the case of fraud) made by Reuters other than those set out in this Agreement.
16.8 This Agreement may not be amended, modified or superseded, unless expressly agreed to in writing by both parties.

يُرجى من العميل قراءة البنود المذكورة أدناه بعناية قبل التوقيع على استمارة طلب تقديم الخدمة حيث إن هذه البنود ستكون ملزمة قانونًا عندما تُرسل وكالة رويترز للعميل استمارة طلب موقعة، وننصح العميل بطباعة العقد وحفظ نسخة ورقية من هذه البنود.
في حالة وجود بند لم يتم تعريفه أدناه يتم تعريفه حسب ما هو محدد في استمارة الطلب المعمول بها.

النشر الآلي – هو النشر الآلي لمحتوى رويترز كما هو في خدمة التي يقدمها العميل دون أن يتدخل أي شخص بالكتابة فيه.

غرفة أخبار العميل – عمليات التحرير التي يقوم بها صحفيون محترفون من جمع الأخبار وتحريرها وبرمجتها ويعملون لدى العميل بدوام كامل أو جزئي حتى يستطيع العميل تقديم الخدمة.
الخدمة التي يقدمها العميل – ما يقدمه العميل من منشورات وبرامج وخدمات واستخدامات المواقع الإلكترونية الخاصة به ومنقولاته والمنصوص عليها في استمارة الطلب المستخدمة والتي تكفل للعميل حقوق معينة في استخدام محتوى رويترز بموجب هذا العقد.
المعلومات السرية – هي المعلومات، بأي صورة كانت (بما في ذلك، دون قصر، النماذج والبرامج ومخرجات الكمبيوتر)، التي لم تستبعدها المادة 11,2، سواء كانت مكتوبة أو شفهية، وذات طبيعة مالية أو فنية أو كانت مميزة أو تم الإشارة إليها على أنها مميزة أو أن تكون مميزة عقليًا أو معروف أنها سرية والتي يقولها أي طرف للغير أو أي من أعضاء مجموعته عند تعاملهما معًا.

التحكم – هو سلطة توجيه أو التسبب في توجيه سياسات إدارة كيان آخر سواء عن طريق امتلاك الأوراق المالية لهذا الكيان أو التعاقد أو غير ذلك.
وسائل الإعلام الرقمية – هي وسائل الإعلام على الإنترنت أو الأجهزة المحمولة وأي من وسائط التخزين الرقمية المادية أو أية وسيلة إعلان إلكترونية يمكنها استقبال المحتوى فيما عدا التلفزيون والراديو العادي.
حدود النشر الرقمي – هو عدد عناصر محتوى رويترز الذي يجوز نشره عبر وسائل الإعلام الرقمية للخدمة التي يقدمها العميل يوميًا كما هو مبين في استمارة الطلب ذات الصلة.
الحقوق الرقمية – هي الحق في إنتاج ونشر محتوى رويترز في الخدمة التي يقدمها العميل عبر وسائل الإعلام على الإنترنت والأجهزة المحمولة.
التحرير – هو التحرير، والتطويع، والتحرير الجزئي، والدبلجة واستكمال أي محتوى وترجمة أي جزء من نص مكتوب أو مسموع لأى محتوى عن طريق الأشخاص.
المعدات – هي الأجهزة والبرمجيات أو أحدهما والوثائق ذات الصلة التي يوفرها عدد من أعضاء مجموعة رويترز والمدرجة في استمارة الطلب المستخدمة.
الخلاصة – هي أي ملخص لمحتوى رويترز بما في ذلك، على سبيل المثال وليس الحصر، أي تقرير منفصل أو خبر أو نص مكتوب وأي مقطع مسموع أو مرئي أو صورة غير متحركة (وتشمل – على سبيل المثال وليس الحصر – الصور والرسوم).
خدمة الاستعلامات المالية – هي أي خدمة تتضمن إمكانية الوصول للبيانات أو غيرها من المعلومات المالية عن طريق المنتج النهائي لرويترز وما هو محدد في استمارة الطلب على أنه ضمن خدمة الاستعلامات المالية

المجموعة – بالنسبة لرويترز تكون مجموعة رويترز وبالنسبة للعميل هي الشركات القابضة الخاصة به والشركات التابعة لها.
المُضيف – هو الغير الذي يقوم باستضافة الخدمات التي يقدمها العميل والحفاظ عليها أو يقوم بنشر محتوى رويترز.
العنوان الثابت – أي عنوان للعميل (أو مُضيف العميل) الذي تقدم له رويترز الخدمات مباشرة أو تنزل له الخدمات أو المكان الذي يمكن منه الوصول للخدمات كما هو محدد في استمارة الطلب.
النشر اليدوي – هو أي نشر لمحتوى رويترز من خلال الخدمة التي يقدمها العميل، كما هي أو حسب المصدر مع بعض التغييرات التي تقوم بها غرفة أخبار العميل.
وسائل الإعلام – هي أية وسيلة إعلام يقدم بها العميل خدماته وفق ما هو محدد في استمارة الطلب.
المدة الأولية - هي المدة الزمنية الأولية المحددة في استمارة الطلب ذات الصلة مقابل خدمة معينة.
الأجهزة المحمولة – أي جهاز محمول يستخدم تكنولوجيا لاسلكية وتشمل، على سبيل المثال وليس الحصر، الهاتف الخلوي والمساعد الرقمي الشخصي وأجهزة النداء الآلي التي يستخدمها الأفراد لاستقبال محتوى عبر استخدام منصة مخصصة للأجهزة المحمولة أو عبر شبكة الإنترنت.
وسائل إعلام الإنترنت – أي موقع على الإنترنت أو خدمة تقدم من خلاله.
استمارة الطلب – أي نموذج طلب عادي لرويترز ينص على الخدمات التي يطلبها العميل وتقبل رويترز تنفيذها.
خدمة الصور – هي الخدمة التي تتكون من محتوى به صور ورسوم وتحددها استمارة الطلب (أو حسب ما تحدده رويترز للعميل على أنها) خدمة صور.

الشركة التابعة – هي الشركة التي تمتلك فيها شركة أخرى، سواء بطريقة مباشرة أو غير مباشرة، أكثر من 50% من رأس المال الصادر أو لها حقوق مساوية وتمارس عليها سيطرة فعلية.
الدعم – بذل جهد معقول للحفاظ على المعدات والبرمجيات والخدمات أو أي منها في حالة جيدة للتشغيل، وتوفير التعديلات لتعزيز الخدمة، وعند الحاجة، تركيب المعدات والتخلص منها أو وضعها في مكان آخر حسب نص العقد.
المدة الزمنية – المدة الزمنية الأولية بالإضافة إلى أية فترات تجديد أخرى والتي يشترك العميل خلالها في الخدمات ذات الصلة بموجب هذا العقد.
الإقليم – هو الموقع الجغرافي (إن وجد) المحدد في استمارة الطلب والتي ينشر فيها العميل خدماته.
الخدمات النصية – الخدمات التي تتكون من محتوى نصي والمنصوص عليه في استمارة طلب خدمات وسائل إعلام رويترز - تعتبر خدمات النصوص والصور والاستعداد للنشر وأي من الخدمات الأخرى التي تخطر بها رويترز العميل من آن لآخر خدمات نصية.
الخدمات المرئية – خدمة أخبار العالم (أو أي خدمة بديلة لها) وتتكون من محتوى فيديو (مصحوبة بمعلومات النص المكتوب) وخدمة مكتبة سطح المكتب وأي خدمات أخرى تنص عليها استمارة الطلب (او التي تخطر بها رويترز العميل) هي خدمة مرئية.
الشبكة المصغرة – هي تطبيق أو مُكون شبكي يمكن مشاركته ويمكن أن يتضمنه سطح مكتب الكومبيوتر أو صفحة على الإنترنت لعرض المحتوى الذي تم تحديثه ديناميكيًا مثل عناوين الأخبار.
1- النطاق والبداية والمدة الزمنية للعقد
1,1 لأسباب تنظيمية أو أسباب أخرى، يقدم عضو آخر بمجموعة رويترز بعض الخدمات، وتكون حقوق العميل والتزاماته بالنسبة لهذه الخدمات مع عضو مجموعة رويترز المنصوص عليه في استمارة الطلب المستخدمة عند تقديم الخدمة المذكورة، ويُفسر معنى "رويترز" وفقًا لهذا.
1,2 يكون هذا العقد ساريًا وفعالًا ما كانت استمارة الطلب فعالة وما لم تنص استمارة الطلب على غير ذلك بعد انقضاء المدة الأولية أو الفترات التي تم تجديدها، وتتجدد استمارة الطلب تلقائيًا لمدة (12) شهرا جديدة ما لم يقدم أي من الطرفين إخطارًا بإنهاء الخدمة قبل نهايته بتسعين (90) يومًا من الفترة الحالية.
2- الخدمات التي تقدمها رويترز
2,1 توفر رويترز الخدمات للعميل أو تقوم بتوصيلها إليه في عنوانه الثابت، ويدفع العميل في المقابل الرسوم ويقوم وحده باستغلال الخدمات وفق شروط هذا العقد.
2,2 وافق العميل على ما يلي: (أ) عدم استخدام هذه الخدمات بما يخالف القوانين واللوائح، (ب) مسئوليته عن الحصول على جميع التراخيص المطلوبة والحفاظ عليها وكذلك الموافقة على استقبال واستخدام الخدمات وعمل أي تسجيلات ضرورية للخدمة التي يقدمها العميل مثل الحصول على موافقة هيئة الإذاعة والاتصالات السلكية واللاسلكية والسلطات الحكومية والتنظيمية الأخرى، (ج) ضمان أن كلمات السر المستخدمة للدخول إلى الخدمات سرية ولا يعرفها أحد غيره، وعليه أن يخبر رويترز فورًا إن علم كلمة السر شخص غير مخول بالدخول للخدمة ذات الصلة، (د) أن يقوم موظفوه بملء أية استمارات وموافقات أو أيهما تراها رويترز ضرورية بشكل معقول لتتوافق مع الالتزامات القانونية المتعلقة باستخدام وتخزين ونقل رويترز للبيانات الشخصية للموظفين المطلوبة في سياق قيام مجموعة رويترز بعملياتها، (هـ) إعلام المستخدم النهائي المتلقي لخدمات العميل أن محتوى رويترز هو فقط من أجل الاستخدام الشخصي غير التجاري.
3- استخدام محتوى رويترز
3,1 الشروط العامة التي تسري على جميع الخدمات
3.1.1 تمنح رويترز العميل أثناء المدة المتفق عليها وبموجب هذا العقد حق الاستخدام غير الحصري وغير القابل للنقل أو عمل ترخيص من الباطن لمحتوى رويترز كما هو و كمصدر، ويستخدمه العميل فقط ويدمجه في الخدمات التي يقدمها وينشرها عبر وسائل الإعلام في إقليمه وطبع نسخ داخلية حسب الحاجة حتى يمكنه استخدام المحتوى.
3.1.2 يجب على العميل الالتزام برموز تأخير التحرير الملزمة في محتوى رويترز والالتزام بأية حدود وقواعد أخرى معقولة وضعتها رويترز، أو الغير الذي يقوم بتقديم المحتوى و/أو المحكمة أو السلطة المختصة عند استخدام أو عرض أو نشر محتوى رويترز بما في ذلك – على سبيل المثال وليس الحصر – القيود المحددة في البرامج النصية بخدمات الفيديو أو ضرورة وجود ترخيص منفصل من الغير مقدم الخدمة، وتقوم رويترز بإخبار العميل بالمعنى المقصود بهذه الرموز.
2,1,3 لدى رويترز الحرية الكاملة في كتابة شكل ومضمون محتوى رويترز والذي يجوز أن يتغير من وقت لآخر، ويجوز أن تتضمن هذه التغييرات – على سبيل المثال وليس الحصر – سحب عناصر وتصحيح في المحتوى المنشور. يوافق العميل على اتخاذ إجراءات فورية كرد على التصحيح أو السحب الصادرة من خلال الخدمات المقدمة كما وافق العميل على بذل كل جهد ممكن لدمج النسخة الحديثة بعد تصحيحها في الخدمات التي يقدمها، ويقوم في حالة السحب بالحذف الفوري قدر الإمكان لهذه العناصر من الخدمة التي يقدمها بما في ذلك حذفها من السجلات إن أمكن.
3.1.4 باستثناء استخدام العمل لمحتوى رويترز في إعداد التقارير عن الأخبار الجارية، يكون العميل مسئول مسئولية كاملة عن الحصول – على نفقته الخاصة – على التصاريح اللازمة للغير والمتعلقة بأي جزء أو عنصر من عناصر المحتوى يمكن أن يكون محميا بموجب حقوق الملكية أو حقوق المؤلف أو حقوق الجوار (على سبيل المثال وليس الحصر الحقوق المعنوية وحقوق بث الموسيقى) أو حقوق الخصوصية التي تسبق استخدام العميل للمحتوى بما في ذلك – على سبيل المثال وليس الحصر - (أ) الحصول على تصريح ممن تظهر أسماؤهم أو بورتريه لهم أو صور أو يؤدون دورا بالمحتوى، و (ب) الحصول على التصريحات الخاصة بالأعمال الموسيقية والتسجيلات الصوتية والمباني والأعمال الفنية والتصميمات والمعالم الأثرية العامة والأشياء والتي يضمها المحتوى.
3,1,5 يحظر على العميل استخدام المنشورات الآلية لمحتوى رويترز وفق نص المادة 3,5,2 من العقد.
3,1,6 يجوز للعميل تضمين مقتبسات نصية أو فيديو أو صورة و/أو خدمات الاستعداد للنشر في الخدمات التي يقدمها وفي المواد البحثية النصية (بما في ذلك البرامج النصية) التي أعدها العميل بقصد واحد وهو إنتاج الخدمة التي يقدمها.
3,1,7 وفقًا لنص المادة 3,4,1 يجوز للعميل كتابة ملخص بغرض دمجه في الخدمة التي يقدمها شريطة ألا يتشوه المعنى في هذا الملخص ولا يعرض الملخص المذكور أو أي جزء منه للازدراء أو التشهير. وإذا انتهك العميل هذه المادة فسوف يقوم بنشر أو بث (حسب الحالة) تراجع عن الخبر بالشكل والطريقة التي تحددها رويترز، في حدود المعقول وبما يتماشى مع الممارسات المحلية، من خلال الخدمات التي يقدمها العميل وذلك دون وضع قيود على حقوق رويترز الأخرى.
3,1,8 عند قيام العميل بترجمة جزء كبير (مع الوضع في الاعتبار الجودة والكمية) من مقتطفات من اللغة الأصلية يجب أن يذكر أن هذا الجزء مترجم.
3,1,9 يجوز للعميل السماح لمستخدمي خدماته إرسال محتوى رويترز عبر البريد الإلكتروني أو طباعته أو مشاركته على ألا يكون ذلك لأغراض تجارية ويكون للاستخدام الفردي في الأساس وبما يتفق مع المادة 8 (على سبيل المثال أيقونات "أرسل الخبر عبر الإيميل لصديق" أو "اطبع الخبر" أو "المشاركة").
3,1,10 عندما يكون دخول العميل إلى محتوى رويترز محمي بكلمة سر يجب أن يسمح العميل لرويترز الدخول للخدمات التي يقدمها مجانًا لتتأكد من التزام العميل ببنود هذا العقد.
3,1,11 لا يجوز للعميل عرض اسم أو شعار أو علامة تجارية أو أي شيء يحدد هوية الغير ليعطي للمشاهد انطباع أن هذا الغير هو ناشر محتوى رويترز أو مشترك فيه وذلك في أي صفحة تضم محتوى رويترز، ولا يمنع هذا وجود الإعلانات التقليدية أو وجود راعي والتي لا تخلق مثل هذا الانطباع.
3,1,12 لا يجوز للعميل استخدام إعلانات أو راعي ذي صلة بمحتوى رويترز والذي: (أ) ينتهك القوانين واللوائح حيث يتم استعراض الخدمة التي يقدمها العميل، (ب) الادعاء الضمني أن المُعلن أو الراعي له علاقة برويترز أو محتواها.
3,1,13 يجب على العميل – بناءً على طلب رويترز- تقديم أرقام التوزيع أو المشاهدين بالنسبة لما ينشره من محتوى رويترز وعلى رويترز اعتبار هذه المعلومات سرية.
3,1,14 تمنح رويترز العميل ترخيصا غير حصري وغير قابل للنقل وفردي باستخدام رموز أدوات رويترز طوال مدة العقد بغرض الدخول لمحتوى خدمات رويترز وتحديده شريطة أنه يجوز نشر رموز أدوات رويترز مع المحتوى الأساسي (أي يجوز للعميل عرض رموز أدوات رويترز على أنها من محددات المحتوى).
3,1,15 يضمن العميل التزام أي مُضيف بهذا الاتفاق ويوافق العميل على أن أي انتهاك يرتكبه المُضيف يتم التعامل معه على أنه انتهاك من العميل.
3.2 شروط إضافية تسري على خدمات الفيديو
3,2,1 لا يجوز للعميل اقتطاع (بشكل جزئي أو كلي) ملخص من خدمة الفيديو ودمجه في الخدمات التي يقدمها من أجل إعادة عرضها او السماح لشخص ما باستخدامها لم تخوله رويترز بأي شكل من الأشكال بذلك، وإذا أضاف العميل صوتا لمحتوى رويترز عليه الإقرار بأنه مصدر الصوت المضاف.
3,2,2 بينما يوافق العميل على تزويد رويترز بالمحتوى المساهم به خلال مدة العقد فإنه يمنح رويترز حقا دائما وبدون رسوم وغير حصري وغير قابل للنقل أو عمل تصريح من الباطن بتضمين ونشر المحتوى المساهم به المذكور في أي خدمة تقدمها مجموعة رويترز لعملائها بشرط: (1) أن تعرف رويترز بكل وضوح أن العميل هو مقدم المحتوى المساهم به، (2) أن تتحمل رويترز أية تكاليف تتعلق بتوصيل المحتوى المساهم به لرويترز، (3) لن يقدم العميل أي محتوى مساهم به ينتهك أي من القوانين واللوائح ولن تستخدم رويترز هذا المحتوى، (4) تفحص رويترز أية شروط معقولة يخطرها بها العميل تتعلق بالمحتوى المساهم به والالتزامات التي تفرضها أي محكمة أو سلطة مختصة.
3,2,3 يجب على العميل الاحتفاظ بسجلات حديثة ودقيقة للأشرطة والوسائل الإعلامية الأخرى حسب الحاجة ويتم تخزين محتوى رويترز فيها ويتحدد التاريخ والخبر والعنوان ومصدر كل شريط (أو أي وسيط آخر) وفق ما هو محدد في المعلومات النصية ذات الصلة، ويقدم العميل نسخة من هذه السجلات لرويترز عند طلبها.
3,3 شروط إضافية تسري على خدمات المعلومات المالية
3,3,1 يستخدم العميل المحتوى المأخوذ من خدمة المعلومات المالية لأغراض المعلومات الداخلية فقط ولا يجوز للعميل نشر هذه المعلومات أو تقديمها لأي شخص (أ) فيما عدا الموظفين المحددين والمخولين بالدخول إلى المحتوى المذكور أو استرجاعه من الأجهزة أو المنافذ المبينة في استمارة الطلب أو أية إضافات، (ب) فيما عدا هذا يجوز للعميل توزيع مقتطفات محدودة بطريقة غير ممنهجة على أنها جزء من محتوى المصدر الذي أنشأه العميل ضمن الخدمة التي يقدمها.
3,3,2 يوافق العميل على الالتزام بأي قيود وشروط مفروضة على الاستخدام والدخول والتخزين والتوزيع المسموح به وإعادة توزيع المحتوى المأخوذ من خدمة المعلومات المالية من قبل الغير مقدم الخدمة وتزويد رويترز بنسخ من كل التراخيص المطلوبة عند طلب رويترز ذلك بالقدر المعقول، وعلى رويترز والغير مقدم الخدمة إخطار العميل بهذا، كما يوافق العميل على الدخول في اتفاق منفصل مع رويترز أو أي مقدم خدمة آخر عند اللزوم.
3,4 شروط أخرى تسري على خدمة الاستعداد للنشر
3.4,1 لا يجوز للعميل تعديل محتوى فيديو من خدمة الاستعداد للنشر فيما عدا التعديل بسبب الطول فقط.
3,5 شروط إضافية تسري عند توزيع محتوى رويترز عبر الوسائط الرقمية
3,5,1 يجوز للعميل توزيع محتوى رويترز عبر وسائط رقمية عند منح استمارة الطلب المعنية واحد أو أكثر من حقوق الوسائط الرقمية مع مراعاة ما يلي: (أ) أن يؤكد العميل ويعلن أن السوق الأولية المستهدفة لنسخة الوسائط الرقمية للخدمة التي يقدمها العميل هي السوق الإقليمية (ب) لا يجوز للعميل تضمين أي محتوى في نسخة الوسائط الرقمية تراه رويترز على أنه يخضع لقيود وأن الاستخدام المقصود والتوزيع يخالف هذه القيود بما في ذلك – على سبيل المثال وليس الحصر – أي حظر لاستخدام الهاتف المحمول أو أية قيود جغرافية، (ج) يجب عرض أي صور تتضمنها نسخة الوسيط الرقمي للخدمة التي يقدمها العميل بطريقة تحاكي الفيديو.
3,5,2 باستخدام النشر الآلي، يجوز للعميل عبر الوسيط الرقمي ذي الصلة توزيع (أ) خدمة الاستعداد للنشر بدون قيود على عدد العناصر التي يتم توزيعها (شريطة أن يلتزم العميل بجميع القيود المفروضة على أي فيديو) و (ب) يخضع محتوى رويترز في الخدمات النصية وخدمات الصور لحدود النشر الرقمي المنصوص عليه في استمارة الطلب ذي الصلة.
3,5,3 باستخدام النشر اليدوي، يجوز للعميل عبر الوسيط الرقمي ذي الصلة محتوى رويترز من الخدمات النصية وخدمات الصور والفيديو والاستعداد للنشر عبر الوسائط الرقمية ذات الصلة وتخضع في حالة خدمات الصور لأي من حدود النشر الرقمي المحددة في استمارة الطلب ذات الصلة.
3,5,4 يجب على العميل، فيما يتعلق بأي خدمة، عدم السماح لأي مواقع أخرى أو أي خدمات على الإنترنت أو تُقدم بأي طريقة أخرى أو جذبهم أو تشجيعهم (وفقا لمدى تأثيره) على صياغة أو تقديم محتوى رويترز في خدمة العميل بأي طريقة، ولا يجوز للعميل، بالقدر الممكن تكنولوجيًا ومعقول تجاريًا، السماح للغير بصياغة خدمة العميل المذكورة في محتوى رويترز وظهوره على نفس الشاشة مثل الخدمة التي يقدمها الغير، وعند حدوث هذا يوافق العميل على التعاون مع رويترز في جعل الغير يتوقف عن هذه الصياغة والكف عنها.
3,5,5 فيما يتعلق بأي خدمة أو الخدمة التي يقدمها العميل والتي تتألف من محتوى رويترز حصريًا، لا يجوز للعميل الانضمام لتغذية RSS وأدوات الشبكة الخاصة بالغير والتي تعود إلى محتوى رويترز في خدمة العميل، وفيما عدا هذا يجوز للعميل توزيع العناوين الرئيسية والملخصات النصية القصيرة أو الصور المصغرة لعناصر محتوى رويترز (إعلانات) الموجودة في خدمة العميل في النشرات البريدية وتغذية RSS وأدوات الشبكة المتاحة للأفراد المستخدمين ل خدمة العميل شريطة أن يخبر العميل المستخدم النهائي أن محتوى رويترز يستخدم للأغراض الشخصية فقط وليس التجارية وتكون هذه الإعلانات رابطا يعود بالمستخدم إلى عناصر محتوى رويترز في خدمة العميل.
3,5,6 يُدمج أي عنصر في محتوى رويترز كما هو أو كمصدر في الخدمة التي يقدمها العميل وينشرها عبر الوسائط الرقمية أو موقع إلكتروني للغير ويجوز عرضها في الخدمة التي يقدمها العميل خلال مدة هذا الاتفاق.
3.5.7 بموجب ما سبق أو أية شروط أخرى إذا أُعيدُ إنتاج محتوى رويترز أو نشر في الوسائط الاجتماعية أو مواقع إلكترونية أخرى يمتلكها الغير وسعى هذا الغير إلى استغلال حقوقه المزعومة في محتوى رويترز بما يناقض شروط هذا العقد، يجب على العميل حينئذ حذف المحتوى المتضرر من الموقع الإلكتروني للغير.
4- تخزين المحتوى
4,1 ما لم يكن التخزين لفترة طويلة إلزام يفرضه القانون ولم تنص عليه استمارة الطلب ذات الصلة، يجوز للعميل تخزين محتوى رويترز كما يلي: أ) محتوى رويترز في الخدمات النصية وخدمات الصور والاستعداد للنشر واستخدامها لمدة 12 شهرا فقط، ب) يجوز تخزين محتوى رويترز في خدمات الفيديو حتى يقوم أحد الطرفين بفسخ العقد أو إنهائه شريطة استخدام محتوى رويترز المذكور في الخدمة التي يقدمها العميل لمدة 30 يومًا بعد استلامها من رويترز، ويجب على العميل الإعراب عن رغبته في استخدام أي عنصر من عناصر محتوى رويترز في خدمة الفيديو خلال 30 يومًا من استلام العنصر المذكور، وعلى العميل إرسال إخطار إلى مكتبة الفيديو في رويترز ودفع الرسوم المعتادة للمكتبة التي ستخطره عند الطلب.
4,2 يوافق العميل على حذف المحتوى المُخَزّن وغير المستخدم في نهاية مدة التخزين المحددة والمنصوص عليها في المادة 4,1 أعلاه، بما يعني، ودون مساس بالمادة 3,5,6، أن جميع ما سبق لا يجب أن يمس حقوق العميل في تخزين محتوى رويترز كما هو منصوص عليه في خدمة العميل.
4,3 لا تسري المادتان 4,1 و 4,2 على استخدام العميل لخدمة مكتبة سطح المكتب، وبدلا من هذا يجوز للعميل استخدام محتوى هذه الخدمة في خدمة العميل خلال المدة الزمنية للتعاقد، ولا يجوز للعميل تخزين أي من هذا المحتوى سوى في الوسيط الذي قدمت به الخدمة وعليه أن يُعيد هذا المحتوى لرويترز بعد فسخ أو انتهاء خدمة مكتبة سطح المكتب أو العقد.
5- البرمجيات (إن وجدت – انظر استمارة الطلب)
5,1 يمكن أن يتطلب استخدام العميل برمجيات معينة يمتلكها أو يمتلك ترخيصها الغير دخوله في اتفاق إضافي معه.
5,2 تمنح رويترز العميل أثناء فترة التعاقد حقا غير حصري وغير قابل للنقل باستخدام البرمجيات وحده في عنوانه الثابت لأغراض الدخول إلى محتوى رويترز ولا يجوز للعميل منح ترخيص من الباطن أو توكيل لأحد باستخدام هذه البرمجيات كما لا يجوز له نسخها (إلا بغرض عمل نسخة احتياطية) أو توزيعها أو تعديلها أو دمجها او نقلها أو تفكيكها أو استخدام الهندسة العكسية عليها إلا في المدى الذي تسمح به رويترز كتابةً أو المدى الذي يسمح به القانون المعمول به.
6- المعدات (إن وجدت – انظر استمارة الطلب)
6,1 تقوم رويترز أو من ترشحهم بتوفير و/أو تركيب المعدات في العنوان الثابت المشار إليه في استمارة الطلب حتى يستطيع العميل الدخول إلى محتوى رويترز، ويجور لرويترز في أي وقت خلال 30 يومًا من إرسال إخطار مكتوب (أو خلال فترة أقل أو بدون إرسال إخطار عند الضرورة المعقولة) استبدال المعدات بأخرى (والتي ستشكل جزءا من المعدات) أو استبدال وسائل نقل الخدمة بوسائل أخرى.
6,2 يقوم العميل – على نفقته الخاصة – بالحصول على جميع الموافقات على تركيب واستخدام المعدات ولا يجوز للعميل نقل المعدات من مكانها دون موافقة مسبقة من رويترز وتحت إشرافها، وغير مسموح للعميل تعريض هذه المعدات لإقامة دعاوى أو الحصول على امتيازات أو رهونات، ولا يجوز للعميل السماح لأي شخص ما عدا رويترز أو من ترشحهم بصيانة و/أو إصلاح المعدات، ويوفر العميل – على نفقته الخاصة – جميع الوصلات من نظم الحاسب الآلي له إلى المعدات وفقًا لمعايير الصناعة وهو وحده مسئول عن نقل وتوصيل محتوى رويترز من المعدات إلى نظام الحاسب الآلي له.
6,3 العميل مسئول عن أي خسارة أو أضرار تحدث للمعدات لأي سبب كان إلا إذا كان هذا الضرر يرجع إلى أي إجراء قامت به رويترز أو تقصير من جانبها.
6,4 يوافق العميل على أن يقوم، من وقت لآخر وعلى نفقته الخاصة، بتحديث المعدات للتوافق مع التعديلات التي تحدث للخدمة ووسائل الدخول لها.
7- الدعم
7,1 توفر رويترز أو من ترشحهم الدعم، وهي غير ملتزمة بتوفير الدعم المطلوب عند الأسباب التالية: أ) وقوع حادث أو إهمال أو إساءة استخدام لا يعود إلى رويترز، ب) وجود خطأ في بيئة التشغيل أو وجود أسباب أخرى غير التشغيل المعتاد، ج) محاولة موظف آخر غير موظفي رويترز أو من ترشحهم إصلاح أو تعديل أو نقل أو صيانة البرمجيات أو المعدات، د) عدم استخدام النسخ الحديثة سواء للبرمجيات أو المعدات مع توافرها للعميل، هـ) استخدام أجهزة وبرمجيات غير التي قدمتها رويترز، إذا قامت رويترز بتوفير الدعم مع وجود الأسباب السابق ذكرها يقوم العميل بدفع مقابل الوقت والمواد التي تستخدمها رويترز بأسعار رويترز حينئذ، وعلى العميل السماح لرويترز أو من ترشحهم دخول العنوان الثابت أو أي أماكن أخرى ممكنة في أي وقت مع إخطار مسبق بذلك من أجل تركيب أو فحص أو صيانة أو إصلاح أو استبدال أو إزالة كل البرمجيات والمعدات أو جزء منها.
8- الإشعار والائتمان والعلامة التجارية
8,1 يوافق العميل على الالتزام بشروط رويترز لعرض إشعارات حقوق النشر وإخلاء المسئولية والعلامة التجارية على النحو المبين في الموقع الإلكتروني للعلامة التجارية للوسائط الإعلامية لرويترز: http://about.reuters.com/media/brandguide من آن لآخر ويجوز أن يتضمن هذا العلامة التجارية للغير من مقدمي الخدمة.
8,2 باستثناء ما هو مسموح به في المادة 8، لا يجوز للعميل استخدام اسم رويترز أو أي من علامات رويترز التجارية دون موافقة خطية مسبقة من رويترز ولا يجوز للعميل الإدلاء بأية تصريحات (سواء شفهية أو مكتوبة) في أي إعلان خارجي أو تسويق أو ترويج مواد تتعلق برويترز أو الخدمات دون موافقة خطية مسبقة من رويترز، لا تحتاج المواد التي تتطابق إلى حد كبير مع ما تم الموافقة عليه من قبل إلى إعادة الموافقة عليها.
9- الملكية الفكرية
9,1 جميع الحقوق الخاصة بالخدمات واسم رويترز وعلاماتها التجارية سواء الموجودة حاليًا أو المستقبلية وغير الممنوحة صراحةً للعميل في هذا العقد محفوظة لمجموعة رويترز، ويرجع تقدير استخدام العميل اسم رويترز وعلاماتها التجارية بحسن نية إلى مجموعة رويترز فقط.
9,2 يجب على العميل استخدام وسائل تجارية معقولة لحماية تأمين محتوى رويترز في خدمة العميل من الدخول غير المصرح به أو إجراء تعديل أو توزيع له، وفي حالة معرفة العميل باختراق مجال الأمان عليه اتخاذ إجراءات فورية لمعالجة هذا الاختراق وحماية محتوى رويترز.
9.3 يقوم العميل بإخطار رويترز فور حدوث أي انتهاك أو تعدي يهدد حقوق الملكية الفكرية التي يعلمها العميل كما يقدم العميل يد المساعدة لرويترز – على نفقة رويترز الخاصة – بشأن هذه التعديات.
10 – الرسوم
10,1 تكون جميع الرسوم – ما لم تنص استمارة الطلب على خلاف هذا- : أ) مدفوعة من أول يوم في الشهر التالي لإتاحة الخدمات للعميل، ب) يتم إرسال فاتورة ربع سنوية مقدمًا، ج) ويتم الدفع خلال 30 يوما من استلام الفاتورة، ويدفع العميل المبالغ المستحقة بموجب هذا العقد بأي حال إلى رويترز كاملةً دون حجب او الحق في المقاصة أو الخصم، ويجوز تطبيق رسوم خدمة 1,5% كل شهر أو أعلى سعر قانوني للفائدة على جميع المبالغ التي لم تُدفع عند الاستحقاق.
10,2 على الرغم من إلغاء أي من الخدمات المقدمة بموجب هذا العقد، يوافق العميل على استمرار دفع رسوم أي خدمة تم إلغاؤها بموجب هذا العقد حتى نهاية الشهر الذي أُلغيت فيه.
10,3 يدفع العميل إلى رويترز أو هيئة الضرائب ذات الصلة جميع الضرائب والمستحقات (بما في ذلك – على سبيل المثال وليس الحصر- الضريبة المقتطعة) المستحقة عن تقديم الخدمات، بحيث لا تقل المبالغ التي تتلقاها رويترز بعد دفع الضرائب والمستحقات المذكورة عن الرسوم.
10,4 يجوز لرويترز تغيير الأساس الذي يجرى عليه حساب الرسوم مرة واحدة في العام لكل خدمة بحيث يسبق ذلك إشعار بمدة لا تقل عن 3 شهور، ويجوز للعميل إلغاء أي خدمة زادت رسومها عن 5% وفي حالة اختيار العميل إلغاء الخدمة يجب أن يخطر رويترز خلال 30 يوما من تاريخ إخطار رويترز له بالزيادة ويتم إلغاء الخدمة التي زادت رسومها من تاريخه.
11- السرية
11,1 وافق الطرفان بالأصالة عن نفسيهما وكوكيلين عن المجموعات التي يتبعانها (بالنسبة للمادة 11 تشمل المستشارين والوكلاء والممثلين المعنيين) على ما يلي: (أ) الاحتفاظ بالمعلومات السرية كأسرار لا يفصح عنها أي طرف أو عن أي جزء منها إلا بموافقة خطية من الطرف الآخر لأي شخص غير الأطراف المعنية بالمعاملات بين الطرفين ومن تكون معرفتهم بهذه المعلومات السرية ضروريا لهذه التعاملات، ويجب أن يضمن الطرف المتلقي أن هؤلاء الأشخاص ممتثلون للالتزامات التي تفرضها هذه المادة على المتلقي، ويكون الطرف المستلم مسئول عن تقصير هذا الشخص، (ب) ولا يحق لأي طرف الإفصاح عن المعلومات السرية إن لم يحصل على موافقة خطية من الطرف الآخر باستخدام المعلومات السرية لأي غرض سوى التعامل مع الطرف الآخر، (ج) لكي يتم إلغاء أي جهاز يحتوي على معلومات سرية والعودة للطرف الذي كشف الأسرار عند طلبها أو حدوث أيهما وعند انتهاء العقد تكون هذه المعلومات السرية مطلوبة بموجب القانون واللوائح والمعايير المهنية والأعمال التجارية المعقولة التي يمارسها عضو في مجموعة المتلقي، (د) بذل المساعي المعقولة لإخطار الطرف المفصح عن المعلومات السرية بأنه إن مجموعة الطرف المتلقي أصبحت مجبرة قانونيًا على الإفصاح عن أي معلومات سرية ويجوز للطرف المُفصح طلب أمر حماية أو القيام بأي إجراء قانوني آخر. إن لم تكن هذه الإجراءات القانونية متاحة حينئذ يسقط الالتزام بالسرية للحد الضروري للخضوع للقانون.
11,2 لا يسري الالتزام بالسرية على المعلومات التي: (أ) أصبحت وقت الإفصاح عنها أو عندما لم يتخذ الطرف المتلقي أي إجراء متاحة لعامة الجمهور، (ب) علم بها الطرف المتلقي من الغير الذي ليس لديه التزام بالسرية، (ج) يستطيع الطرف المتلقي إثبات أن هذه المعلومات كانت في حوزة مجموعة الطرف المتلقي قبل الإفصاح عنها، (د) طورتها مجموعة الطرف المتلقي بشكل مستقل.
11,3 يظل هذا التعهد ملزمًا طالما أن هذه المعلومات السرية تكتسب قيمة تجارية.
12 – الضمان
12,1 تضمن رويترز توفير الخدمات بالعناية والمهارة المعقولة.
13 – المسئولية
13.1 باستثناء ما ينص عليه العقد صراحة وفي حدود القانون يتم إلغاء جميع البنود والشروط والضمانات والتأكيدات والتعهدات الضمنية في القانون أو الصريحة أو غيرها مما يتصل بالخدمة والمحتوى والمعدات أو أي منها.
13.2 لا يجب أن يتخطى إجمالي المسئولية المالية لرويترز للعميل والعميل لرويترز سواء من أجل الخسارة أو الأضرار أو التكاليف بموجب هذا العقد (سواء كان بانتهاك العقد أو سوء التفسير أو أي سبب آخر) في أي سنة إجمالي الرسوم المدفوعة في هذا العام، وهذا الحد من المسئولية المالية لا يسري على:
أ) مسئولية أي من الطرفين تجاه الآخر عند الإهمال الذي يتسبب في موت أو جرح أحد الموظفين.
ب) مسئولية رويترز بموجب المادة 14,1.
ج) مسئولية العميل بموجب المادتين 3,8 و 14,2 من هذا العقد.
د) مسئولية أي طرف عن الغش أو الاحتيال بالكذب أو الخداع، حيث تكون المسئولية غير محدودة.
13,3 لا تكون رويترز أو أي عضو بمجموعة رويترز مسئول عن أي خسارة أو ضرر يلحق بالعميل أو الغير ينشأ عن (سواء إهمال أو انتهاك للعقد أو الخداع أو أي أسباب أخرى) وقوع أخطاء أو التوقف عن تقديم الخدمة أو تأخيرها أو عدم دقة محتوى رويترز أو وجود أخطاء أو حذف به.
13,4 لا يعتبر أي من الطرفين مسئولًا، تحت أي ظرف، عن أية أضرار غير مباشرة أو عرضية أو خاصة أو لاحقة تتعلق بموضوع العقد أو فقدان البيانات أو الخسارة المادية دون الوضع في الاعتبار إن كانت الأضرار المذكورة يمكن التنبؤ بها ومنعها.
13,5 لا يعد أي من الطرفين مسئولًا عن حدوث أي خسارة أو فشل في الوفاء بالتزاماته بموجب هذا العقد (فيما عدا التزام العميل بالدفع طالما أنه يستقبل خدمات رويترز) لظروف قهرية، وإن استمرت هذه الظروف لما يزيد عن 3 شهور يجوز لأي من الطرفين إلغاء أي خدمة تتأثر بهذه الظروف فورًا بإرسال إخطار.
13,6 لا يتضمن هذا العقد ما يؤثر على حقوقك التي لا يمكن قانونًا استبعادها أو تعديلها.
14. التعويضات
14.1 توافق رويترز (وفقاً للبنود 13.4، 14.2 و14.3) على دفع تعويض للعميل عن أية تكاليف أو خسائر مباشرة (تتضمن- على سبيل المثال وليس الحصر- الرسوم القانونية وتكلفة التحقيقات المعقولة) يتكبدها من جراء إقامة الغير دعوى بأن محتوى رويترز يمثل انتهاكًا لملكيته الفكرية، شريطة أن:
أ) تكون الدعوى غير ناشئة عن أية تعديلات لمحتوى رويترز قام بها عميل أو أي شخص آخر تلقى محتوى رويترز عبر العميل.
ب) تكون الدعوى المرفوعة لا تخص محتوى رويترز الذي أخطرت العميل بعدم استخدامه.
ج) إذا كانت الدعوى قائمة على محتوى حصلت عليه رويترز من الغير مقدم الخدمة ويتم تحديد التعويض بالمقدار الذي تستعيده رويترز من هذا الغير ويوزع كنسب على الدعاوى الأخرى (المقامة أو المحتملة) الناشئة عن نفس الانتهاك المزعوم.
د) ألا تكون الدعوى ناشئة نتيجة لخرق العميل للمادة 3.
14.2 يعوض العميل رويترز (بموجب المادتين 13.4و 14.3) عن أي تكاليف أو خسارة مباشرة (تتضمن- على سبيل المثال وليس الحصر- تكاليف التحقيق والرسوم القانونية المعقولة) تتحملها نتيجة الدعاوى التي رفعت عليها من الغير والمتعلقة أو القائمة على الخدمات التي يقدمها العميل أو أنشطة العميل الأخرى المتعلقة بطريقة مباشرة أو غير مباشرة باستخدام محتوى رويترز (تتضمن- على سبيل المثال وليس الحصر- التعدي على حقوق الملكية الفكرية للغير) إلا إذا كانت هذه الدعاوى غير ناشئة عن استخدام العميل لأي محتوى لرويترز وفق شروط هذا العقد.
14.3 أي التزام بموجب بنود التعويض ينشأ فقط عند: (أ) إعطاء الطرف المُعوِّض سلطة فورية وكاملة فيما يتعلق بدعوى التعويض، (ب) تعاون الطرف المعوَّض على نفقة الطرف المُعوِّض وعدم إخلاله ماديا بسير الدعوى.
15- انتهاء العقد
15.1 يجوز لرويترز والعميل فسخ العقد وفقاٌ للمادة 1.2.
15.2 عند حلول موعد إلغاء أو إنهاء العقد لأي سبب كان، ينتج عن ذلك ما يلي: (أ) يتوقف حق العميل عن الدخول وتتجمد حقوقه في استخدام الخدمة، (ب) بنص المادة 4، يجب على العميل حذف أو التخلص من أي محتوى لرويترز وبرمجياتها، (ج) ويدفع العميل كافة الرسوم المستحقة والواجبة الدفع حتى تاريخه.
15.3 يجوز لرويترز إنهاء العقد فورًا بالكامل أو لخدمة أو أكثر في حالة: (أ) انتهاك العميل ماديًا أي من التزاماته بموجب هذا العقد وإذا كان هذا الانتهاك قابلا للإصلاح وفشل في إصلاحه خلال: (1) 5 أيام لانتهاك أي من المادتين 3 أو 8، (2) 30 يوما في كافة الحالات الأخرى إذا كان طلبًا مكتوبًا، (ب) تحول الخدمات المعنية لموضوع دعوى انتهاك حقوق الغير، (ج) كون الخدمة المعنية غير قانونية أو تعارضت مع إحدى القواعد المطبقة أو اللوائح أو المبادئ التوجيهية أو بطلب لأي هيئة تنظيمية، (د) تعديل أو إنهاء العقد بين عضو مجموعة رويترز والغير اللازم لتوفير الخدمة لأي سبب أو انتهاكه من قبل الغير، أو (هـ) تُوقف رويترز تقديم الخدمة (أو أي جزء منها) كمنتج تعرضه في أي وسيلة من وسائل الإعلام تعطي فيها رويترز العميل إخطار مسبق لا يقل عن 90 يوما.
15,4 يجوز لرويترز عندما ينتهك العميل هذا العقد انتهاكًا ماديًا، بعد إخطاره، أن توقف خدماتها فورًا وكذلك حقوق العميل التي تمنحها له رويترز كليًا أو جزئيًا دون عقوبة حتى يتم التعامل مع هذه المخالفة.
15,5 يجوز لرويترز أو العميل فسخ العقد في الحال ودون إخطار في حالة: (أ) دخول الطرف الآخر في تسوية مع دائنيه، (ب) صدور أمر قضائي بإنهاء تعامل أحد الطرفين مع الآخر، (ج) تمرير قرار فعال لإنهاء التعامل مع الطرف الآخر (فيما عدا أغراض الدمج وإعادة التكوين)، (د) تعيين حارس قضائي، أو مدير أو حارس قضائي إداري، أو مسؤول لدى الطرف الآخر.
15,6 إذا انقطعت الخدمات، لأي سبب في نطاق سيطرة رويترز، لمدة 5 أيام بعد إرسال إخطار خطي يجوز للعميل إنهاء هذا العقد فورًا وفي هذه الحالة تلتزم رويترز بإعادة دفع الرسوم غير المستخدمة المدفوعة مقدمًا بصورة تناسبية.
15,7 إذا ألغى العميل جميع الخدمات أو جزء منها حسب ما هو مسموح به في العقد أو عند إنهاء رويترز للعقد بسبب أي انتهاك قام به العميل يكون لديها الحق في استعادة 75% من الرسوم المستحقة الدفع حتى تاريخ انتهاء الخدمة كتعويضات مقطوعة من العميل بموجب هذا العقد، كما يوافق الطرفان على أن هذا تقدير معقول لخسائر رويترز.
15,8 لا يؤثر إنهاء العقد على الحقوق والالتزامات المعنية للطرفين.
16- أمور عامة
16,1 يجب أن تكون جميع الإخطارات خطية بموجب هذا العقد ويتم إرسالها عبر البريد المسجل أو البريد السريع أو الفاكس أو البريد الإلكتروني أو يتم التسليم شخصيًا على العناوين التالية للإخطارات:

إلى العميل: انظر الشخص المسؤول في استمارة الطلب
يرسل كل طرف إخطارات خاصة بانتهاك أو إنهاء العقد عن طريق البريد المسجل أو البريد السريع أو الفاكس أو البريد الإلكتروني أو يتم التسليم شخصيًا، يتم اعتبار الإخطارات قد تم تسليمها بعد مرور 3 أيام عمل من الإرسال أو عند استلام تأكيد بالوصول إن حدث أولًا.
16,2 لا يجوز لأي من الطرفين نقل أي حق من الحقوق أو الالتزامات الخاصة بالعقد دون موافقة مسبقة من الطرف الآخر ولا يجوز حجب هذه الموافقة أو تأخيرها، ويجوز لأي طرف، بعد الإخطار، نقل أي من حقوقه أو التزاماته لعضو في المجموعة التابع لها طالما أن الكيان المذكور لديه أصول كافية لتحقيق الالتزامات الناشئة بموجب العقد، وفي حالة العميل، لا يطلب من رويترز توصيل الخدمة إلا إلى العنوان الثابت.
16,3 يخضع هذا العقد للقانون المنصوص عليه في استمارة الطلب، ويخضع الطرفان للسلطة القضائية غير الحصرية للمحاكم المبينة في استمارة الطلب.
16,4 إذا وجد أن أي جزء أساسي من هذا العقد غير قانوني لن يؤثر هذا على صحة ونفاذ بقية العقد.
16.5 إذا تأخر أي من الطرفين عن ممارسة حقوقه أو الإجراءات القانونية أو لم يستطع ممارستها بموجب العقد لا يجب على هذا الطرف التنازل عن هذا الحق أو الإجراء أو غيرها في أي مناسبة أخرى.
16,6 يتضمن هذا العقد دخول كلا من رويترز والعميل في تفاهم كامل حول موضوعه كما يلغي جميع الاقتراحات والتمثيلات والبيانات والمفاوضات والتعهدات الأخرى سواء كانت شفوية أو مكتوبة تتعلق بالموضوع ذي الصلة.
16,7 عند التوقيع على العقد لم يعتمد العميل على أية بيانات أو ضمانات أو تمثيل أو أي إجراء (فيما عدا في حالة الغش) تقوم به رويترز غير ما ذكر في العقد.
16,8 لا يجوز تعديل هذا العقد أو إبطاله؛ إلا إذا اتفق الطرفان على ذلك كتابةَ.
